32 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, March 02, 1933. The Council was called to order by the Mayor. Roll call showed the following members present: Councilmen Alford, Gillis, Mayor McFadden, Councilman Mueller, 4; absent, Councilman Steck, 1. The Minutes of the last regular meeting were read and Councilman Gillis moved the adoption of same as read. Motion was seconded by Councilman Mueller and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. A committee of Negro citizens presented to the Council a written report of a mass meeting of their citizens held for the purpose of considering the proposal of the City Council with reference to a 1ibrary for the Negroes. Councilman Mueller moved that the report be received, approved, and ordered spread on the Minutes of the City Council, and that the Library Commission be authorized to enter into negotiations for the purchase of a site for said library. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. The report of said committee follows: "Austin, Texas, March 2, 1933. Representative Negro citizens from the Community Welfare Association, the Federated Negro Women's Clubs, the Interdenominational Alliance, the Baptist Ministers' Union, the Recreational Council, the Parent-Teachers Association, and the Negro Citizens' Council met in a mass meeting on Monday night, February 27th, to reconsider the library project from the point of view offered by the City Council in its meeting of February 23rd. The citizens agreed to accept the offer made by the City Council that it will purchase a site acceptable to the Negro people, move the frame structure located at 9th and Guadalupe Streets onto thei site, brick veneer the same on the outside, beautify it on the inside and make it an attractive building; to beautify the grounde; to provide books necessary for a good public 1ibrary as a unit of the main City library; that it will employ a trained librarian of the Negro race; and to have this library under the supervision of the Library Commission and the City Manager. "The citizens in mass meeting agreed upon the site adjacent to the Community Center, namely, two lots facing Angelina Street and running south to Cotton Street. Respectfully submitted, (8gd) Mrs. O. Givens " Walter Greig, Attorney for Chas. Boatner and wife, Wilma H. Boatner, Plaintiffs, presented a written claim against the City for damages to the property of Plaintiffs at 128 and 132 West North Street, in the amount of $1418.00, by reason of failure on the part of the City to carry out an alleged agreement to furnish a larger water supply to said property. The matter was referred to the City Attorney. The Mayor laid before the Council the following resolution: WHEREAS, the improvements on Lot 4, Outlot 25, Division "D", Plat 46, on the tax rolls in the name of Mrs. J. B. Jourdan, are assessed at a taxable value of $1710.00; and WHEREAS, this valuation is based on a unit figure of $1.90 per square foot, with 33-1/3% depreciation; and i : WHEREAS, upon investigation by the Tax Department, it is found that said improvements are old and in a very bad state of repair, and in order to equalise same with similar property both the unit and the depreciation should be changed; Now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Assessor and Collector of Taxes be and he is hereby authorized to change the unit on said improvements from $1.90 to $2.00 per square foot and the depreciation from 33-1/3% to 66-2/3%, thereby changing the assessed valuation from $1710.00 to $900.00. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Counoilman Mueller, 4; nays, none; Councilman Steck absent, 1. The Mayor laid before the Council the following resolution: WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the southwestern Bell Telephone Company be and the same is hereby permitted to construct its pole lines in the following streets: (1) Beginning at the northwest corner of Lot 4, Block 123, of the Original Oity of Austin according to a map or plat of said Original City on file in the General Land Office of the State of Texas, which point of beginning is the intersection of the east line of Oongress Avenue Alley and the south line of East Tenth Street Alley; thence N.45018 π. 14.87 feet with the centerline of an underground telephone conduit to an existing telephone company manhole. The underground conduit described above shall be installed by means of using a pipe pusher to push same underneath the existing pavement. In case it is found impractical to install this underground conduit by the pipepusher method, after having made a diligent effort to do so, or in case it is found that any utility or underground structure will be damaged by installing said conduit by the pipe-pusher method, then the Southwestern Bell Telephone Company must notify the City Engineering Department immediately of such findings, and the City Engineer will then 1ssue orders as to how to install said underground conduit and his orders must be followed closely throughout the remainder of the job. That the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed, shall be under the supervision and direction of the City Manager. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, 0111is, Mayor Mofadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. The Mayor laid before the Council the following ordinance: AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDIΝΑΝΟΣ REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERA, TION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, LOCATION AND MAIN-. TENANCE OF BUILDINGS AND STRUCTURES IN THE CITY OF AUSTIN, TEXAS; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR; DEOLARING AND ESTABLISHING FIRE DISTRIOTS; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH", IN THE PARTICULARS STATED HEREIN. The above ordinance was read the first time and Councilman Mueller moved a suspension of the rule and the placing of the ordinance on its second reading. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. 33 34 i The foregoing ordinance was read the second time and Councilman Mueller moved a further suspension of the rule and the placing of the ordinance on its third reading. Motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Ogunoilman Mueller, 4; nays, none; Councilman Steck absent, 1.. The ordinance was read the third time and Councilman Mueller moved that same be finally passed. Motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor McFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. The Mayor laid before the Council the following ordinancet AN ORDINANCE ORDERING A GENERAL ELECTION FOR THE PURPOSE OF ELECTING FIVE COUNCILMEN OF THE CITY OF AUSTIN, FOR THE TERM OF TWO YEARS, BEGINNING MAY 1, 1933, DESIGNATING THE POLLING PLACES IN THE VARIOUS WARDS, AND PROVIDING THE PROCLAMATION OF SAID ELECTION. The above ordinance was read the first time and Councilman Mueller moved that the rule be suspended and the ordinance passed to its second reading. Motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilmen Alford, Gillis, Mayor MoFadden, Councilman Mueller, 4; nays, none; Councilman Steck absent, 1. The ordinance was read the second time and Councilman Mueller moved that the rule be further suspended and the ordinance passed to its third reading.
