Attost: Helen Millar City Clerk REGULAR MEETING OF THE CITY COUNCIL: Appro Jom milla. Mayor. Austin, Texas, October 18, 1934. The meeting was called to order with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen C. F. Alford, O. M. Bartholomew, Simon Gillis, Mayor Miller, and Councilman Wolf, 5; absent, none. The regular order of business was suspended. T. H. Seekatz presented a petition signed by a number of residents on West 35th Street, asking for the opening of said street between King Street and West Avenue. The matter was referred to the City Manager and City Engineer for investigation and report to the Council at its next regular meeting. A. M. Soott appeared before the Council to protest the excessive valuation placed on a lot owned by him in Edgecliff Terrace, Travis Heights. The matter was taken under advisement with the Board of Equalization. Councilman Wolf offered the following resolution: WHEREAS, In accordance with the requirements of Federal Emergency Administration of Public Works and the provisions of the City Charter of the City of Austin, Texas, proposal for bids for the various works under P. W. A. Dooket No. 9223, Eng. Ref. No. 71, was duly advertised to be received by the City Manager and to be opened at 2 o'clock P. M., October 17, 1934, at the City Hall in the City of Austin, Texas; and and WHEREAS, At said time and place said bids were publicly opened and read as specified; WHEREAS, Thereupon it was found that W. J. Schwarzer, of Austin, Texas, was the lowest and best bidder for that part of the work specified under bid No. 1, towit, for the construction of the Public Market Building, walks, curbs and pavements, and that said bid was regular and proper in all particulars; and WHEREAS, Thereupon it was also found that Spiller & Miller, of Austin, Texas, were the lowest and best bidders for that part of the work specified under bid No. 2, towit, for the construction and installation of the plumbing on and in said works, and that said ! 568 bid was regular and proper in all particulars; and WHEREAS, Thereupon it was also found that John L. Martin, of Austin, Texas, was the lowest and best bidder for that part of the work specified under bid No. 3, towit, for the construction of the electric work on and in said works, and that said bid was regular and proper in all particulars; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: : THAT said bid of W. J. The Mayor introduced the following resolution: WHEREAS, The Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the Oity Engineer; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be, and the same is hereby permitted to construct its pole lines in the following streets: (1) A telephone pole line in EAST THIRTIETH STREET from East Avenue to Robinson Street, the centerline of which pole line shall be 6 feet north of and parallel to the south line of said East 30th Street. (2) A telephone pole line in EAST AVENUE ALLEY from East 30th Street south approximately one-half block, the centerline of which pole line shall be 1 foot east of and par- allel to the west line of said East Avenue Alley. The Mayor offered the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative mape or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: 570 (1) A gas main in EAST THIRTY-SECOND STREET beginning at a point & feet north of and 30 feet east of the intersection of the south line of East 32nd Street and the west line of Robinson Street; Thence in a westerly direction with the centerline of a gas main, which centerline shall be 8 feet north of and parallel to the south line of East 32nd Street, for a distance of 170 feet. Said gas main described above shall have a cover of not less than 20 feet. (2) A gas main in DEPEW AVENUE beginning at a point &t feet west of and 210 feet north of the intersection of the east line of Depew Avenue and the north line of East 46th Street, Thence in a southerly direction with a gas main, the centerline of which shall be s fest west of and parallel to the east line of said Depew Avenue, for a distance of 556 feet. Said gas main described above shall have a cover of not less than 2t feet. (3) A gas main in EAST FORTY-SIXTH STREET beginning at a point 15 feet north of and St fest west of the intersection of the east line of Depew Avenue and the south line of East 46th Street; Thence in an easterly direction with a gas main, the centerline of which shall be 15 feet north of and parallel to the south line of said East 46th Street, for a distance of approximately 150 feet to the City limit line. Said gas main described above shall have a cover of not less than 21 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Upon motion of Councilman Gillis, the resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. The Mayor introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of $2.50 be and the same is hereby appropriated out of the General Fund, not otherwise appropriated, for the purpose of refunding to Lou Sweet the amount of cigarette dealer's license paid by him for the year 1934, under License No. 6272. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. The Mayor introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager is authorized and directed to enter into a lease with Jennie Washington of her land situated about two (2) miles east of the City of Austin for the term: of one year at the consideration of $100.00 per year, and the privilege of renewal of said lease from year to year of her said land, to be used by the City of Austin as a dumping i ! ground for refuse, waste and garbage. 571 The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. The Mayor introduced the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the Oity of Austin hereafter named, and said maps or plans have been considered by the Oity Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A 4" cast iron gas main in SAN JACINTO STREET, beginning at a point 24 feet south of and 29 feet east of the intersection of the north line of East Sth Street and the west line of San Jacinto Street; Thence in a northerly direction with said gas main, the centerline of which shall be 29 fest cast of and parallel to the west line of said San Jacinto Street, to the north line of East 10th Street. Said gas main described above shall have a cover of not less than 2 feet. (2) A4" cast iron gas main crossing SAN JACINTO STREET, beginning at a point on the west line produced of Ban Jacinto Street, at a point 24 féet south of the north line of East 8th Street; Thence crossing said San Jacinto Street to a point on the east line produced of San Jacinto Street, which point shall be 24 feet south of the north line of East Sth Street. Said gas main described above shall have a cover of not less than 2 feet. (3) A 3" cast iron gas main at the intersection of EAST NINTH STREET and SAN JACINTO STREET as follows: Beginning at a point 29 feet east of and 19 feet north of the intersection of the west line of San Jacinto Street and the south line of East 9th Street; Thence in a westerly direction to a point on the west line produced of San Jacinto Street, which point shall be 19 feet north of the south line of East 9th Street. Said gas main described above shall have a cover of not less than 2 feet. (4) A 2" gas main in the intersection of EAST NINTH STREET and SAN JACINTO STREET, as follows: Beginning at a point 29 feet cast of and 19 feet north of the intersection of the west line of San Jacinto Street and the south line of East 9th Street; Thence in an easterly direction to a point on the east line produced of San Jacinto Street, which point shall be 19 feet north of the south line of East 9th Street. Baid gas main described above shall have a cover of not less than 2 feet. (5) A 4" cast iron gas main in the intersection of EAST TENTH STREET and SAN JAGINTO STREET, as follows: Beginning at a point 29 feet east of and 28 feet north of the intersection of the west line of San Jacinto Street and the south line of East 10th Street; Thence in a westerly direction to a point on the went line produced of San Jacinto! Street, which point shall be 28 feet north of the south line of East 10th Street. Said gas main described above shall have a cover of not less than 2 feet. (6) A 2" gas main within the intersection of EAST TENTH STREET and SAN JACINTO STREET, as follows: Beginning at a point 29 feet east of and 19 feet north of the intersection of the west line of San Jacinto Street and the south line of East 10th Street; Thence in an easterly direction to a point on the east line produced of San Jacinto Street, which point shall be 19 feet north of the south line of East 10th Street. Said gas main described above shall have a cover of not less than 2 feet. AND THAT whenever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said company by the City of Austin. Upon motion of Councilman Alford, the resolution was adopted by the following vote: Ayee; Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. Councilman Gillis moved that the Red Cross Society be granted a temporary permit to hang triangular signs, measuring five feet, to the electric light poles on Congress Avenue as a means of advertising their drive for the week of November 12th to 17th. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. The matter of water line extension to the residence of H. C. Treadwell on Woodmont Avenue, situated outside of the corporate limits, as submitted by Councilman Bartholomew, was referred to the City Manager, Oity Attorney, and Superintendent of Water Lines for adjustment. The matter of widening the underpass of the International & Great Northern Railroad on Enfield Road was referred to the Oity Manager for attention. There being no further business, Councilman Gillis moved to recess subject to call of the Mayor. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; naye, none.
