494 WHEREAS, Automobile accidents are increasing tremendously this year; and WHEREAS, Five deaths and one hundred and fifty-nine personal injuries have resulted from accidents in our city so far this year; and WHEREAS, It is the aim and purpose of the City Council to do all in its power to make motoring on the streets of Austin safe; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: ! THAT this City Council issue through the press of the City a warning to the people to abstain from those common, careless acts which cause the bulk of accidents on our streets; to obey the signs and signals and the ordinances of our Oity; and to observe those rules of courtesy and self-respect in driving which lie at the heart of the automobile safety problem in this country. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, 011118, Mayor Miller, and Councilman Wolf, 5; nays, none. The application of G. A. Carter, 99 San Marcos Street, for license to operate as a taxicab a 1933 Model Chevrolet Coach, Motor No. 3374321, State Highway License No.308-300, was read. Councilman Alford moved that the application be granted. Mayor Pro tem Wolf laid before the Council the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE OITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gaa mains in and upon the following streets: (1) A gas main in SAN JACINTO STREET beginning at the junction of two 4" gas mains, which point of beginning is 32 feet north of and 28 feet east of the intersection of the south line of East 12th Street and the west line of San Jacinto Street. Thence in a southerly direction with a 4" gas main, the centerline of which gas main shall be 28 feet east of and parallel to the west line 11 of San Jacinto Street, a distance of 32 feet; Thence in a westerly direction on a line with the south line of East 12th Street with the centerline of a 4" gas main a distance of 16 feet to the west ourb line of San Jacinto Street, at which point the size of this main may be reduced to 2 inches; Thence continuing on a line with the south line of said East 12th Street a distance of approximately 2 feet to a point that is 10 feet east of the west line of said San Jacinto Street; Thence in a southerly direction with the centerline of a 2" gas main 10 feet east of and parallel to the west line of San Jacinto Street a distance of 97 feet. Said gas main described above shall have a cover of not less than 2 feet. (2) A gas main in SAN JACINTO STREET beginning at the junction of two 4" gas mains, which point of beginning is 28 feet east of and 61 feet south of the intersection of the west line of San Jacinto Street and the north line of East 11th Street; 496 ! Thence in a northerly direction with the centerline of a 4" gas main 25 feet east of and parallel to the west line of Ban Jacinto Street a distance of 76 feet; Thence in a westerly direction with the centerline of said 4" gas main, which centerline shall be parallel to the north line of East 11th Street, a distance of 16 feet to the west curb line of San Jacinto Street, at which point the size of this main may be reduced to 2 inches; Thence continuing on a line parallel to the north line of East 11th Street a distance of approximately 12 feet to the west line of San Jacinto Street. Baid gas main described above shall have a cover of not less than 2 feet. (3) A gas main in SAN JACINTO STREET as follows: Beginning at a point on a 4" gas main within the intersection of East 11th Street and San Jacinto Street, which point of beginning is 61 feet south of and 10 feet west of the intersection of the north line of East 11th Street and the east line of San Jacinto Street; Thence in a northerly direction with the centerline of a 4" gas main, which centerline shall be 10 feet west of and parallel to the east line of San Jacinto Street, a distance of approximately 41 fest to the north curb line of East 11th Street, at which point the size of this main may be reduced to 2 inches; Thence continuing in a northerly direction with the centerline of a 2" gas main, which centerline shall be 10 feet west of and parallel to the east line of San Jacinto Street a distance of approximately 300 feet to the south curb line of East 12th Street, at which point the size of this gas main must be increased to 4 inches; Thence continuing in a northerly direction with the centerline of a 4" gas main, which centerline shall be 10 feet west of and parallel to the east line of San Jacinto Street, a distance of approximately 26 feet to a 4 gas main in East 12th Street. Said gas main described above shall have a cover of not less than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depthe may be required at special points. When the Texas Public Service Company requires definite information upon the grounds as to elevations of working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said company by the City of Austin. Upon motion of Councilman Gillis, the resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Pro tem Wolf, 4; nays, none; Mayor Miller absent, 1. Mayor Pro tem Wolf laid before the Council the following resolution: WHEREAS, Joe J. Daywood, owner of Lots 1 and 2, Block 1 of Buddington Subdivision within the City of Austin, Travis County, Texas, which property is located at the southwest corner of the intersection of Guadalupe and West 37th Streets, and being locally known as 3518 Guadalupe Street, has made application to the City Council of the City of Austin for permission to construct two 30-foot commercial driveways across the sidewalk area on the west side of Guadalupe Street and south of West 37th Street opposite the above described property, as shown upon the plan hereto attached marked 2-H-374, which plan is made a part hereof; and WHEREAS, The City Council has favorably considered the granting of said request; therefore, ! 497 i : ! : BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Joe J. Daywood, owner of Lote 1 and 2, Block 1 of Buddington Subdivision within the City of Austin, Travis County, Texas, which Lots 1 and 2, said Block 1, are located at the southwest corner of the intersection of Guadalupe and West 37th Streets, and which property is locally known as 3518 Guadalupe Street, is hereby granted permission to construct two 30-foot commercial driveways across the sidewalk area on the west side of Guadalupe Street and south of West 37th Street, which driveways are to be opposite said Lots 1 and 2, Block 1 of Buddington Subdivision, subject to the construction of concrete rampe, curbs, driveways and sidewalks as shown upon the plan hereto attached marked 2-H-374, which plan is hereby made a part of this resolution, and subject further to the condition that all concrete curb, ramp, driveway and sidewalk construction done within the City streets shall be done by a bonded sidewalk contractor and in accordance with lines and grades furnished by the Engineering Department of the City of Austin and under the supervision and direction of the City Engineer of said City of Austin. Mayor Pro tem Wolf laid before the Council the following resolution: WHEREAS, It has been determined that the assessments for taxes on 2.74 acres, Outlot 19, Division "0", 50 acres, Outlot 10/11, Division "0", and 11 2/5 acres, Outlot 19, Division "0", Oity of Austin, assessed in the name of Austin Country Club, for the year 1930, at the aggregate sum of $46,510, for the year 1931 at the aggregate sum of $46,465, for the year 1932 at the aggregate sum of $45,585, and for the year 1933 at the aggregate sum of $43,885, are each excessive, and should be lowered; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aggregate assessment on the above described property for the year 1930 be reduced from $46,500, and fixed at $37,210, for the year 1931 from $46,464 and fixed at $37,170, for the year 1932 from $45,585 and fixed at $36,464, and for the year 1933 from $43,888 and fixed at $35,108, and the Tax Assessor and Collector is hereby authorized and directed to change his records accordingly. BE IT FURTHER RESOLVED: THAT all interest and penalties that have accrued on said tax account be and the same is hereby remitted. Johnson Estate, and during said time the title to said property has been in litigation, and for such reason no responsible party could be found to pay the taxes; and WHEREAS, It has only recently been determined by judgment of the Court that E.R.York is the rightful owner of the property; and WHEREAS, During the time of litigation as to the title to the property, there has
