210 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, September 21. 1933. The Council was called to order by the Mayor. Roll call showed the following members present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; absent, none. The Minutes of the last regular meeting were read and Councilman Gillis moved the adoption of same as read. The motion was seconded by Councilman Alford and same prevailed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. A committee from the Austin Woman's Club, with Mesdames P. W. MoFadden and A.N.MoCallum as spokesmen, came before the Council and asked that their club building located at No. 708 San Antonio Street be exempted from taxation on the grounds that it is used for educational purposes, is non-revenue producing, and is exempted by the State and County. Councilman Bartholomew moved that the matter be referred to the Legal Department for a legal opinion, with instructions that the Council be advised of its decision at the earliest date possible. The motion was seconded by Councilman Gillis and carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. Мг. м. Н. Огrockett came before the Council in behalf of the Boys Band and asked that the City contribute $100.00 per month to pay for the services of a director for said band, in order that same may continue to function, and in return for such donation, the services of said band would be at the disposal of the Recreation Department, without cost, whenever needed. The matter was referred to the City Manager for recommendation. Messrs. Robt. B. Gragg and W. A. Trenckmann submitted to the Council à petition signed by approximately fifty-two property owners in the area lying between Houston Way and Nineteenth Street on the north and south, and East Avenue and Red River Street on the east and west, asking that the City Council rescind the certain resolution passed by the City Council on October 20, 1932, changing the names of the streets in this area, and that the names formerly given these streets be restored. Messrs. Gragg and Trenckmann urged that this request be granted on the ground that the public has experienced considerable annoyance and inconvenience in locating correct addresses in this section by reason of such change. Councilman Bartholomew moved that the matter be referred to the City Manager and City Engineer for a study of the situation, in conjunction with Messrs. Gragg and Trenckmann, and that after such survey has been made they submit their recommendations to the Council. The motion was seconded by Councilman Wolf and same carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. Mr. G. 8. 0. Tordt requested that the Council waive the requirement for an indemnity bond in connection with his permit to place a snake exhibit in Zilker Park owing to the refusal of insurance companies to write such bonds. The matter was referred to Mayor Miller for an inspection of the premises to determine the amount of hazard inourred. The application of D. H. Hogan, 1619 East Ist Street, for license to operate as a taxicab a Chevrolet four-door sedan, 1929 Model, Engine No. 411523, State Highway License No. 941735, was read. Councilman Gillis moved that the application be granted. The motion was seconded by Councilman Alford and same carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. 211 A petition from the Negro Oitisens Council asking that Chalmers Street be opened and worked from seventh to Eleventh Streets was read and referred to the City Manager and Oity Engineer for attention. The Mayor laid before the Council the following resolution: WHEREAS, Certain securities have been deposited by Glens Falls Insurance Company of Glens Falls, New York, with the Treasurer of the State of Texas, and were assessed by the City of Austin for the years 1931 and 1932 at a value of $36,665.00; and WHEREAS, It has been ascertained that said securities have been over-assessed for said years, and that said assessments should be corrected in the particulars that the assessment for each year should have been $18,333.00; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Assessor and Collector of Taxes be instructed to correct said assessments respectively in the particulars above set out, on condition that the taxes for said years be promptly paid, but on account of the facts above stated that no penalty or interest be required. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; naye, none. The Mayor laid before the Council the following resolution: WHEREAS, The Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its pole lines in the following streets: (1) Nine poles in SAN MARCOS STREET, commencing at Holly Street and & feet west of the east line of San Marcos Street; thence in a southerly direction 8 feet distant from and parallel to the cast line of San Marcos Street a distance of three blocks. (2) Тпо роlеs in LAMBIE STREET ALLEY, commencing at San Marcos Street and two feet north of the south line of Lambie Street Alley; thencs in a westerly direction two fest distant from and parallel to the south line of Lambie Street Alley a distance of one block. (3) Four poles on FLORES STREET, commencing at East Avenue and nine feet north of the south line of Flores Street; thence in an easterly direction nine feet distant from and parallel to the south line of Flores Street a distance of two blocks. (4) Ten poles in CASWELL AVENUE, commencing at 43rd Street and eight feet west of the cast line of Caswell Avenue; thence in a northerly direction nine feet distant from and parallel to the east line of Caswell Avenue to the City limits. (5) Four poles in GRAPEVINE STREET ALLEY, commencing at Red River Street and one foot south of the north line of Grapevine Street Alley) thence in a westerly direction one foot distant from and parallel to the north line of Grapevine Street Alley a distance of two blooks. (6) One pole on East 44th Street on the east property line of Caswell Avenue and eight feet north of the south line of 44th Street. (7) Seven poles on WOODLAND AVENUE, commencing at Travis Heights Boulevard and eleven feet south of the north line of Woodland Avenue; thence in an easterly direction eleven feet distant from and parallel to the north line of Woodland Avenue to the City limits. (8) One pole on FAIRMOUNT AVENUE, commencing at Travis Heights Boulevard and nine feet north of the south line of Fairmount Avenue; thence in an easterly direction nine feet distant from and parallel to the south line of Fairmount Avenue to the City limits. (9) Five poles on SAN BABA STREET, commencing at Willow Street and eight feet east of the west line of San Saba Street; thence in a southerly direction eight feet distant from and parallel to the west line of San Saba Street a distance of two blocks. (10) One pole on RIVER STREET, commencing at Red River Street nine feet north of the south line of River Street; thence in an easterly direction nine feet distant from and parallel to the south line of River Street to East Avenue. 212 ! That the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed, shall be under the supervision and direction of the City Manager. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. The Mayor laid before the Council the following resolution: WHEREAS, Taxes are due the City of Austin on Lot 6, Abstract 697, Spear League, 43 20. by 131 ft. on West Eleventh Street in the City of Austin, for the years 1912-1932, both inclusive, and amount to $65.02, with penalty and interest amounting to $34.72; and WHEREAS, Taxes are due the City of Austin on Lot 7, Abstract 697, Spear League, 43 It by 131 feet corner Eleventh and Charlotte Streets in the City of Austin, for the years 1912-1932, both inclusive, and amount to $76.42, with penalty and interest amounting to $62.51; and WHEREAS, Said Lot 6 is assessed in the name of Elijah Allen Estate and said Lot 7 18 assessed as Unknown; and WHEREAS, The owners of said lots are now unknown, and for such reason it would be a difficult, expensive and uncertain matter to foreclose on said lots for said taxes; and WHEREAS, Ben May proposes to pay all of the taxes against said lots, provided that the penalties and interest are remitted, on the showing that with the penalties and interest added the aggregate amount would be in excess of what said lots are worth; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT in event Ben May shall promptly offer the payment of said taxes, the City Tax Assessor and Collector of Taxes is instructed to deduct the penalties and interest therefrom and to deliver proper tax receipts upon the payment of said taxes. The above resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; naye, none. The Mayor laid before the Council the following resolution: WHEREAS, The Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the proposed construction of an underground conduit at the intersection of East 26 Street and Speedway, and said maps and plans have been considered by the City Engineer; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct an underground conduit at the intersection of East 261 Street and Speedway as follows: Beginning at the intersection of the east line of Speedway and the south line of East Twenty-sixth and One-half Street; thence in a northeasterly direction diagonally across East Twenty-sixth and One-half Street with the centerline of an underground telephone conduit a distance of 110 feet to a telephone pole that is 10 feet south of the north line of said East Twenty-sixth and one-half street and 97 feet cast of the east line of Speedway. THAT all the tarvia surface damaged during the course of construction or maintenance of the above described conduit shall be replaced at the expense of the Southwestern Bell Telephone Company and in accordance with the City of Austin's specifications for the replacement of such surface as might be damaged by said construction or maintenance and that water shall be used at intervals during the course of backfilling of the ditches and that work and construction of said underground conduit, including the excavation of the streets and the restoration and maintenance of said streets after said conduit has been constructed, shall be under the supervision and direction of the City Manager. 213 The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. The Mayor laid before the Council the following resolution: WHEREAS, The Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its pole lines in the following strests: (1) A telephone pole line in NORTH GUADALUPE STREET from West 30th Street to Wheeler Street, the centerline of which telephone pole line shall be 10 feet east of and parallel to the west line of said North Guadalupe Street. (2) A telephone pole line in SAN JACINTO BOULEVARD ALLEY from Elmwood Place to Bellevue Place, the centerline of which pole line shall be one foot east of and parallel to the west 1ine of said San Jacinto Boulevard Alley. (3) A telephone pole line in ALTA VISTA AVENUE ALLEY from Burleson Road to Rosedale Terrace, the centerline of which pole line shall be one foot west of and parallel to the cast line of said Alta Vista Avenue Alley. (4) A telephone pole line in LINSCOMB AVENUE from Garner Avenue to Barton Boulevard, the centerline of which pole line shall be eight feet north of and parallel to the south line of said Linscomb Avenue. (5) A telephone pole line in GARNER AVENUE from Linscomb Avenue to Margaret Street the centerline of which oh pole line shall be eight feet east of and parallel to the west line of said Garner Avenue. (6) A telephone pole line in WEST THIRTY-SECOND STREET from King Street to Guadalupe Street, the centerline of which pole line shall be fourteen feet south of and parallel to the north line of said West Thirty-second Street. THAT the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed, shall be under the supervision and direction of the City Manager. The above resolution was adopted by the following vote: Ayce, Councilmen Alford, Bartholomew, 011118, Mayor Miller, and Councilman Wolf, 5; nays, none. Upon the recommendation of G. 8. Moore, Building Inspector, Councilman Alford moved that permit be granted to A. T. Long to construct an all-metal building at the southwest corner of the intersection of Red River and Fourth Streets. The motion was seconded by Councilman Gillis and same prevailed by the following vote: Ayes, Councilmen Alford, Bartholomew, 011118, Mayor Miller, and Councilman Wolf, 5; nays, none. There being no further business before the Council, Councilman Alford moved to rec088 subject to call of the Mayor.
