REGULAR MEETING OF THE CITY COUNCIL: 375 Austin, Texas, June 16, 1932. The Council was called to order by the Mayor. Roll call showed the following members present: Councilmen Alford, Gillis, Mayor Mofadden, Councilmen Mueller and Steok, 5; absent, none. The Minutes of the last meetings were read and Councilman Steck moved the adoption of same as read. Motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; nays, none. The Mayor laid before the Council, for its second reading, the following ordinance: AN ORDINANCE AMENDING AN ORDINANCE EN- TITLED "AN ORDINANCE REGULATING THE OPERATION AND USE OF AUTOMOBILES ENGAG- ED IN THE BUSINESS OF CARRYING PASSENGERS FOR HIRE WITHIN THE CITY OF AUSTIN, PRO- VIDING FOR THE LICENSING AND BONDING OF SAME, PRESCRIBING PENALTIES FOR THE VIO- LATIÓN HEREOF, REPEALING OF ORDINANCES IN CONFLICT HERENITH, AND DECLARING AN EMERGENCY PASSED BY THE CITY COUNCIL AND APPROVED MARCH 8, 1932, IN THE CERTAIN PARTICULARS HEREINAFTER STATED. The above ordinance was read the second time and laid over. The Mayor laid before the Council, for its second reading, the following ordinance: AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE TO DEFINE THE TERM 'JITNEY TO LICENSE AND REGULATE THE OPERATION OF JITNEYS ON THE STREETS AND PUBLIC PLACES OF THE CITY OF AUSTIN, AND PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF", IN THE CERTAIN PARTICULARS HEREINAFTER STATED. The above ordinance was read the second time and laid over. The Mayor laid before the Council the following resolution: WHEREAS, on the 31st day of March, 1932, the City Council accepted the proposal of Brown & Root for the reconstruction and asphalting of East Avenue or Cameron Road from the Manor Road northerly to the City limits, in accordance with their unit price bid, making an estimated cost in the sum of Five Thousand One Hundred and Eighty-five Dollars ($5,185.00); and WHEREAS, engineering and contingent expenses will be approximately 5%, making the cost of the project in the total sum of Five Thousand Four Hundred and Forty-four Dollars and Twenty-five Conte ($5,444.25); and WHEREAS, the City Council has favorably considered same; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of Five Thousand Four Hundred and Forty-four Dollars and Twenty-five Cents ($5,444.25) is hereby appropriated out of the Street Improvement Bond Fund for the purpose of improving and asphalting East Avenue from the Manor Road northerly to the City limits. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; nays, none. The Mayor laid before the Council the following resolution: WHEREAS, on the 14th day of April, 1932, the City Council approved the construction of a curb setback on 8th Street in front of the City Hall; and 376 WHEREAS, said work has been completed and the Engineer's estimate shows that same will cost One Hundred and Fifty-Seven Dollars and Sixty Cents ($157.60); therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of One Hundred and. Fifty-seven Dollars and Sixty Cents ($157.60) be and the same is hereby appropriated out of the unappropriated contingent fund of the General Fund of the City of Austin for the purpose mentioned above. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steok, 5; nays, none. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: 1. A gas main in RAINBOW BEND from Windsor Road casterly approximately one block to Parkway, the centerline of which gas main shall be 30 feet north of and parallel to the south line of said Rainbow Bend. Said gas main described above shall have a cover of notless than 22 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations of working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT wherever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of back-filling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shal1 be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said company by the City of Austin. 1 The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; nays, none. The following report of the City Engineer was read: Mr. Adam R. Johnson, City Manager, Austin, Texas. Dear Sir: "Austin, Texas, June 1, 1932. Following is a tabulation of the cost of the widening and improving of Barton Springs Road with asphalt. We have placed an asphalt mat equal in thickness to that which will be given to us under recent bid prices on work in this Oity at the rate of 33d per square yard. The total amount of asphalt widened or resurfaced by us, which does not include the small patches in the center of the street, was 13,485 square yards at a total of $3268.63. This makes our work cost us 2444 per square yard. The detail estimate of cost is as follows: Asphalt surface widening on Barton Springs Road, Congress Avenue to Barton Springs Oreek: 170 sq. yds. pea gravel at $1.25 ---- 9 cars of crushed stone ----- --- 293 barrels asphalt at $3.85 29 days, Foreman and truck, at $10.00--$212.50 755.33 1,128.65 290.00 72.00 723.00 270.00 9 days truck time, including driver, at $8.00241 days labor at $3.00 ------------ 27 days roller at $10.00 ------- Less paid by Sohutze Filling Station Π $3,450.88 Total - ----- $141.50 40.75 $188.25- Net Cost to City - 182.25 $3,268.63 Wende Store ------- 377 Respectfully submitted, (8gd) Orin E. " The Mayor then laid before the Council the following resolution: WHEREAS, Barton Springs Road has been widened, improved and reasphalted by the Street Department of the City of Austin; and WHEREAS, the City Engineer's report shows that the cost of said work was Three Thousand Two Hundred and Sixty-eight Dollars and Sixty-three Cents ($3268.63) and has been paid out of the Street and Bridge Division fund; and WHEREAS, said work is in reality new construction work and was not contemplated at the time the budget for 1932 was prepared; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of Three Thousand Two Hundred and Sixty-eight Dollars and Sixty-three Conts ($3268.63) is hereby appropriated out of the unappropriated contingent fund of the General Fund of the City of Austin to reimburse the Street and Bridge Division portion of the Engineering Department funds. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor NoFadden, Councilmen Mueller and Steck, 5; nays, none. No further business coming before the Council, Councilman Steck moved to recess, subject to call of the Mayor. Motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilmen Mueller and Steok, 5; nays, none.
