REGULAR MEETING OF THE CITY COUNCIL: 539 Austin, Texas, September 13. 1934. The meeting was called to order with Mayor Pro tem Oswald G. Wolf presiding. call showed the following members present: Councilmen C. F. Alford, C. M. Bartholomew, Simon Gillis, and Mayor Pro tem Oswald G. Wolf, 4; absent, Mayor Tom Miller, 1. Ro11 The Minutes of the last regular meeting were read and upon motion of Councilman Gilli were adopted as read by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Pro tem Wolf, 4; nays, none; Mayor Miller absent, 1. Orin E. Metcalfe, et al, submitted a petition signed by a majority of the qualified voters of the certain territory out of St. Elmo Common School District No. 43 described therein, asking for the annexation of said territory to the City of Austin for school purposes only. H. K. Dickehut, Trustee of the St. Elmo school, protested the proposed annexation on the grounds that it would greatly curtail the revenues of said school. Action on the matter was deferred until the next regular meeting, A. C. Baldwin and Dr. E. O. Chimene, City Health Officer, came before the Council and urged that a campaign for the extermination of rats be inaugurated as a health measure. The matter was referred to the City Manager, with instructions to confer with the local FERA authorities and find out if workers could be supplied by said organization to assist in the work. Mrs. Lena Dancy Ledbetter submitted a request for the opening of Dancy Street through Dancy Addition. The matter was referred to the City Engineer, Jack Turner, Advertising Agent of the Harley Sadler Shows, petitioned the Council for a permit for said shows to play for one month, beginning October 10th, on the vacant block at 16th and Guadalupe Streets. Petitions from a large number of citizens and taxpayers asking that the permit be granted were received. The Council took the matter under advisement until the next regular meeting. Mayor Pro tem Wolf introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of $2.50 be and the same is hereby appropriated out of the General Fund, not otherwise appropriated, for the purpose of refunding to Kuhn's Pharmacy the amount of cigarette license paid by said firm for the year 1934, under License No. 6305. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Pro tem Wolf, 4; nays, none; Mayor Miller absent, 1. Mayor Pro tem Wolf introduced the following resolution: WHEREAS, Steve Heffington, Jr., lessee from the H. & T. C. Railroad Company of a paroel of land situated in Blocks 3 and 4, in Outlet 10, Division "A", of the Government Out- lots adjoining the Original City of Austin, Travis County, Texas, which parcel of land fronts 75 feet on East 6th Street and is situated on the south side thereof, the east line of which parcel of land being 287 feet westerly from the west line of Perdenales Street and being locally known as 2401 East 6th Street, has made application to the City Council of the City of Austin for permission to construct one 20-foot commercial driveway opposite said parcel of land as shown upon the plan hereto attached marked 2-H-392, which plan is made & part hereof; and WHEREAS, The City Council has favorably considered the granting of said request; therefore, i i 540 ! BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Steve Heffington, Jr., lessee from the H. & T. C. Railroad Company of a parcel of land situated in Blocks 3 and 4, in Outlot 10, Division "A", of the Government Outlota adjoining the Original Oity of Austin, Travis County, Texas, which parcel of land fronts 75 feet on East 6th Street and is situated on the south side thereof, the east line of which parcel of land being 287 feet mesterly from the west line of Perdenales Street and being locally known as 2401 East 6th Street, is hereby granted permission to construct one 20-foot commercial driveway opposite the above mentioned parcel of land subject to the construction of concrete ramps, ourbs and driveways as shown upon the plan hereto attached marked 2-11-392, which plan is hereby made a part of this resolution, and further subject to the condition that all concrete curb, ramp and driveway construction done within the City streets shall be done by a bonded sidewalk contractor and in accordance with lines and grades furnished by the Engineering Department of the City of Austin and under the supervision and direction of the City Engineer of the City of Austin. Upon motion of Councilman Gillis, the resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Pro tem Wolf, 4; nays, none; Counoilman Bartholomew absent, 1. Mayor Pro tem Wolf introduced the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Counc11; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A 2" high-pressure gas main in MoDONALD AVENUE, beginning at a point 19 feet west of and 165 feet north of the intersection of the cast line of MoDonald Avenue and the north line of West 35th Street; thence in a northerly direction with the centerline of said gas main, which centerline shall be 19 feet west of and parallel to the east line of said McDonald Avenue, for a distance of 204 feet. Said gas main described above shall have a cover of not less than 2t feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Upon motion of Councilman Gillis, the resolution was adopted by the following vote: ! ! : Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Pro tem Wolf, 4; nays, none; Mayor Miller 541 absent, 1. The application of R. A. Miller, 805 Spence Street, for license to operate as a taxicab a Debota Sedan, 1930 Model, Factory No. 23058, State Highway License No. 948544, was read. Councilman Gillis moved that the application be granted. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Pro tem Wolf, 4; nays, none; Mayor Miller absent, 1. The application of B. J. Dzierzanowski, 309 Crockett Street, for license to operate as a taxicab a 4-door Buick Sedan, Factory No. 2051386, State Highway License No.952-654, was read. Councilman Gillis moved that the application be granted. The motion carried by the following vote: Ayee, Councilmen Alford, Bartholomew, Gillis, Mayor Pro tem Wolf,4; nays, none; Mayor Miller absent, 1. The application of E. Owens, 1128) West 6th Street, for license to operate as a taxicab a 4-door Chevrolet Sedan, 1934 Model, Factory No. 4454134, State Highway License No. 198364, was read. Councilman Gillis moved that the application be granted. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Fro tem Wolf, 4; naye, none; Mayor Miller absent, 1. Mayor Pro tem Wolf introduced the following ordinances AN ORDINANCE AMENDING SECTION 6 OF AN ORDINANCE ENTITLED "AN ORDINANCE TO PROVIDE FOR LICENSING AND REGULATING PERSONS WHO ENGAGE IN BUYING AND/OR SELLING FISH, OYSTERS, SHRIMP, LOBSTERS, ORABS, TURTLES, TERRAPING AND CLAMS AT WHOLESALE AND RETAIL WITHIN THE CITY OF AUSTIN, DEFINING TERMS AND FIXING PENAL- TIES.A The ordinance was read the first time and Councilman G1111s moved that the rule be suspended and the ordinance be placed on its second reading. The motion carried by the following vote: Ayee, Councilmen Alford, Bartholomew, Gillis, Mayor Pro tem Wolf, 4; naye, none; Mayor Miller absent, 1. The ordinance was read the second time and Councilman Gillis moved that the rule be further suspended and the ordinance be placed on its third reading. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Fro tem Wolf, 4; nays, none; Mayor Miller absent, 1. The ordinance was read the third time and Councilman Gillis moved that the same be finally passed. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Pro tem Wolf, 4; nays, none; Mayor Miller absent, 1. A letter of appreciation from Mrs. Frances H. Stacy for the naming of Stacy Park in honor of her deceased husband, im. H. Stacy, was received and filed. A letter from E. W. Winkler, tendering his resignation as a member of the Austin Public Library Commission, was read. Councilman Bartholomew moved that the resignation of the said E. W. Winkler be accepted with regret, and that the City Manager be instructed to write him a letter expressing the thanks of the Council for his valuable services while on the Commission. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Pro tem Wolf, 4; nays, none; Mayor Miller absent, 1.
