1 REGULAR MEETING OF THE CITY COUNCIL: 263 Austin, Texas, April 14, 1932. The Counoil was called to order by the Mayor. Roll call showed the following members present: Councilmen Alford, Gillis, Mayor MoFadden, Councilman Mueller, 4; absent, Councilman Steck, 1. The Minutes of the last meeting were read and Councilman Gillis moved the adoption of same as read. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. Messrs. Chas. Ballard, Roy Taylor and P. W. Stark, Iron Workers, appeared before the Council and protested the employment of out-of-town skilled labor on the United Engineers & Constructors' Contract in preference to local men. After an investigation, in which Mr. Bell of the United Engineers & Constructors, was present and spoke in defense of the charges, the Council advised the protestants to confer further with Mr. Bell relative to an adjustment of the matter. An estimate, in the amount of $268.00, submitted by the City Engineer, covering cost of outting back sidewalk in front of City Hall to provide more parking space, was read. Mayor KoFadden moved that said estimate be approved and the City Manager be directed to secure bide on same. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor KoFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. The Mayor laid before the Council the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorized and instructed to purchase from Martha E. Routt, for the consideration of $37.50, for street purposes, the property desoribed as follows, to-wit: All that strip of land marked 5' reserved across the cast end of Park Place in Park Hill Addition, a Subdivision by R. L. Routt of a part of Outlot 5, Division "0" of the Government Outlots adjoining the City of Austin, Travis County, Texas, according to a map or plat of said Park Hill Addition, as recorded in Travis County Court Records, Plat Book 3, Page 91. BE IT FURTHER RESOLVED: THAT the sum of $37.50 be and the same is hereby appropriated out of the Street Improvement Bond Fund, for the purpose of paying for said property, and that a warrant for said amount be issued to Martha E. Routt, upon delivery by her of her General Warranty deed to said property. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. The Mayor laid before the Council the following resolution: WHEREAS, heretofore West 44th Street was dedicated as a street by the owners, Jessie Ramsey Murray, Euphie Ramsey Taylor and Winnie Ramsey Nitschke, by their Resubdivision of Lot 1, of Lewis Hancock Subdivision of a portion of the George W. Spear League, a plat of said Subdivision being recorded in Book No. 2, at Page 133, of the Plat Records of Travis County, Texas, and the plat of said Resubdivision being filed for record by said parties on June 30, 1931, and being recorded in Book 3, at Page 182, of the Plat Records of Travis County, Texas; and 264 WHEREAS, said Resubdivision was revised and again resubdivided by the owners thereof, as shown by the plat of said second or last resubdivision, filed for record by said parties and recorded in Plat Book No. _, at Page _ of the Plat Records, Travis County, Texas, and said last resubdivision shows a shifting of said West 44th Street to the north of the street lines shown by said first Resubdivision; and in order to locate the street as shown in said second resubdivision, and to preserve the original full width of same, it has become necessary and it is agreed between the owners of said Resubdivision and the City of Austin that there shall be an exchange between said parties each of a strip of land on the respective sides of said street; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT, for the consideration hereinafter expressed, the City Manager be and he is hereby authorized and instructed to convey by quitclaim deed, in the name of the City of Austin, to Jessie Ramsey Murray, Euphie Ramsey Taylor and Winnie Ramsey Nitschke the following described strip of land, in the City of Austin, Travis County, Texas, to-wit: Beginning at a point in the east margin of Burnet Road and the north margin of West 44th Street which is s. 60052 E. a distance of 25.0 feet from a point in the west line of Lot No. 1, Lewis Hancock Subdivision, which point is N. 29015 1. 108.47 fost distant from the 8. W. corner of said Lot No. 1, Lewis Hancock Subdivision of a portion of the George W. Spear League of record in Book No. 2, Page 133, Travis County, Texas, Plat Records; thence 8. 60052 1. with the south margin of w. 44th Street 112.55 feet distance to the west margin of Alice Avenue; thence N. 170271. with the west margin of Alice Avenue 8.6 feet distance to a point in W. 44th Street; thence N. 30°00 พ. 110.0 feet distance to east margin of Burnet Road; thence 8. 29°15 W. with the east margin of Burnet Road 9.5 feet distance to the place of beginning. Babel, General Agent of the Missouri-Pacific Lines, requesting that said Company be granted a franchise to extend its track located south of the stor- age yard of the Water and Light Plant across West Avenue between West Third and West Fifth Strests to serve the warehouse of Brown & Root, Inc., was read. The Mayor then laid before the Council the following ordinance: AN ORDINANCE GRANTING TO THE INTERNATIONALGREAT NORTHERN RAILROAD COMPANY THE RIGHT TO CONSTRUCT, MAINTAIN AND OPERATE A RAILROAD TRACK OVER AND ACROSS WEST AVENUE, BETWEEN WEST THIRD STREET AND WEST FIFTH STREET IN THE CITY OF AUSTIN, SUBJECT TO CERTAIN CONDITIONS. The above ordinance was read the first time and laid over. The Mayor laid before the Council, for its third reading, the following ordinance: AN ORDINANCE GRANTING TO THE INTERNATIONALGREAT NORTHERN RAILROAD COMPANY THE RIGHT TO CONSTRUCT, MAINTAIN AND OPERATE A TRACK OVER AND THROUGH THE ALLEY RUNNING THROUGH BLOCKS 23 AND 22, AND OVER AND ACROSS SAN ANΤΟΝΙΟ STREET, FOR THE PURPOSE OF SERVING BLOCKS 187 AND 188, IN THE CITY OF AUSTIN, SUBJECT TO CERTAIN CONDITIONS. The above ordinance was read the third time and laid over. 265 The Mayor laid before the Council the following resolution: WHEREAS, the residents of Lockhart Drive in Blue Bonnet Hills Addition to the City of Austin have petitioned the City Council to open said street westerly from Newning Avenue to Brackenridge Street; and WHEREAS, after investigation by the City Engineer, it is deemed advisable to open said street; and WHEREAS, in order to open said street, it becomes necessary to purchase Lot No. 9, Blue Bonnet Hills Addition, from Joe St. John, Owner, for the sum of $650.00; and WHEREAS, T. C. Steiner, the other property owner involved, has agreed to dedicate the land owned by him for the opening of this street provided the City will grade same; and WHEREAS, it is deemed expedient that this work should be commenced as soon as practicable; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT, after T. 0. Steiner has executed a dedication, without cost to the City of Austin, of that portion of the land which lies between Brackenridge Street and Lot #9, of Blue Bonnet Hills Addition needed for street purposes, the City Manager is hereby authorized to complete negotiations with Joe St. John for the purchase of Lot No. 9 of the Blue Bonnet Hille Addition at a cost not to exceed the sum of $650.00; and BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of Six Hundred and Fifty Dollars ($650.00) be and the same is hereby appropriated out of the Street Improvement Bond Fund of the City of Austin for the purchase of said Lot No. 9, Blue Bonnet Hills Addition, and that warrant in said amount issue therefor, payable to Joe St. John, Owner, and to be delivered to said party after approval of title to said land by the City Attorney and delivery by said party of his general warrant deed to said land. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gil116, Mayor NoFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. Counoilman Alford stated to the Council that he had prepared a resolution to be introduced at today's meeting, calling for a reduction in the expenditures of the 1932 City Budget, but on account of the absence of Councilman Steck, would defer the introduction of same until the next regular meeting. He further stated that in his opinion the City Budget could be out several thousand dollars without curtailing the operation of the city government, and thought that same should be done. Councilman Mueller asked that the Council postpone action on the above matter until the committee on city affairs appointed by the Taxpayers' League to look into the situation had made its report. Councilman Gillis brought to the attention of the Council the bad condition of Kinney Avenue and the desirability of widening same at certain points. The matter was referred to the City Manager for attention as soon as possible. The Mayor laid before the Council the following resolution: WHEREAS, Lots Nos. 19 and 20, in Outlot 33, Division "0", Plat 21, are assessed in the name of John T. Depew Estate; and WHEREAS, the taxes against said property are delinquent for the years 1913 to 1931, inclusive, and the City has a tax title to same; and WHEREAS, a fair present-day valuation of this property is deemed to be $1425.00, the taxable value of same being $950.00; and 266 WHEREAS, one of the heirs of this estate is attempting to clear up the indebtedness against same and assume the responsibility for keeping the taxes on same paid up in the future; Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT in order to effect a settlement of the taxes on this property, the assessed valuation on same be placed at $950.00 for the years 1913 to 1931, inclusive, and the Tax Assos- or and Collector be and he is hereby authorised to change his rolls accordingly, provided settlement is made at once by the heirs of said estate, in the amount of $691.18. Whereas, on the 18th day of April, 1932, the Central Freight Lines, Inc., made application for a permit to install one underground 280 gallon gasoline tank and pump for private use only.
