REGULAR MEETING OF THE CITY COUNCIL: 421 Austin, Texas, August 25, 1932. The Council was called to order by the Mayor. Roll call showed the following members present: Councilmen Alford, Gillis, Mayor MoFadden, Councilman Mueller, 4; absent, Councilman Steok, 1. The Minutes of the last meeting were read and Councilman Mueller moved the adoption of same as read. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilman Mueller, 4; naye, none; Councilman Steck absent, 1. The City Manager submitted to the Council a request from the Community Chest organisation that they be furnished water and light free of charge at their building, 204 West Seventh Street. Councilman Gillis moved that the request be granted. Motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. Letters from Pattons, Inc., and Lightsey's System, asking that no more taxicab licenses be granted at present, were read and filed. The following communication from Orin E. Metcalfe, City Engineer, was reads "Austin, Texas, August 24,1932. Honorable Oity Council, City of Austin, Austin, Toхав. Gentlemen: Pursuant to the instructions of the City Council, I have visited the proposed regulator site as requested by the Texas Public Service Company at Nueces Street between Second and Third Streets in company with the superintendent of said company. No were unable to find any method by which we could accomplish the purpose they desired without making the out in the paved street. The Manager, Mr. Tabor, explained to me that the new boilers recently installed by the City of Austin at the Water and Light Plant require more than twice as much pressure as the old boilers required and that to give this pressure at our power plant they have to boost the pressure over the entire northwest section of the City, increasing their cost of maintenance and greater danger from gas leaks. If the new type of equipment had not been installed at the Water and Light Plant, they would not have to make the request for this regulator pit. Although there is no emergency on account of gas leaks, it would probably be to the City's best interests to grant this permit so that in the event gas leaks would ooour there would be less danger because a lower pressure could be maintained north and west of the proposed regulator site. N i The Mayor then laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A regulator pit in Nucces Street and to be confined within the area described as follows, to-wit: 422 1 Beginning at a point in Nueces Street and on the south line produced of the alley traversing Blook 23 of the Original City of Austin, Travis County, Texas, according to a map or plat of said Original Oity on file in the General Land Office of the State of Texas, and from which point of beginning a concrete monument at the intersection of the centerline of Nueces Street and the center line of West Second Street bears N. 71° พ. 11 feet and 8. 19° พ. 168 fest; Thence 8. 19° W. 12 feet to a point; Thence 8. 71° E. & fest to a point; Thence N. 19º E. 12 feet to a point, and from which point the northwest corner of Lot 1, Block 23 of said Original City bears 8. 71° 1. 21 fest. Thence N. 71° H. & feet to the place of the beginning. Said regulator pit shall be constructed within the above area in such a manner that one axis of same will be parallel to said centerline of Nucces Street. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of back-filling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager and under all the pertinent terms and conditions of the certain franchise granted to said company by the City of Austin; provided , however, that all pavement torn up in excavating for said regulator pit shall be replaced by the Southwest Bitulithic Company at the expense of the Texas Public Service Company. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Couno11; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following strests: (1) A gas main in GIBSON STREET from South First Street to South Fourth Street, the centerline of which gas main shall be 38 feet south of and parallel to the north line of said Gibson Street. Said gas main described above shall have a minimum cover of 2 feet and at points where drainage structures are encountered said gas main shall be constructed in such a manner that the top of same will be not less than 1 foot beneath the flow line of said drainage structures. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, 423 but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. The application of Lonnie Anderson, 3805 Duval Street, for license to operate as a taxicab a 1931 Model A, Two-Door Ford Sedan, Engine No. 14708835, State Highway License No. K 40-609, was read. Councilman Mueller moved that the application be denied on the grounds that the applicant is a minor. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor NoFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. The Mayor laid before the Council the following resolution: WHEREAS, charges have been preferred against Willie Burns; as driver, who operates for Neal H. DeWitty, as owner, a taxicab under City License #202, and under State License No. K31-092, in that said Willie Burns did, on August 10th and divers other dates subsequent thereto, receive and carry passengers indiscriminately from and to various places in the City of Austin without having received calls for such transportation, and did, in other particulars, violate the terms of the ordinance regulating the operation of taxicabs; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT a hearing on said matter be had by the City Council on September 1, 1932, at eleven o'clock A. M., and that said Neal H. DeWitty be given notice to appear before the City Council at said time to show cause why said City License should not be revoked. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor NoFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. The hearing on the revocation of Taxicab License No. 53, owned by Charlie Henry, which was set for 10:00 o'clock A. M., was opened. Two witnesses were called in the case, following which Councilman Mueller moved that, upon the recommendation of the City Attorney, the charges against the said Charlie Henry be dismissed. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor NoFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. 424 No further business coming before the Council, Councilman Mueller moved to reces subject to call of the Mayor. A written protest against the erection of a negro funeral home in the 1100 block on East Sixth Street, signed by thirty-three property owners in the vicinity, was read and the matter was referred to the City Manager and City Attorney for investigation of the situation. • The hearing on the revocation of Taxicab License No. 104, owned by E. L. Jackson, which was set for 10:00 o'clock A. M., was opened. Councilman G1111s moved that the complaint against the said E L. Jackson be dismissed, in accordance with the recommendation of the City Attorney. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor KoFadden, Councilman Mueller, 4; nays, none; Counoilman Steck absent, 1, The application of Mrs. T. O. Bell, Agent for W. B. Odom, for permit to construct a rook wall in front of the property at No. 307 East 12th Street, was read. The following report of the City Engineer was also read: "Austin, Texas, August 31, 1932. Mr. Adam R. Johnson, City Manager, Austin, Texas. Dear Sir: Pursuant to your request, I have investigated the application for a permit made by Mrе. Т. О. Bell, Agent for W. B. Odom, to be allowed to construct a rock wall two feet high adjacent to the south edge of the sidewalk in front of the property known as 307 East Twelfth Street and being more particularly described as Lot No. 9, Block No. 137 of the Original City of Austin.
