REGULAR MEETING OF THE CITY COUNCIL: 275 Austin, Texas, December 21, 1933. The Council was called to order by the Mayor. Roll call showed the following members present: Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; absent, Councilman Bartholomew, 1. The Minutes of the last regular meeting were read and upon motion of Councilman Wolf were adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; naya, none; Councilman Bartholomew absent, 1. Mr. M. 8. Hule, representing the Travis County Board of Welfare, submitted a request that the City and County jointly furnish warehouse facilities for the Federal Relief Agencies and that the Oity pay one-half the rental on a building for this purpose. Councilman Alford then introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of $37.50 be and the same is hereby appropriated out of the General Fund, not otherwise appropriated, for the purpose of paying one-half the rental to February 1st on the building at 502 Colorado Street to be used as a warehouse for the Federal Relief Agencies. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillie, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. A committee composed of Messrs. M. H. Crockett, Earl Simms, and Mrs. Clarence Stumpf, submitted a request that the Council include in the budget appropriations for the year 1934 the sum of $720.00 to pay for the services of a director for the Austin Boye Band, which would be at the disposal of the Recreation Department whenever the services of same were needed. Letters from Dr. M. P. Smartt, Messrs. John F. Wallace and Fred H. Hall, and Mrs. A. A. Brown, recommending a continuation of the services of said band, were also received. The matter was taken under advisement. Mr. J. W. B. Love submitted an amended petition, signed by eighty-two qualified voters of the certain area in the St. Elmo School District asking for annexation of said territory to the City of Austin for school purposes only; a resolution from the Board of Trustees of the Austin Public Schools, recommending the annexation of said territory; and certified lists of the qualified voters and the property involved in said territory from the County Tax Collector and County Tax Assessor, respectively. Mr. Ed Cullen submitted petitions, signed by sixty-four qualified voters of the St. Elmo School District, protesting the annexation of the territory in question. After considerable discussion, the Mayor introduced the following ordinance: AN ORDINANCE EXTENDING THE CORPORATE LIMITS OF THE CITY OF AUSTIN, TEXAS, FOR SCHOOL PURPOSES ONLY, TO INCLUDE THAT CERTAIN TERRITORY OUT OF ST.ELMO COMMON SCHOOL DISTRICT NO. 43, HERE- INAFTER DESCRIBED IN SECTION I, AND PROVIDING FOR THE ASSESSMENT AND COLLECTION OF SCHOOL TAXES WITHIN THE TERRITORY SO ADDED. The ordinance was read the first time and Councilman Gillie moved a suspension of the rule and the placing of the ordinance on its second reading. The motion was carried by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. 276 The foregoing ordinance was read the second time and Councilman Alford moved a further suspension of the rule and the placing of the ordinance on its third reading. The motion was carried by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. The ordinance was read the third time and Councilman Alford moved that same be finally passed. The motion was carried by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. The Mayor laid before the Council the following resolution: WHEREAS, The City of Austin proposes the following work relief project, for which application has been made to the Texas Rehabilitation and Relief Commission for the cost of labor on same, to-wit: AUSTIN DAM IMPROVEMENTS ; and WHEREAS, It is estimated that the following tools, equipment and transportation facilities will be necessary in the prosecution of said project, to-wit: Fifty picks, fifty mattocks, seventy-five shovels, twenty hoes, ten rakes, thirty-six axes, two hand sawe, six 12# sledge hammers, two stone hammers, five crow bars, four soythes, two files, one hundred feet " rope; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT, in consideration of the Texas Rehabilitation and Relief Commission, through its Travis County Board of Welfare and Employment, furnishing the funds sufficient to pay the cost of labor, including truck drivers, employed on said project, the City of Austin w111 supply, free of cost to the Travis County Board of Welfare and Employment: (1) All the materiale necessary for the successful completion of said project; (2) The use, free of cost to said County Board of Welfare and Employment, of all the tools, equipment and transportation facilities that may be necessary for the successful completion of the project; and (3) Whatever technical supervisory personnel is necessary to the successful completion of the project, and hereby designates such personnel as follows: J. E. Mothoral, City Engineer; and BE IT FURTHER RESOLVED: THAT there is hereby appropriated out of the General Fund of the City of Austin, the sum of $350.00 for the purpose of paying for said materials, tools, equipment, transportation facilities and supervision. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. The Mayor introduced the following resolution: WHEREAS, J. R. Blackmore is the Contractor for the alteration of an awning located at 409 Colorado Street and desires a portion of the sidewalk space abutting Lot 9, Block 43, of the Original City of Austin, Texas, during the alteration of the awning, such space to be used in the work and for the storage of materials therefor; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 1. THAT space for the uses hereinabove enumerated be granted to said J.R.Blackmore, the boundary, of which is described as follows: Sidewalk Working Space Beginning at the southwest corner of the above described lot; thence in a westerly direction and at right angles to the centerline of Colorado Street a distance to the east curb line of Colorado Street; thence in a northerly direction along the east curb line of Colorado Street a distance of 46 feet; thence in an easterly direction and at right angles to the centerline of Colorado Street a distance to the east line of Colorado Street; thence in a southerly direction and along the east line of Colorado Street to the place of the beginning. 277 2. THAT the above privileges and allotment of space are granted to said J. R. Blackmore, hereinafter termed "Contractor", upon the following express terme and conditions: (1) That the Contractor shall maintain an unobstructed walkway through the above described working space at all times, such walkway to be protected from overhead work. Special work to be done at each end of the awning shall be done first at one side and then at the other. (2) That the Contractor shall in no way obstruct any fire plugs or other public utilities in the construction of such walkway. (3) That provision shall be made for the normal flow of all storm waters in the gutter and the Contractor will be responsible for any damage done due to obstruction of any such storm waters. (4) That the Contractor shall place on the outside corners of any walkway, barricades of obstructions, red lights during all periods of darkness. (5) That the Contractor is permitted to construct a temporary work office within such allotted working space provided such work office is not within 25 feet of any corner street intersection. (6) That the Contractor shall remove all fences, barricades, loose materials and other obstructions on the sidewalk and street immediately after the necessity for their existence on said sidewalk or street has ceased, such time to be determined by the City Manager, and in any event all such sidewalk, barricades, materials, equipment and other obstructions shall be removed not later than December 30, 1933. (7) That the Contractor shall restore all public and private property injured during the use of such space to as good condition as the same existed before the use of such space began. (8) That the City reserves the right to revoke at any time any and all the privileges herein granted or to require the erection or installation of additional barriers or safeguards if the conditions demand it. (9) That the Contractor shall furnish the City of Austin a surety bond in the sum of Five Thousand ($5000.00) Dollars, which shall protect, indemnify and hold harmless the City of Austin from any claims for damages to any person or property that may accrue to or be brought by any person by reason of the exercise of the privileges granted the Contractor by the City of Austin and shall guarantee the replacement of all sidewalks, pavement and all other public property and public utilities disturbed or removed during the alteration work and shall further guarantee the construction of a walkway and other safeguards during the occupancy of the space. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Counoilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. The Mayor introduced the following resolution: WHEREAS, There is a controversy between John W. Hornsby and the Assessor and 001lector of Taxes as to the payment of the taxes for 1927 on Lot No. Four (4), Outlot Twenty- one (21), Division "E", and on certain personal property for taxes of 1929; said Horneby claiming that said taxes have been paid and the records of the Tax Office showing same still unpaid; and WHEREAS, In settlement of said controversy, it is proposed that the interest and penalties on said tax items be cancelled in consideration of said John W. Hornsby paying said taxes; therefore, 278 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the interest and penalties on the taxes on Lot No. 4, Outlot 21, Division "E", for the years 1927 and 1929, and the interest and penalties on the taxes on personal property for the year 1929 be and the same are hereby cancelled, upon condition of the immediate payment of all taxes due on said real estate and personal property as shown by the records of the Tax Office. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. The Mayor laid before the Council the following resolutions WHEREAS, Kuntz-Sternenberg Lumber Company has been compelled to recover from E. E. Bustin Lots Nos. Thirty-one (31) and Thirty-two (32), in Block No. Four (4), in Highlands Addition, for debt, and has discovered that City taxes for the years 1928 to 1932, both inclusive, in the aggregate amount of $3.92, plus $.20 penalties, have accrued while said property was under ownership of his debtor; and WHEREAS, It is deemed equitable and expedient that, under the above facts, the penalties on said taxes should be remitted; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT said penalties, amounting to the aggregate sum of $.20 be and the same are hereby remitted, provided that said Kuntz-Sternberg Lumber Company immediately pays all of said taxes, together with interest. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. The Mayor introduced the following resolution: WHEREAS, Kuntz-Sternenberg Lumber Company has been compelled to recover from Sam Billingsley Lot No. Eight (8), in Block No. Seventeen (17), in Grandview Addition, for debt, and has discovered that City taxes for the years 1930 to 1932, both inclusive, in the aggregate amount of $31.08, plus $1.56 penalties, have accrued while said property was under ownership of his debtor; and WHEREAS, It is deemed equitable and expedient that, under the above facts, the penaltics on said taxes should be remitted; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT said penalties, amounting to the aggregate sum of $1.56, for the years 1930 to 1932, both inclusive, be and the same are hereby remitted, provided that said KuntzSternenberg Lumber Company immediately pays all of said taxes, together with interest. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. The Mayor introduced the following resolution: WHEREAS, Kuntz-Sternenberg Lumber Company has been compelled to recover from I. Garner Lot No. Eleven (11), Blook "A", Outlot No. Fifty-six (56), Division "O", Free & Williams Addition, for debt, and has discovered that City taxes for the years 1931 and 1932, both inclusive, in the aggregate amount of $28.01, plus $1.40 penalties, have accrued while said property was under ownership of his debtor; and WHEREAS, It is deemed equitable and expedient that, under the above facts, the penalties on said taxes should be remitted; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT said penalties, amounting to the aggregate sum of $1.40, for the years 1931 and 1932, be and the same are hereby remitted, provided that said Kuntz-Sternenberg Lumber 279 Company immediately pays all of said taxes, together with interest. The resolution was adopted by the following vote: Ayes, Counoilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. The Mayor introduced the following resolution: WHEREAS, Kuntz-Sternenberg Lumber Company has been compelled to recover from J. R. Lyle part of Lot No. Two (2), of the George W. Spear League, 1020 West 31st Street, for debt, and has discovered that City taxes for the years 1929 to 1932, both inclusive, in the aggregate amount of $89.48, plus $4.47 penalties, have accrued while said property was under ownership of his debtor; and WHEREAS, It is deemed equitable and expedient that, under the above facts, the penalties on said taxes should be remitted; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT said penalties, amounting to the aggregate sum of $4.47, for the years 1929 to 1932, both inclusive, be and the same are hereby remitted, provided that said KuntzSternenberg Lumber Company immediately pays all of said taxes, together with interest. The Mayor introduced the following resolution: WHEREAS, Kuntz-Sternenberg Lumber Company has been compelled to recover from James Sampson part of the south 1/2 of Block No. One (1), Outlot No. Thirty-six (36), Division B, 1406 East 12th Street, for debt, and has discovered that City taxes for the years 1923, 1931, and 1932, in the aggregate amount of $112.24, plus $5.60 penalties, have accrued while said property was under ownership of his debtor; and WHEREAS, It is deemed equitable and expedient that, under the above facts, the penalties on said taxes should be remitted; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT said penalties, amounting to the aggregate sum of $5.60, for the years 1923, 1931, and 1932, be and the same are hereby remitted, provided that said Kuntz-Sternenberg Lumber Company immediately pays all of said taxes, together with interest. Bouldin Addition, for debt, and has discovered that City taxes for the year 1932, in the sum of $31.90, plus $1.59 penalty, have accrued while said property was under ownership of his debtor; and WHEREAS, It is deemed equitable and expedient that, under the above facts, the penalty on said taxes should be remitted; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT said penalty, amounting to the sum of $1.59, for the year 1932, be and the same 18 hereby remitted, provided that said T. E. Odiorne immediately pays said taxes, together with interest. Atkins has been compelled to recover Lot No. Two (2), in Block No. Two (2), of Johnson's River Addition, for debt, and has discovered that City taxes for the years 1928 to 1932, both inclusive, in the aggregate amount of $278.29, plus $13.91 penalties, have accrued while said property was under ownership of his debtor; and WHEREAS, It is deemed equitable and expedient that, under the above facts, the penalties on said taxes should be remitted; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT said penalties, amounting to the aggregate sum of $13.91, for the years 1928 to 1932, both inclusive, be and the same are hereby remitted, provided that said C. F.Atkins immediately pays all of said taxes, together with interest. Mayor Miller introduced the following resolution: WHEREAS, There is assessed on the tax rolls of the City of Austin, for the year 1931, taxes amounting to Ninety-eight and 88/100 (98.88) Dollars, on the North part of Lot No. Forty-five (45), Enfield D, in the City of Austin, Travis County, Texas, in the name of Dr. J. V. Siegmund; and WHEREAS, Said property was purchased on October 29, 1930, from the Westenfield Development Company, and said deed filed November 21, 1930; and WHEREAS, The Tax Department failed to transfer the assessment on said property for the year 1932, from said Westenfield Development Company to Dr. J. V. Siegmund unt11 December, 1933; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the penalties and interest, amounting to Fifteen and 17/100 ($15.17) Dollars be remitted, and that the Tax Collector and Assessor be and he is hereby authorized to accept payment of the taxes, amounting to Ninety-eight and 88/100 ($98.88) Dollars. The Mayor introduced the following resolution: WHEREAS, There appears on the delinquent tax rolls of the City of Austin certain items which represent taxes assessed against personal property for various years prior to 1933; and WHEREAS, It is deemed that said taxes cannot be collected for the reason that in sach case either the property or the owner of the property cannot be located, and for the past several years the Tax Collector, after diligent search and inquiry, and on account of such facts has been unable to collect said taxes, and same should not longer be carried on the rolls as assets of the City of Austin; therefore,.
