410 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, August 04, 1932. The Council was called to order by the Mayor. Roll call showed the following members present: Councilmen Alford, Gillis, Mayor Mofadden, Councilman Mueller, 4; absent, Councilman Steck, 1. The Minutes of the last meeting were read and Councilman Alford moved the adoption of same as road. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. The application of J. D. Pelphrey for permit to construct a concrete driveway acтоев the sidewalk area south of his Funeral Home on Twelfth Street was read. Judge Geo. Mendell, Attorney for Mrs. J. E. Howze, adjacent property owner, presented a written protest against the granting of the permit. Councilman Mueller moved that the above permit be granted, and that the City Attorney be instructed to draw an ordinance prohibiting parking on the north side of Twelfth Street from Lavaca Street went to the J. E. Howze property. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mueller, 3; nays, Mayor McFadden, 1; absent, Councilman Steck, 1. Skinny Pryor came before the Council and asked that a part of the Parks & Playgrounds Bond money on hand be spent in laying out a golf course on the Zilker tract, developing the grounds, and widening the roadway at Barton Springs. The Council took no action on the matter, but advised Mr. Pryor that the Park Board had under consideration the development of this golf course. Edwin 0. The City Attorney reported to the Council that the deed conveying the Zilker tract of land at Barton Springs to the City, as authorized by the voters of the City at an election held December 21, 1931, had been executed by the grantor, and that City Warrant for the sum of $50,000.00, cash payment, together with fifteen notes, each for the sum of $10,000.00, representing the purchase price of said land, had been executed by the City Manager. The Mayor laid before the Council the following resolution: WHEREAS, the south 15 feet of Lote 8, 9, 10, and 11, Outlot 7, Division "0", Country Club Lawns, Plat 66, was assessed in the name of Maude E. Stark for the years 1928, 1929, 1930, and 1931; and WHEREAS, the only address that the tax department had in this name was Austin, Texas, and no statements ever reached said Maude E. Stark; and WHEREAS, W. L. Stark was discovered to be the husband of Maude E. Stark, and the assessment on the above described property adjoins a tract, 209x208 feet, which is the home place of W. L. and Maude E. Stark, and W. L. Stark states that he supposed the fifteen feet, as above, was included in the assessment of the home property, the taxes on which have been paid each year; Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Tax Assessor & Collector be and he is hereby authorized to accept payment of the taxes for the years 1928, 1929, 1930, and 1931 on the south 15 feet of Lots 8, 9, 10, and 11, Outlot 7, Division "0", Country Club Lawns, Plat 66, without penalty and interest. The application of M. L. Pearson for permit to construct a stone walk in front of his property at 601-603-605 West 37th Street was read. The Mayor then laid before the Council the following: "Austin, Texas, August 4,1932. Mr. Adam R. Johnson, Oity Manager, Austin, Texas. Dear Sir: I have investigated the request of M. L. Pearson and Mrs. Helen C. Pearson for a permit to construct a stone walk from the property line to the curb in front of 601, 603 and 605 West 37th Street, adjacent to Lots 1 and 2 of Block 3, Outlot 76, of the City of Austin, Texas. Mr. Pearson proposes to construct only a temporary walk with the understanding that he will remove the stone walk at any time that sidewalks are generally constructed in the neighborhood, at which time he agrees to construct his concrete sidewalk. I recommend that he be granted the right to construct a temporary stone walk subject to the following conditions: That the stone cross walks shall be laid loose in sand or earth and shall not be Joined together by concrete or cement. 413 That the fee owner of the adjacent lot be required to remove said stone walk within 30 days after receiving official notice from the City of Austin to do so. WHEREAS, the curb and sidewalk specifications of the City of Austin, which have been previously adopted by the City Council of the City of Austin, require that all ourbs and sidewalks be of concrete unless a special permit has been secured from the City Counc11 for other materials; and WHEREAS, M. L. Pearson and Mrs. Helen C. Pearson, owners of property situated at 601, 603, and 605 West 37th Street, Outlot 76, Block 3, being the east 36 feet of Lot 1, west 22 feet of Lot No. 1, and east 18 feet of Lot No. 2, and west 40 feet of Lot No. 2, respectively, have requested the City Council of the City of Austin to grant them a permit to construct a flag-stone cross walk in front of their property between the curb line and the property line; and WHEREAS, the City Council has investigated and approved the construction of said flagstone cross walks as requested; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That M. L. Pearson and Mrs. Helen C. Pearson, owners of the property situated at 601, 603, and 605 West 37th Street, Outlot 76, Block 3, being the east 36 feet of Lot No.1, west 22 feet of Lot No. 1, and east 18 feet of Lot No. 2 and west 40 feet of Lot No. 2, respectively, are hereby granted the right to construct a flagstone coross walk in front of said property, said walk to be constructed under the supervision of the Engineering Department of the City and according to lines and grades furnished by same, and further subject to the following conditions: That all said work in 37th Street shall be done by a bonded sidewalk contractor. That the stone cross walks shall be laid loose in sand or earth and shall not be Joined together by concrete or cement. That the fee owner of the adjacent lot be required to remove said stone walk within 30 days after receiving official notice from the City of Austin to do so. The petition of Theta X1 Association of Texas, Inc., asking for a change in the zoning of their property at the northwest corner of Twenty-eighth and Rio Grande Streets, from Residence "A" to Residence "B", was read. The Mayor then laid before the Council the following resolution: WHEREAS, the Theta X1 Association of Texas, Incorporated, by R. W. Byram, Secretary, owner of Lots (E) and (F), Outlot 67, Division "D" of the City of Austin, said property being located at the northwest corner of the intersection of Rio Grande and West 28th Streets, with a frontage of 102.9 feet on West 28th Street and a frontage of 132 feet on Rio Grande Street, has petitioned the City Council to amend the Zoning Ordinance so as to change the USE designation of such lots hereinabove described from "A" RESIDENCE DISTRICT to "B" RESIDENCE DISTRICT; and WHEREAS, under the terms of the Zoning Ordinance, such matters must be referred to the Board of Adjustment for its consideration and action and that a public hearing be held at which opportunity shall be given the public to offer any objections to said amendment; therefore,
