386 REGULAR MEETING OF THE CITY COUNCIL: The meeting was called to order by the Mayor. members present: Councilman Gillis, Mayor KoFadden, absent Councilman Alford, 1. Austin.. Texas, June 30, 1932. Roll call showed the following Councilmen Mueller and Steck, 4 The Minutes of the last regular meeting, both morning and afternoon sessions, were read and Councilman Gillis moved the adoption of same as read. Motion seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Councilman Gillis, Mayor NoFadden, Councilmen Mueller and Steok, 4; nays, none. The Mayor laid before the Council the following ordinance: ORDINANCE CANCELLING CONTRACTS BETWEEN SOUTHWEST BITULITHIO COMPANY AND THE OITY OF AUSTIN, PROVIDING FOR THE IMPROVEMENT OF PORTIONS OF EAST SIXTEENTH STREET IN SAID CITY OF AUSTIN, TEXAS. The above ordinance was read the first time and Mayor NoFadden moved a suspension of the rule and the plackyof the ordinance on its second reading. The Mayor laid before the Council the following communication received from the Colored Community Welfare Association: To the Honorable Mayor, Oity Manager and Council, Austin, Tехав. Gentlemen: Austin, Texas, June 30, 1932. The Community Center, located at 1186 Angelina Street, was erected by the Community Welfare Association in the fall of 1929, at a cost of $7,050.00, including land, furnishings and other expenses. The Center is uniquely located for serving the Colored population as a health center, recreation center for small children and older people, a library center, since it is easily accessible to most of the schools, and a meeting place for the ParentTeacher Association, and Volunteer Health League. The Community Welfare Association is an incorporated organization to do charitable wоrk, соmроsed of all the Negro Women's Federated clubs of the city, except the King's Daughters. It has striven earnestly to maintain the work for which the Jenter was erected with the hope that at some time this place would become a part of the city's charge for our group. With this in view, the organization requests the right to submit to this Council for Its consideration as a location for these units its equity in the Center, if selected for a library site. The Mayor laid before the Council the following: "Austin, Texas, June 28, 1932. Mr. Adam R. Johnson, City Manager, Austin, Texas. Dear Sir: Following is a comparison of bids for a street sweeper: 388 AUSTIN WESTERN ROAD MACHINERY COMPANY making an allowance for one old Elgin Sweeper and making an allowance for cash, submits a bid, cost to the Oity, F. O. B. Austin, in the sum of THE WALTER TIPS COMPANY offers an ELGIN SWEEPER, according to a proposal by the district representative of the Elgin Sweeper Company, as follows: Basic bid price LESS the following allowances: Old sweeper Discount for cash Repair parts allowances, to be ordered when need- ed for either old or new sweeper, $400.00 122.00 $6,780.00 $5,965.00 300.00 Total allowances NET cost to the City 822.00 $5,958.00 The Elgin Sweeper Company's allowance of $300.00 for repair parts will very likely be needed during the year 1932 for one of the Elgin Sweepers which we now have in use. I recommend the purchase of the Elgin Sweeper for the following reasons: The Elgin Sweepers previously in Austin service have given satisfaction. There would be some advantage in the interchangeability of parts as the Elgin equipment gets older, if all of the machines are of the same make. I have witnessed demonstrations of both types of machines, and I was better iюргеввed by the operation of the Elgin Sweeper. The Elgin Sweeper sweeps closer to inlets and is more easily turned on corners and dead-end streets. I like the dumping method of the Elgin Sweeper better than the Austin Western. Statistics as to the cost of repairs, maintenance and operation of the two machines, as obtained from various Texas sources and personal investigations, show that they are cодflicting but appear to be about equal. After discussing the above bide, Councilman Steck moved that the bid of The Walter Tips Company for one Elgin Sweeper, at a net cost to the City of Austin, of $5,958.00 be accepted, and the Oity Manager be instructed to purchase ваше. The Mayor laid before the Council the following Resolution: WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be, and the same is hereby permitted to construct its pole lines in the following streets: 1. A telphone pole line in CAPITOL STREET from Hearn Street to CENTER Street, to the centerline of which pole line shall be 12 feet north of and parallel to the south line of said Capitol Street. THAT the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed, shall be under the supervision and direction of the City Manager. The above resolution was adopted by the following vote: Ayes, Councilman Gillis 389 Mayor MoFaddin, Councilmen Mueller and Steck, 4; nays, none. The Mayor laid before the Council the following Resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following strecta: 1. A gas main in Lynn Street from Holly Street to Riverview Street, the center1ine of which gas main shall be 19 feet west of and parallel to the east line of said Lynn Street. Said gas main described above shall have a cover of not less than 22 feet. 2. A gas main in Haskell Street from Chicon Street to Canadian Street, the conterline of which gas main shall be 20 feet south of and parllel to the north line of said Haskell Street. Said gas main described above shall have a cover of not less than 21 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depthe may be required at special points. When the Texas Public Service Company requires definite informa- tion upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution; and THAT wherever payement is cut in the vicinity of a fire plug, water must be used at intervals during the course of back filling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets, and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchises granted to said company by the City of Austin. The above Resolution was adopted by the following votel Ayes, Councilman Gillis Mayor NoFadden, Councilmen Mueller and Steck, 4; nays, none. The Mayor laid before the Council the following Resolution: WHEREAS, on the 4th day of March, 1931, the Park Board of the City of Austin set aside the sum of Seven Thousand Five Hundred Dollars and No/100 ($7,500.00) in addition to monies previously allotted for the development of Fruth Park or Central Park, subject to the consideration of the City Council of the Oity of Austin, and, WHEREAS, said appropriation has not been needed previous to this time, and WHEREAS, Brown and Root, contractors for the development of the drives of Fruth Park, are now entitled to an estimate and a portion of said fund will be needed, and WHEREAS, the City Council has favorably considered same; therefore, i 390 BE IT RESOLVED BY THE CITY COUNCIL OF THE OITY OF AUSTIN: THAT the additional sum of Seven Thousand Five Hundred Dollars and No/100 ($7,500.00) is hereby appropriated out of the Parks and Playgrounds Bond Fund for the purpose of additional developments in Fruth Park or Central Park. : :: The above Resolution was adopted by the following vote: Ayes, Councilman 011118, Mayor McFaddin, Councilmen: Mueller and Steck, 4;nays; none. Gentlemen: Kindly grant us the right to set our ourb back on Red River Street in front of our now store building just south of 18th street. Dear Sir: The request of Wesly Stone and Mary Lou Stone, owners of Lot No. 8 of Outlot No. 65, Division "E" of the Government Outlots of the City of Austin, for a permit to set their curb back on the east side of Red River Street, south of 18th street, has been received and considered. trict. Wesly Stone and Mary Lou Stone's property is within the "C" Commercial Use DisThe use of the proposed set back area by the customers of the Weely Stone and Mary Lou Stone business building will aid traffic thru Red River Street. I recommend that this permit be granted, subject to the following conditions: (1) That the reconstruction of the set back area on Red River Street shall be concreted in accordance with the accompanying plan marked 2-0-459, and that all such widened area, ramps and curbs shall be constructed of concrete at the expense of the applicant. (2) That all such concrete work shall be not less than 6" in thickness and of the following proportions: 1 part of coment, 2 parts of sand, and 4 parts of screened gravel or rook. (3) That the concrete curb to be constructed shall be not less than 6" high and an expansion joint not less than 3/4" thick shall be placed between the ourb and sidewalk. (4) That all concrete work within the street area shall be executed by a bonded sidewalk contractor. (5) That all work shall be done in accordance with lines and grades furnished by the Engineering Department of the City of Austin, and under the direction of the City Engineer. The Mayor then laid before the Council the following Resolution: WHEREAS, Wealy Stone and Mary Lou Stone, owners of lot No. 8, Outlot No. 65, Division "E" of the Government Outlots adjoining the City of Austin, Texas, which lot is situated at the southeast corner of Red River and 18th Streets; and WHEREAS, Wesly Stone and Mary Lou Stone have requested the City Council to grant them a permit to set their curb back so as to provide more parking space on Red River Street; and WHEREAS, a plan has been presented showing the proposed layout, and said plan has been considered and approved by the City Council of the City of Austin; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT permission is hereby granted Wesly Stone and Mary Lou Stone, owners of Lot No. 8, Outlot No. 65, Division "E" of the Government Outlots adjoining the City of Austin, to move the curb back in front of a portion of their property on the cast side of Red River Street and south of 18th Street, all construction to be in accordance with the plan approved by the City Engineer, which plan is hereto attached and marked 2-0-459; and further subject to the conditions set forth in the attached recommendation of the City Engineer, which plan and recommendation is hereby make a part of this resolution, and that this permit is made subject to all work being done in accordance with the directions of the Oity Engineer and the expense of all work incident to said construction shall be borne by the applicant. The Mayor laid before the Council the following: "Austin, Texas, June 24, 1932. Honorable Mayor and City Council, City of Austin, Austin, Texas. Gentlement I hereby make application for permission to construct, maintain and operate a drive-in gasoline filling station at the northeast corner of West 38th Street and Alice Avenue. All city rules and regulations shall be complied with in construoting, maintaining and operating this station. (sgd) Yours truly, Sam Payne." "Austin, Texas, June 29, 1932. Mr. Adam R. Johnson, Oity Manager, Austin, Teхав. Dear Sir: I have considered the application of Sam Payne for a permit to construct, maintain and operate a drive-in gasoline filling station to be located at the northeast corner of West Thirty-sight Street and Alice Avenue, same being legally described as Lot 2, Blook 2 of Seiders Addition in the Geo. W. Spear League, and hereby advise that the following conditions existi (a) He proposes to construct his filling station on property which is shown on the zoning map as being located within the "C" Commercial Use Distrid. (b) A storm sewer exists within 30 feet of the property on which Mr. Payne proposes to construct his filling station, and into which waste water can be concentrated. (c) Sam Payne proposes to comply with all ordinances regulating filling stations. I recommend that Sam Payne be granted a permit to construct and operate said filling station subject to the following conditions: (1) That all buildings and equipment shall be placed inside of the property line, correct lines to be obtained before construction starts, or equipment installed. Lines and grades to be obtained from the City Engineering Department for entrances and driveways, building plans to be approved by the City Building Inspector. That the applicant shall confer with the City Engineering Department as to the future grades of the sidewalks and gutters on the adjacent streets before he starts any construction relating to the filling station. 391 392 (2) That all construction of the filling station improvements shall be in accord with the Building Ordinance, Zoning Ordinance, Filling Station Ordinance and in accord with the ordinance prohibiting the disposal of commercial water or oil upon the city streets. (3) That the grades of the station shall be such that no waste oils or water or any floor washing shall ever: pass over the city sidewalk arsa, and that all of said oils and water shall be concentrated into a combined grease and sand trap which shall be constructed in accordance with our standard plan 2-H-48, and shall be conducted by a pipe connection from said sand trap to the nearest City storm sewer at the expense of the applicant. Before commencement of any construction the applicant shall apply to the City Engineer for an estimate of the cost of that portion of the storm sewer which will have to be built within any city street or alley and shall deposit in escrow a sum equal to said estimate with the City Finance Director. (4) That pumps shall be located as shown on the plan hereto attached marked 2-H-276. (5) That all adjacent sidewalks, ramps and curb returns adjacent to that property to be developed as a filling station shall be constructed of concrete and in accordance with plan 2-H-276. (6) That before use of said station the owner shall apply to the Building Inspector for final inspection when he considers that he has complied with all the requirements of the City. The Mayor then laid before the Council the following Resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves that northeast corner of West Thirty-eighth Street and Alice Avenue, same being legally described as Lot 2, Block 2 of Seiders Addition in the Geo. W. Spear League, and hereby authorizes Mr. Sam Payne to construct and operate a filling station subject to same being constructed and conforming with all the Ordinances relating thereto, and further subject to the foregoing attached recommendations and plans, and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of this filling station after full compliance with all of the provisions of this resolution, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained, if, after hearing, it is found by the City Council that Sam Payne has led and refused and will continue to fail and refuse to perform any such conditions, regulations and ordinances. The above Resolution was adopted by the following vote: Ayes, Councilman Gillis, Mayor MoFaddin, Councilmen Mueller and Stock, 4; naye, none. The Mayor laid before the Council the following ordinancet AN ORDINANCE GRANTING TO SCHWARZER AND LOREY CERTAIN SPAΟΣ ΟΝ ΝΙΝΕETEENTH STREET BETWEEN SAN ANTONIO AND NUECES STREETS, AND IN THE ALLEY BETWEEN SAN ANTONIO AND NUECES STREETS NORTH OF NINETEENTH STREET, IN THE CITY OF AUSTIN, DURING THE CONSTRUCTION OF A CITY FIRE STATION. The above ordinance was read the first time and Councilman Mueller moved a suspension of the rule and the placing of the ordinance on its second reading.
