240 i REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, October 26, 1933. Roll call showed the following The Council was called to order by the Mayor. members present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; absent, none. The Minutes of the regular meeting of October 19th and the special meetings of October 20th and October 25th were read and Councilman Bartholomew moved that same be approved. The motion was seconded by Councilman Wolf and carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. The Mayor laid before the Council the following ordinance: AN ORDINANCE PROVIDING FOR THE REQUIREMENT AND ISSUANCE OF LICENSE PERMITS TO ITINERANT VENDERS BY THE CITY OF AUSTIN, DEFINING ITINERANT VENDERS; REGULATING THE SALE OF GOODS AND MERCHANDISE BY ITINERANT VENDERS IN THE CITY OF AUSTIN FOR THE BENEFIT OF THE PUBLIC; PROVIDING PENALTIES FOR THE VIOLATION THEREOF, REPEALING ORDINANCES INCONSISTENT THEREWITH, AND DECLARING AN EMERGEΝΟΥ. The ordinance was read the first time and Councilman Alford moved that the rule be suspended and the ordinance placed on its second reading. The motion was seconded by Councilman Gillis and carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gi11is, Mayor Miller, and Councilman Wolf, 5; nays, none. The ordinance was read the second time and Councilman Alford moved a further suspension of the rule and the placing of the ordinance on its third reading. The motion was seconded by Councilman Gillis and carried by the following vote: Ayes, Councilmen Alford, Bartholomew, G1111s, Mayor Miller, and Councilman Wolf, 5; nays, none. The ordinance was read the third time and Councilman Alford moved that same be finally passed. The Mayor laid before the Council, for its second reading, the following ordinance: AN ORDINANCE TO PROVIDE FOR LICENSING AND REGULATING PERSONS WHO ENGAGE IN BUYING AND/ OR SELLING FISH, OYSTERS, SHRIMP, LOBSTERS, CRABS, TURTLES, TERRAPING AND CLANS AT WHOLESALE AND RETAIL WITHIN THE CITY OF AUSTIN, DEFINING TERMS, AND FIXING PENALTIES. The ordinance was read the second time and Councilman Alford moved that the rule be suspended and the ordinance placed on its third reading. The motion was seconded by Councilman 0111is and carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. The ordinance was read the third time and Councilman Alford moved that same be finally passed. The motion was seconded by Councilman Gillis and carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. J. T. Duke, representing T. B. Trotter Company, submitted a statement covering the expenditures of the Bond Funds, as previously requested by the Council. F. G. Rogers Company of San Antonio submitted a proposal to audit the books of the City covering the period from May 1st to December 31, 1933. Further consideration of the matter was deferred until the next regular meeting in order to give local firms an opportunity to submit proposals. 241 The Mayor laid before the Council the following resolution: WHEREAS, The Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the Oity Engineer; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its pole lines in the following streets: A telephone pole 1ine in SAN MARCOS STREET from East Third Street to East Fourth Street, the centerline of which pole line shall be sight feet east of and parallel to the west line of said San Marcos Street. THAT the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed, shall be under the supervision and direction of the City Manager. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, G11118, Mayor Miller, and Councilman Wolf, 5; naye, none. The Mayor laid before the Council the following resolution: WHEREAS, The curb and sidewalk specifications of the City of Austin which have been previously adopted by the City Council of the City of Austin require that all curbs and sidewalks be of concrete unless a special permit has been secured from the City Council for the use of other materials; and WHEREAS, Mrs. Bessie Cochran, owner of the south 136 x 2481 of a two-acre tract of land in Outlot 40, Division "D", of the Government Outlots of the City of Austin, Travie County, Texas, which property fronts 136 feet on the west side of San Gabriel Street and fronts 248 feet on the north side of West 23rd Street, has requested the City Council of the City of Austin to grant her permission to construct a flagstone walk in San Gabriel Street adjacent to the east side of the aforesaid Mrs. Bessie Cochran's property, which flagstone walk is to be 4.5 feet wide and to extend from the north line of said Mrs. Bessie Cochran's property in a southerly direction to the north curb line of West 23rd Street, the west line of which sidewalk shall be 1.5 feet east of and parallel to the west line of San Gabriel Street; and WHEREAS, The City Council has investigated and approved the construction of said flagstone walk; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Mrs. Bessie Cochran, owner of the south 136 x 248' of a two-acre tract of land in Outlot 40, Division "D", of the Government Outlots of the City of Austin, Travis County, Texas, which property fronts 136 feet on the west side of San Gabriel Street and fronts 248 feet on the north side of West 23rd Street, is hereby granted the right to construct a temporary flagstone walk in San Gabriel Street adjacent to the aforesaid Mrs.Bessie Cochran's property, which walk is to be 4.5 feet in width and to extend from the north line of said Mrs. Bessie Cochran's property in a southerly direction to the north ourb line of West 23rd Street, and which walk is to be constructed in accordance with the supervision and directions of the City Engineer of the City of Austin and shall be constructed to the lines and grades furnished by said City Engineer or his assistant; and further subject to the following conditions: That all of said work shall be done by a bonded sidewalk contractor. That if at any time the sidewalk as allowed under this permit becomes a hazard to pedestrians, same shall be repaired in such a manner as to relieve such hazardous conditions and such repairs shall be made by the property owner within thirty days after having received notice from the City that such repairs must be made. 242 The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, Councilman Bartholomew, 1. The Mayor laid before the Council the following ordinance: AN ORDINANCE PROHIBITING THE STANDING OF VEHICLES ON EAST ELEVENTH STREET OPPOSITE THE ENTRANCE TO THE STATE HIGHWAY BUILDING IN THE CITY OF AUSTIN, CUMULATIVE OF CERTAIN ORDINANCES, REPEALING ORDINANCES IN CONFLICT HEREWITH, AND PRESORIBING PENALTIES. The ordinance was read the first time and Councilman Alford moved that the rule be suspended and the ordinance passed to its second reading. The motion was seconded by Councilman Gillis and carried by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; Councilman Bartholomew present but not voting. The ordinance was read the second time and Councilman Alford moved a further suspension of the rule and the placing of the ordinance on its third reading. The ordinance was read the first time and Councilman Alford moved that the rule be suspended and the ordinance passed to its second reading. The Mayor laid before the Council the following resolutions BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of $350.00 be and the same is hereby appropriated out of the General Fund, not otherwise appropriated, for the purpose of paying funeral expenses of Sergeant W. M. Stuart, who was killed while on duty. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. Mr. G. M. Roberdeau came before the Council and entered a protest against the continuous parking of automobiles in front of his residence at 704 West 13th Street, stating that the situation was becoming intolerable on account of his being deprived of an entrance He was advised that the situation would be remedied as far as possible. to his home.
