254 A letter from Mrs. W. M. Stuart thanking the Council for the kindness and generosity shown to her and family during the illness and death of her husband, Sergeant W. M. Stuart, Motorcycle Officer, was read and filed. There being no further business, Councilman Alford moved to recess, subject to call of the Mayor. The motion was seconded by Councilman Gillie and carried by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor Miller, 3; Councilmen Bartholomew and Wolf absent, 2. Roll call showed the following The Council was called to order by the Mayor. members present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; absent, none. The Minutes of the last regular meeting were read and Councilman Gillis moved the adoption of same as read. The motion was seconded by Councilman Bartholomew and carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. At the request of Mrs. E. R. Pils, representing the Red Star Taxicab Company, the Council granted permission to said Company to operate three additional taxicabs under its present licenses during the State Teachers Convention, November 30th to December 2nd; provided the drivers of such taxicabs were indorsed by the Chief of Police and the bonds of said Company now in force could be extended to cover such extra cars. Mr. Chester Schacht submitted a request for passage of an ordinance regulating the transient fireworks peddler. The matter was referred to the City Attorney for disposition. A communication from Mr. E. D. Junkin, requesting that the alley lying between Wichita Street and University Avenue from 26th to 27th Streets be repaired and made passable, was read. The matter was referred to the City Engineer, with instructions to have the necessary work done, using RFC labor if available. The application of the State Board of Control for permission to build a retaining wall on the south side of Eleventh Street between Colorado and Lavaca Streets was read. The Mayor then introduced the following resolution:. 255 WHEREAS, The State Board of Control of the State of Texas, acting by and through its Chairman, Claude D. Teer, has requested permission to build a concrete retaining wall. between the sidewalk line and the property line on the south side of West 11th Street, which retaining wall is to extend westerly from a point approximately two feet east of the west line of Colorado Street to a point approximately two feet west of the east line of Lavaca Street, and thence southerly along the east side of Lavaca Street to a point approximately two feet south of the south line of said West 11th Street, the street face of which retaining wall is to be four feet from the property line and one foot from the sidewalk line as shown upon the blue print hereto attached marked 1-A-776, which blue print is hereby made a part of this resolution; and WHEREAS, The object of this retaining wall is to prevent further erosion of the ground surface, thereby protecting the roots of the shade trees now existing adjacent to the site of the proposed retaining wall; and WHEREAS, The City Engineer has reviewed the plane as presented by said Board of Control; and WHEREAS, The City Council has favorably considered said request; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT permission is hereby granted to the State Board of Control of the State of Texas to construct a reinforced concrete retaining wall around a portion of the City block upon which the Governor's Mansion is now located, which retaining wall is to extend westerly from a point approximately two feet east of the west line of Colorado Street to a point approximately two feet west of the east line of Lavaca Street, and thence southerly along the east side of Lavaca Street to a point approximately two feet south of the south line of West 11th Street, the street face of which retaining wall is to be four feet from the property line and one foot from the sidewalk line as shown upon the blue print hereto attached marked 1-A-776, which blue print is hereby made a part of this resolution; and THAT the retaining wall shall be constructed by a bonded contractor and the work shall be carried on under the supervision and direction of the City Engineer of the City of Austin and shall be constructed in accordance with City specifications governing this type of construction. Councilman Gillis moved the adoption of the above resolution. The motion was seconded by Councilman Bartholomew and carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; naye, none. The Mayor laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in BOWIE STREET from West 3rd Street to West 5th Street, the centerline of which gas main shall be 22 feet east of and parallel to the west line of said Bowie Street. Said gas main described above shall have a cover of not less than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities. but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. 256 When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin, The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; naye, none. The Mayor laid before the Council the following resolution: WHEREAS, The taxes on Lots 6, 7, 8, 9, 10, and 11, Block 4, Outlot 2, Division "A", Plat 22, and Lots 10, 11, and 12, Block 4, Outlot 3, Division "A", Plat 22, located in the City of Austin, Travis County, Texas, are delinquent for the years 1930, 1931, and 1932, in the sum of Four Hundred Sixty-three and 50/100 ($463.50) Dollars, not including penalty and interest; and. WHEREAS, Henry Maerki states that he had to foreclose on said property for the vendorjs 1ien note against same and did not know that there were delinquent taxes against said property; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Tах Аввеввот and Collector be and he is hereby authorized to remit the penalty, amounting to $23.17, when collecting said delinquent taxes, provided same is paid immediately. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. Upon motion of Councilman Alford, the fine and costs, amounting to $15.80, assessed against Marcus Wormley in the Corporation Court on November 3, 1933, for speeding, Cause No. 35677, was remitted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; naye, none. There being no further business, Councilman Alford moved to recess, subject to call of the Mayor.
