REGULAR MEETING OF THE CITY COUNCIL: 339 ! Austin, Texas, March 01, 1934- The meeting was called to order by the Mayor. Roll call showed the following members present: Councilmen Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 4; absent, Councilman Alford, 1. There having been no meeting of the City Council on Thursday, February 22nd, the Minutes of the regular meeting of February 15th were read and upon motion of Councilman G1111s were adopted, as read, by the following vote: Ayes, Councilmen Bartholomew, G11118, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Alford absent, 1. The Mayor introduced the following resolutions BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be authorized and instructed to convey, in the name of the City of Austin, by quitolaim deed to Ira P. Hildebrand, for the cash consideration of $150, the following described land; .288 acre, the same being a portion of Outlot No. 9, Division "2", of the Government Outlots adjoining the Original City of Austin, Travis County, Texas, said land being part of the lands conveyed to the City of Austin by H. T. Caswell, et al., by deed recorded in Volume 443, at Page 199, and Volume 433, at Page 74, of the Deed Records of Travis County, Texas, the land to be conveyed being described by metes and bounds as: Beginning at a concrete monument set at the most westerly corner of that certain 7.97acre tract of land as conveyed to the City of Austin by W. T. Caswell according to Travis County Deed Records, Volume 485, Page 331, which point is the southeast corner of a small tract of land conveyed to Ira P. Hildebrand by W. T. A committee of dealers in electric refrigeratore came before the Council and asked for a 25 от 30% reduction in the rate for electric refrigerators and submitted several petitions from citizens asking that some reduction be made. After considerable discussion, upon motion of Councilman Wolf, the matter was taken under advisement. The Mayor laid before the Council the following: "Austin, Texas February 28,1934. Mr. Quiton Morgan City Manager Austin, Tex. Dear Sir: The Publix Ice and Food Pantries, Incorporated, lessee from E. C. Stewart, who is owner of property in Block 8, Swisher Addition in the Isaac Decker League, City of Austin, Travis County, Texas, the same abutting the west side of South Congress Avenue and located north of the north property line of West James Street, is desirous of obtaining permission to operate a drive-in ice service and food pantry at this location and to construct driveways as shown on the attached plan. The property at this location has been zoned for commercial use and we recommend that the request be granted subject to the construction of concrete driveways as shown on the plan hereto attached marked 2-0-508, which plan is hereby made a part of this request. Stewart, owner of property in Blook 8, of Swisher Addition in the Isaac Decker League, City of Austin, Travis County, Texas, the same being situated on the west side of South Congress Avenue and north of the north property line of James Street, has made application to the City Council for permission to operate a drive-in ice service and food pantry as shown upon the plans presented by the said Publiz Ice and Food Pantries, Incorporated, which plan is marked 2-0-508, and the said E. C. Stewart has made application in conjunction with the said Publix Ice and Food Pantries, Incorporated, for permission to construct two 39-foot concrete driveways with a 10-foot safety island in between said driveways; and fore WHEREAS, The City Council has favorably considered the granting of said request; there BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT permission is hereby granted E. The Mayor introduced the following resolution: WHEREAS, A street exists in Enfield Addition extending north from Enfield Road between Windsor Road and Parkway; and WHEREAS, Said street has never been officially named; and WHEREAS, Mrs. Dave Harrell has requested that it be given a name; and WHEREAS, Mrs. Harrell owns property abutting upon this street and has taken considerable interest in beautifying same; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the name of "Harrell Lane" be formally adopted as the official name of said street. The Mayor laid before the Council the following resolution: 'WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in that certain strip of land reserved for public utilities according to Travis County Deed Records, Volume 332, Page 621, the same being a strip of land 18 feet in width and extending from the north line of 38th Street to the south line of 39th Street between Speedway and Avenue "F", the centerline of which gas main shall be 134 feet west of 341 and parallel to the west line of Avenue "y". Said gas main described above shall have a cover of not less than 2 feet. (2) A gas main in HARTFORD ROAD from Niles Road south approximately 152 feet, the centerline of which gas main shall be 25 feet east of and parallel to the west line of said Hartford Road. said gas main described above shall have a cover of not less than 2t feet. (3) A gas main in NORTH GUADALUPE STREET south approximately 170 feet from Wheeler Street, the centerline of which gas main shall be 14 feet west of and parallel to the established centerline of the original North Guadalupe Street. Said gas main described above shall have a cover of not less than 22 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin, Upon motion of Councilman Gillis, the resolution was adopted by the following vote: Ayes, Councilmen Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 4; naye, none; Councilman Alford absent, 1. Tom Neal of the Traffic Division, the City Attorney was directed to prepare an ordinance prohibiting skating in the streets and the standing of pedestrians therein for the purpose of soliciting rides with motorists. The City Manager submitted a tabulation of bids received for removing the gate piers and driftwood at the Lake Austin Dam, and recommended that the height of the Dam be not raised at this time. Councilman Gillis moved that the recommendation of the City Manager be approved, and that the bid of Richard Schmidt, in the amount of $2900, be accepted as the lowest and best bid and the City Manager be instructed to enter into contract with the said Richard Schmidt accordingly. The motion was adopted by the following vote: Ayes, Counoilmen Bartholomew, Gillis, Mayor Miller, and Councilman wolf, 4; nays, none; Councilman Alford absent, 1. The Mayor introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of $2900 be and the same is hereby appropriated out of the Water and Light Fund, not otherwise appropriated, for the purpose of removing the gate piers and driftwood at the Lake Austin Dam.
