The Minutes of the last regular meeting were read and Councilman Gillis moved the adoption of same as read. Letters from the Westenfield Development Company and J. T. Bowman, interested property owners, requesting a reclassification in the zoning of Enfield "A", "B", " "Σ", and Westfield so as to permit the erection of apartment houses in said districts in accordance with the deeds to said property, were read. The Mayor then laid before the Council the following resolution: WHEREAS, certain owners of property situated in Enfield "A", Enfield "B", Enfield"0", Enfield "E", and Westfield, in the City of Austin, have petitioned the City Council to amend the Zoning Ordinance so as to change the Use designation of said areas from "A" Residence District to "B" Residence District, upon the representation that the deeds to all the property situated in said areas contain the covenant that apartment houses may be built on said property; and 490 WHEREAS, under the terms of the Zoning Ordinance, such matters must be referred to the Board of Adjustment for its consideration and action, and that a public hearing be held at which opportunity shall be given the public to offer any objections to said amendment; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT said matters be referred to the Board of Adjustment for its consideration and report to the City Council; and that a public hearing be held thereon at the City Hall at 11:00 Α. Μ. on Thursday, November 10, 1932, and that notice of such hearing be completed by publication as required by the terms of said Zoning Ordinance. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE OITY OF AUSTIN: THAT the Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: 1. A gas main in ROSEDALE TERRACE from Alta Vista Avenue westerly approximately two blocks to Sunset Lane, the centerline of which gas main shall be 20 feet south of and parallel to the north line of said Rosedale Terrace. Said gas main desoribed above shall have a cover of not less than 22 fest. 2. A gas main in ROSEDALE TERRACE from Mariрова Drive southerly approximately one block to Alta Vista Avenue, the centerline of which gas main shall be 20 fest east of and parallel to the west line of said Rosedale Terrace. Said gas main described above shall have a cover of not less than 22 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. 491 When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT wherever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of back-filling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said company by the City of Austin. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilman Mueller, 4; naye, none; Councilman Steck absent, 1. The application of Austin Ice Company for permit to construct a concrete driveway at the corner of 30th and Duval Streets was read. The following report of the City Engineer on the matter was also read: "Austin, Texas, October 19, 1932. Mr. Adam. R. Johnson, Oity Manager, Austin, Texas. Dear Sir: Pursuant to your request, I have investigated the application of the Austin Ice Company as presented by A. J. Zilker, Jr., for a permit to construct and maintain commercial driveways adjacent to the property situated at the northwest corner of Duval and East 30th Streets Mr. Zilker proposes to construct a drive-in commercial building to include a retail ice vault on the south 50 feet of the southeast corner of Blook #1 of the Grooms Addition. I find that this property has been included in the "C" Commercial Use District and that there is a storm sewer in 30th Street close to this property to which a drain from the ice box can be connected. I recommend that the permit be granted subject to the terms and conditions as set forth in the accompanying resolution. Respectfully submitted, (Sgd) Orin E. Metcalfe, City Engineer. H The Mayor then laid before the Council the following resolutions WHEREAS, the Austin Ice Company by A. J. Zilker, Jr., owner of the south 50 feet out of the southeast corner of Block #1 of the Grooms Addition, which is situated at the northwest corner of Duval and East 30th Streets, has made application to the City Council for a permit to construct commercial driveways for an ice vault and other commercial purposes; and WHEREAS, the City Council has favorably considered the granting of said request, subject to the conditions hereinafter set forth; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT permission is hereby granted the Austin Ice Company, by A. J. Zilker, Jr., owner of the south 50 feet out of the southeast corner of Block #1 of the Grooms Addition, which is situated at the northwest corner of Duval and East 30th Streets, to construct commercial 492 driveways on Duval and 30th Streets, subject to the following conditions: That the driveways on both Duval and 30th Streets shall be constructed in accordance with plan #2-H-290, which is hereto attached and made a part of this resolution. That all ramps and ourb returns shall be constructed of concrete by a bonded sidewalk contractor at the expense of the applicant, and that a concrete gutter not less than 24" wide shall be constructed for a distance of not less than 56 feet adjacent to the ourb line on East 30th Street at the expense of the applicant. That concrete waike shall be constructed opposite and adjacent to the lot as set forth on said plan #2-H-290. That all waste commercial water from the ice box or other improvements shall be conducted through a trap, to be approved by the City Engineering Department, to the nearest city storm sewer at the expense of the applicant. That all work shall be done under the direction of the City Engineer. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. The application of D. E. MoArthur for permit to construct a flagstone walk at 906 West 34th Street was read. The Mayor then laid before the Council the following resolution: WHEREAS, D. E. MoArthur, owner of the property adjacent to 906 West 34th Street, it being Lote 16 and 17 of the Glennridge Addition, has applied to the City Council for permission to construct a stone cross walk adjacent to his property; and WHEREAS, the Ordinance which regulates the construction of sidewalks of the City of Austin requires that any one desiring to construct any other kind of walk on the streets of Austin other than concrete shall get special permission from the City Council; and WHEREAS, the Oity Council has investigated and approved the construction of a temporary stone cross walk; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT D. E. McArthur is hereby granted the right to construct a temporary stone oross walk in front of his property at 906 W. 34th Street, provided that all of the work, shall be of a temporary nature, and that D. E. MoArthur as owner of Lots 16 and 17, or his heirs or assigns, shall remove said temporary stone cross walk upon receiving notice from the City of Austin, whenever sidewalks are constructed in accordance with the City Ordinance governing same on the adjacent lots, and that said sidewalk shall be constructed under the supervision of the City Engineer and according to lines and grades furnished by same. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilman Mueller, 4; naye, none; Councilman Steck absent, 1. A communication from W. Gillespie Stacy, Secretary City Plan Commission, inclosing an excerpt from the Minutes of said Commission of October 3, 1932, relative to the renaming and renumbering of certain streets in the Oity was read. The following report of the City Engineer on the matter was, also, read: "Austin, Texas, October 18, 1932. Mr. Adam R. Johnson, City Manager, Austin, Texas. Dear Sir: Pursurant to the request of the City Council, I met with the City Plan Commission and conferred with them in relation to the renaming of various streets in northeast Austin. The City Plan Commission has made a report to the City Council, which report accompanies this communication. ! C Assuming that the Oity Council will approve the recommendations of the City Plan Commission, I have prepared resolutions which, if adopted, will officially rename the streets in said resolutions accompanying this report. Yours very truly, (Bgd) Orin E. Metcalfe, City Engineer." The Mayor then laid before the Council the following resolution: WHEREAS, the property owners adjacent to that portion of Twenty-ninth (29th) Street which lies between Speedway and University Avenue requested the City Council to change that portion of Twenty-ninth (29th) Street to "Mockingbird Lane"; and WHEREAS, the City Plan Commission, upon request, considered same and has submitted to the City Council of the City of Austin a recommendation that the name "Mockingbird Lane" be given that portion of Twenty-ninth (29th) Street which lies between Speedway and University Avenue; and WHEREAS, said recommendation of the City Plan Commission has been considered and approved by the City Council of the Oity of Austin; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the name of "Mockingbird Lane" be hereby formally adopted by the City of Austin for that portion of Twenty-ninth (29th) Street which lies between Speedway and University Avenue. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. The Mayor then laid before the Council the following resolution: WHEREAS, in making a general revision of the house numbering of the City to eliminate duplication and confusion it has become necessary to also rename some of the streets; and WHEREAS, the City Plan Commission, upon request of the City Council, has considered the renaming of some of the streets in northeast Austin; and WHEREAS, the City Plan Commission has submitted to the City Council of the City of Austin a recommendation for the renaming of various streets, said recommendation having been submitted in the form of a resolution of the City Plan Commission; and WHEREAS, said recommendation of the City Plan Commission has been considered and approved by the City Council of the City of Austin; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the following street names be formally adopted by the City of Austin as hereinafter set forth: East Twenty-fourth (24th) Street from San Jacinto Boulevard to East Avenue, changed to "Houston Way"; East Twentieth (20th) Street from Red River Street to East Avenue, changed to "Gould Street"; East Fourteenth (14th) Street from Navasota Street to Comal Street, changed to "Bob Harrison Street"; Pond Street from the Catholic Cemetery north to 30th Street, changed to "Robinson Street"; Curve Street from 12th Street to East Avenue, changed to "Olander Street"; East Twenty-third and One-half (232) Street from Red River Street to East Avenue, changed to "Bremond Street"; East Twenty-third (23rd) Street from Red River Street to East Avenue, changed to "Glasscock Street"; 493 494 East Twenty-second (22nd) Street from Red River Street to East Avenue, changed to "Manor Road"; East Twenty-first (21st) Street from Red River Street to Whittier Street, changed to "Kalmar Street"; East Twentieth and One-half (204) Street from Red River Street to East Avenue, changed to "Pelham Street"; East Nineteenth and One-half (194) Street from Red River Street to East Avenue, changed to Loomis Street"; The street which lies one block south of and parallel to Nineteenth Street between Leona Street and the east line of the City be named "Eighteenth (18th) Street"; The street which lies two blooks south of and parallel to Nineteenth Street between. A letter from Travis Post #76, American Legion, inviting the City Council to participate in the Armistice Day Parade to be held in this City on November 11th next, was read; and the City Olerk was instructed to notify said organization of the City Council's acceptance of the invitation. Councilman Mueller made a motion that the City Manager be directed to address a letter to the Police Department of the City of San Antonio, conveying the thanks of the City Council for the wholehearted cooperation given by said Department to the Police Department of this City in solving the recent murder of Edgar C. Arledge, Jr., University of Texas student. The City Manager presented to the Council copy of a letter written by A. R. Davis, Superintendent of the Water Department, to Prof. A. N. MoCallum, Superintendent of Public Schools of this City, calling attention to leakage in meters furnishing water to the various schools of the City and asking for immediate correction of same. A letter from A. W. Harris, President Theta X1 Association of Texas, expressing the thanks of said Association for the change in the zoning of their property at 25th and Rio Grande Streets recently granted by the Council, was read and filed. The Mayor laid before the Council the following resolution: WHEREAS, certain securities have been deposited by the Central Surety and Insurance Company of Kansas City, Missouri, to-wit, Wichita County Water Improvement Bonds of the face value of $50,000.00, with the Treasurer of the State of Texas at Austin and were assessed by the City of Austin for the year 1931 at the value of $33,335.00; and WHEREAS, it has been ascertained that on January 1, 1931, said securities had depreciated in value at least 50% and for such reason have been over assessed by the City of Austin for said year and that said assessment should now be corrected in the particular that the assessment for the year 1931 should have been $16,665.00, which is two-thirds of $25,000.00; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Аввевsor and Collector of Taxes be instructed to correct said assessment in the particular above set out on condition that the taxes for said year be promptly paid, 495 but that on account of the facts above stated no penalty or interest be required.
