REGULAR MEETING OF THE CITY COUNCIL: 599 Austin, Texas, December 15, 1932. The Council was called to order by the Mayor. Roll call showed the following members present: Councilmen Alford, Gillis, Mayor MoFadden, Councilman Mueller, 4; absent, Councilman Steck, 1. The Minutes of the last regular meeting were read and Councilman Mueller moved the adoption of same as read. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Coun- cilman Mueller, 4; naye, none; Councilman Steck absent, 1. Councilman Alford was excused from further attendance upon the meeting. Mayor MoFadden moved that the date for the public hearing on the proposed municipal budget for the year 1933 be set for Monday, the 19th instant, at 7:30 P. M. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Counoilman Gillis, Mayor McFadden, Councilman Mueller, 3; nays, none; Councilmen Alford and Steck absent, 2. The Mayor laid before the Council, for its third reading, the following ordinance: AN ORDINANCE AUTHORIZING INTERNATIONAL- GREAT NORTHERN RAILROAD COMPANY TO CON- STRUOT, MAINTAIN AND OPERATE A SPUR OR EXTENSION TRACK OVER AND THROUGH WEST FOURTH STREET FROM NUECES STREET WESTERLY APPROXIMATELY ONE BLOOK, FOR THE PURPOSE OF SERVING BLOCKS 47 AND 48 IN THE CITY OF AUSTIN, SUBJECT TO CERTAIN CONDITIONS. The above ordinance was read the third time and laid over. The application of J. M. Allison, 510 West 7th Street, for a license to operate as a taxicab a 1930 Dodge 4-door Sedan, Engine No. DD17700, State Highway License No. 479-010, was read. Councilman Mueller moved that the application be granted. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilman Gillis, Mayor McFadden, Councilman Mueller, 3; naye, none; Councilmen Alford and Steck absent, 2. The application of J. E. Haire, 417 Congress Avenue, for a license to operate as a taxicab a 1931 Chevrolet Sedan, Motor No. 1979267, State Highway License No. K36-636, was presented to the Council. Councilman Mueller moved that the license be granted on the grounds that same was not a new application but an expansion of an established business. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilman Gillis, Mayor McFadden, Councilman Mueller, 3; naye, none; Councilmen Alford and Steck absent, 2. The application of Pattons, Inc., for permit to install two 550 gallon underground gasoline tanks and pumpe at 1162 East 7th Street was read. The Mayor then laid before the Council the following: "Austin, Texas, December 14, 1932. Mr. Adam R. Johnson, City Manager, Austin, Texas. Dear Sir: We have considered the application of W. T. Patton for a permit to install two 550 gallon underground storage tanks and pumps at "Pattons, Incorporated, No. 1", located at 1162 East 7th Street, this City; said pumps and storage tanks to be used for the handling of gasoline for commercial purposев. We find that the pumps are to be located upon land which has been placed within "C" Commercial Use District by the City Council of the City of Austin. We recommend that W. T. Patton be granted a permit to construct and operate two 550 gallon underground storage tanks and two pumps, subject to the following conditions: ! 600 1. That all equipment shall be constructed in accordance with the plan hereto attached marked 2-H-297. 2. That all equipment shall be of the type required by the filling station ordinance and shall be installed in accordance with the requirements of the Building Ordinance, Zoning Ordinance, Filling Station Ordinance and the ordinance prohibiting the disposal of commercial water or oil upon the city streets. 3. In case that it ever develops that waste oils or water ever accumulate as a result of the use of said pumps and underground storage tanks, same shall not be allowed to ever pass over the City sidewalk area, but shall be concentrated into a combined grease and sand trap which shall be constructed in accordance with the City standard plan 2-H-146, and shall be conducted by a pipe connection from said grease and sand trap to the nearest practical storm sewer, at the expense of the applicant. It is estimated that said pipe connection from the grease and sand trap to the nearest practical storm sewer can be made at a cost of approximately $250.00. " BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the Oity of Austin hereby approves 1164 East Seventh Street as a location for the installation of two 550 gallon underground storage tanks and two gasoline pumps for the handling of gasoline for commercial purposes, and hereby authorizes W. T. Patton to install and operate such equipment at this location, such equipment to be located in accordance with the plan hereto attached marked 2-H-297, which plan is hereby made a part of this resolution. The installation and operation of such equipment shall be in accordance with the attached recommendations and a permit for the same shall be secured from the City Building Inspector, as provided by ordinance, and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of this equipment after full compliance with all the provisions of this resolution and said permission shall be held to be granted and accepted, subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that W. T. Patton has failed and refused and will continue to fail and refuse to fulfill any such conditions, regulations and ordinances. The above resolution was adopted by the following vote: Ayes, Councilman Gillis, Mayor McFadden, Councilman Mueller, 3; nays, none; Councilmen Alford and Steck absent, 2. H. F. Kuehne, Vice Chairman of the Park Board, appeared before the Council and asked that in order to facilitate the work being done with funds from the Reconstruction Finance Corporation, the Council authorize an expenditure out of the Parks & Playgrounds Bond Fund of $250.00 for a topographical survey of the Zilker tract and $672.00 for material to be used in the Shoal Creek development project, pending the proper resolution of the Park Board recommending same. Councilman Mueller moved that this request be granted and the resolution making the appropriation be passed at the next regular meeting of the Council. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilman Gillis, Mayor McFadden, Councilman Mueller, 3; nays, none; Councilmen Alford and Steck absent, 2. No further business coming before the Council, Councilman Mueller moved to recess, subject to call of the Mayor. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilman Gillis, Mayor McFadden, Councilman Mueller, 3; nays, none; Councilmen Alford and Steck absent, 2. The Council then recessed. SPECIAL MEETING OF THE CITY COUNCIL: Approved: WM Mayor. 601 Austin, Texas, December 19, 1932. The Council met at 7:30 P. M., pursuant to notice of public hearing on the proposed budget of the City of Austin for the year 1933, with the following members present: Counoilmen Alford, Gillis, and Mayor MoFadden, 3; absent, Councilmen Mueller and Steok, 2. Various citizens and committees appeared and were heard in the matter, following which the Council took same under advisement The proposal of the City Council to transfer money from the Water and Light Fund to the General Fund for operation of the city government for the year 1933 came up for diacussion and this matter was, also, taken under advisement. The Minutes of the last regular meeting were read and Councilman Gillis moved the adoption of same as read. Motion wae seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; naye, none. The Minutes of the special meeting of the 25th ultimo were read and Councilman Mueller moved the adoption of same. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilmen Mueller and Steck, 5; naye, none.
