306 Councilman Mueller moved that the Council give a vote of confidence in the ability and integrity of the Architect, H. F. Kuehne. Motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; nays, none. Architect Kuehne then expressed his deep appreciation to the Council for their confidence and support and for being allowed a part in seeing his long-cherished dream of a pub- 110 library for the City materialize. The Mayor also extended the thanks of the Oity Council to the Library Commission for their earnest and painstaking efforts in the construction of the library building. Councilman Alford then moved to recess, subject to call of the Mayor. Motion was seconded by Mayor McFadden and same prevailed by the following vote: Ayes, Councilmen Alford Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; nays, none. The Council then recessed. REGULAR MEETING OF THE CITY COUNCIL: Approved WM Faiaden Mayor. Austin, Texas, May 26, 1932. The Council was called to order by the Mayor. Roll call showed the following members present: Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; absent, none. The Minutes of the last meeting were read and Councilman Alford moved the adoption of same as read. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steok, 5; nays, none. Mr. E. C. Rather presented to the Council thirteen petitions, signed by approximately six hundred and fifty taxpayers and merchants of the City, protesting the cut in the salaries and wages of city employes for the year 1932. Mesars. E. 0. Rather, 8. Ferris, Chris Callan, Rabbi Samuel H. Baron, Phillip Johnson, C. W. Moore, Dr. E. P. Sohooh, H. C. Colley, Deputy Labor Commissioner, and V. H. Pannell, spokesmen for a large delegation of citizens present, urged that the Council rescind its former action in reducing the salaries and wages of city employes, pointing out the loss resulting to the business firms of the City by a curtailment of expenditures of city employes, and the setting of a precedent for county and state salary reductions. Councilman Gillis presented a petition signed by the merchants of South Austin, protesting against any out in the salaries and wages of city employes drawing less than $150.00 per month, and stated that he did so at the request of such petitioners, but that he was not supporting such petition. A. C. Baldwin, Chairman of the Sub-committee on City Affairs of the Travis County Taxpayers League, was present and spoke in defense of the Committee's action in recommending a reduction in the salaries and wages of city employes. " 307 After hearing the above discussions, the Mayor stated to those present that the Council would give the matter further serious study. A committee of citizens, composed of Dr. R. V. Murray, H. E. Kelley, Wallace Tobin, W. A. Dyer, Claude W. Voyles, Howard Martin, Fred O. Morse, and Dr. Fred A. Murray, appeared before the Council in behalf of the Austin Street Railway Company, advising that, owing to competition by the 104 taxis, said Company will be financially unable to operate much longer unless some relief is given, and urged that steps be taken to insure a dependable method of transportation for the citizens of the City. Written communications relative to the matter were also received from Chas. H. Ravey, Dr. H. A. Boott, R. Walter Davis, Mountjoy Parts Company, G. K. Eifler, Mrs. A. H. Osburn, Past President Settlement Club, Wm. J. Frees, E. H. Hughes, Bob Drenner, Homer Wallace, G. 8. Heflybower, Hirshfeld & Anderson, Dr. R. V. Murray, and Howard Martin, Inc., The Mayor stated to the Committee that the Council realized the seriousness of the situation and had had the matter under advisement with the City Attorney, with a view to determining what relief could be given. The Mayor laid before the Council the following resolution: WHEREAS, on the 23rd day of May, 1932, the City Park Board presented a resolution recommending that the City Council appropriate an additional sum in the amount of Nine Hundred and Eighty-four Dollars and Eleven Cents ($984.11) for further development of East Avenue between 8th and 14th Streets; and WHEREAS, the City Council has favorably considered same; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the additional sum of Nine Hundred and Eighty-four Dollars and Eleven Cents ($984.11) is hereby appropriated out of the Parks and Playgrounds Bond Fund for the purpos of additional improvement of East Avenue between 8th and 14th Streets. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; nays, none. A resolution of the Park Board, asking that the City appropriate the sum of $500.00 for the purchase of a contour map of Shoal Creek from W. T. Caswell, to be used in the future development of Shoal Creek Park, was read, and the matter was referred to the City Manager to have the proper resolution prepared making the appropriation. The following communication from the Consulting Engineer was read: "Austin, Texas, May 11,1932. Mr. Adam R. Johnson, Oity Manager, Austin, Texas. Dear Sir: Mr. A. L. Peterson owns Lots 1, 2, 3, 4, 5, and 6 in Blook 2 of Lee's Hill Add1tion, which lots abut on the east side of Alice Avenue just north of Fortieth Street. These lots come to a point at Fortieth Street and at the deepest point are about 85 feet deep. The average depth of the lots is approximately 51 feet. Mr. Peterson is assessed for 175.46 feet of paving frontage, the total amount being $616.92. An adjustment has been requested on this assessment. I would recommend that due to the shape of the lots and in accordance with paving adjustments previously made on this street, the City bear fifty (50) per cent of the paving cost against this property. Mayor MoFadden moved that the above recommendation of the Consulting Engineer be approved and that the City Manager be directed to make the adjustment as recommended. Motion 308 was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; nays, none. A communication from H. R. F. Helland, Consulting Engineer, stating that the flushcoating of Colorado Street from Becond to Fifth Streets and from Sixth to Eighth Streets, being Units 200-5 and 200-6, had been completed in accordance with the contract with Southwest Bitulithic Company, and recommending the acceptance of same, was read. The Mayor then laid before the Council the following resolution: RESOLUTION ACCEPTING DOUBLE FLUSHOOATING CONSTRUCTED BY SOUTHWEST BITULITHIO COMPANY ON A PORTION OF COLORADO STREET IN THE CITY OF AUSTIN AND PROVIDING FOR PAYMENT BY THE CITY OF AUSTIN. WHEREAS, on the 25th day of November, 1931, the City of Austin entered into a contract with Southwest Bitulithio Company whereby said Company agreed to construct double flushcoating upon portions of streets in the City of Austin, Texas, among which portions of streets was the following, to-wit: and COLORADO STREET from south line of Second Street to the south line of Fifth Street; COLORADO STREET from the north line of Sixth Street to the south line of Eighth Street WHEREAS, said contractor has fully completed the street improvements upon said streets above described in accordance with its contract and the plans and specifications made a part thereof, and said improvements have been found satisfactory and approved by the Consulting Engineer of the City, and have been found satisfactory and in accordance with the contract by the City Council of said City; therefore, BE IT RESOLVED BY THE OITY COUNCIL OF THE CITY OF AUSTIN: .Ι. That the street improvements constructed by Southwest Bitulithic Company upon said portion of Colorado Street, hereinbefore described, be and the same are hereby in all things approved and accepted by the City of Austin. II. That the cost of said improvements be paid to said Contractor by the City of Austin. III. That this resolution take effect at once. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; nays, none. A resolution of the Park Board, submitting their revised budget for the year 1932, in the amount of $5050.00, to the City Council for approval, was read. The matter was referred to the City Manager for a report on the item, "011, Gas, etc." contained therein before the resolution approving same is adopted. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: 309 (1) A gas main in WEST TWENTY-FIFTH STREET from Seton Avenue to Rio Grande Street, the centerline of which gas main shall be 25 feet south of and parallel to the north line of said West Twenty-fifth Street. Said gas main described above shall have a cover of not less than 22 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best recorde we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department not lees than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT wherever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of back-filling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets, and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager and under all the pertinent terms and conditions of the certain franchises granted to said company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillig, Mayor McFadden, Councilmen Mueller and Steck, 5; naye, none. The Mayor laid before the Council the following: "Austin, Texas, May 26, 1932. i Mr. Adam R. Johnson, Oity Manager, Austin, Texas. Dear Sir: We have received a request from the State Highway Department for a permit to make a set back on Brazos Street south of 11th Street. I have consulted with the State Highway Department Engineers and we have agreed upon the grades which will be used provided the City Council grants their request. I have consulted with the Traffic Police Captain of the City of Austin and he considers that it will be of benefit to the City to have the permit granted. I recommend that the permit be granted in accordance with the accompanying plan and resolution. Respectfully submitted, (Sgd) Orin E. Metcalfe, Oity Engineer. WHEREAS, the Highway Department of the State of Texas has presented a request to make an off-set from the regular curb line on the west side of Brazos Street adjacent to the proposed new Highway building to permit parking on Brazos Street; and WHEREAS, the making of an off-set in the curb line as requested would facilitate the movement of traffic on Brazos Street by providing additional roadway; and WHEREAS, the City Engineer has reviewed the plan and made a study of the proposed off-set in the curb line and recommends that said request be granted; and WHEREAS, the City Council has favorably considered said request; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT permission is hereby granted to the Highway Department of the State of Texas to make an off-set from the regular ourb line on the west side of Brazos Street adjacent to 310 the proposed new Highway building in accordance with the accompanying plan marked 2-G-174, which plan is hereby made a part of this resolution; and That the area between existing ourb and proposed new curb shall be paved with concrete or other approved type of pavement according to Oity of Austin standard specifications; and That that portion of the proposed new curb adjacent to the sidewalk shall show an exposure on the front face of at least six (6) inches; and That the construction of said pavement, new ourbe and sidewalks adjacent to the said proposed new Highway building, all as shown on attached plan marked 2-G-174, shall be done under the direction and supervision of the City Engineering Department. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; nays, none. No further business coming before the Council, Councilman Mueller moved to recess, subject to call of the Mayor. The Council then recessed. SPECIAL MEETING OF THE CITY COUNCIL: AW.M Faseden Approvedr Mayor. Austin, Texas, May 30, 1932. The Council was called to order by the Mayor. Roll call showed the following members present: Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steck, 5; absent, none. The Mayor stated that the meeting was called for the purpose of considering the following communication from the Austin Clearing House Association: "Austin, Texas, May 27, 1932. To the Hon. Mayor and City Councilmen of Austin, Gentlemen: The Austin Clearing House Association, through all of its member banke, as undersigned, respectfully recommends that the penalty date on 1931 city taxes be further deferred from June lat to sometime in the fall, preferably not earlier than October 1st. The matter has been given careful thought, and we feel that our suggestion is well justified by general business and economic conditions now existing, and that its adoption by you will afford those of our tax payers who are affected the relief to which under the circumstances they are entitled Also, it is the unanimous thought of this Clearing House Association that you again give consideration to the collection of taxes in quarterly payments.
