A. W. Harris, Architect, submitted plans for a gasoline filling station to be constructed by S. Ferris at 504-6-8 East 6th Street. Councilman G11118 moved that the permit be granted, subject to the approval of the plans and specifications by the Engineering Department. The motion carried by the following vote: Ayes, Councilmen Bartholomew, G11118, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Alford absent, 1. Councilman Gillis offered the following resolution: WHEREAS, Dr. E. C. Barker, acting by and through H. F. Kuehne, Architect, has made application to the City Council of the City of Austin for permission to construct two commercial driveways across the east sidewalk area of Rio Grande Street south of West 24th Street adjacent to property owned by said Dr. E. C. Barker, which property is known as the west 60 feet of Lote 1 and 2, of Horst's Subdivision of Outlot 37, Division "D", of the Government Outlots adjoining the Original City of Austin, Travis County, Texas, which driveways are shown upon the plan hereto attached marked 2-H-423, which plan is made a part of said request; and WHEREAS, the City Council of the City of Austin has favorably considered the granting 46 of said request; therefore BE IT RESOLVED BY THE OTTY COUNCIL OF THE CITY OF AUSTIN: THAT Dr. E. C. Barker, acting by and through H. F. Kuehne, Architect, is hereby granted permission to construct two commercial driveways across the east sidewalk area of Rio Grande Street south of West 24th Street adjacent to property owned by said Dr. E.C.Barker, which property is known as the West 60 feet of Lots 1 and 2 of Horst's Subdivision of Outlot 37, Division "D", of the Government Outlots adjoining the Original City of Austin, Travis County, Texas, subject to the construction of concrete rampe, curbs, driveways and expansion Joints as shown upon the plan hereto attached marked 2-H-423, which plan is hereby made a part of this resolution, and further subject to the condition that all concrete curb, ramp and driveway construction done within the City streets shall be done by a bonded sidewalk contractor under the direction and supervision of the City Engineer of the City of Austin and in accordance with lines and grades furnished by the Engineering Department of the City of Austin. Councilman Wolf offered the following resolution: WHEREAS, the Board of Adjustment has proposed that the Zoning Ordinance of the City of Austin be amended so as to change the zoning designation of the quarter-blocks abutting on Congress Avenue between 13th and 14th Streets, which property is legally known as Original Lots 1, 2, and 3, Block 159, and Original Lote 1, 2, and 3, Block 160, of the Original City of Austin, from "B" Residence District to "C" Commercial District; and WHEREAS, under the terms of the Zoning Ordinance a public hearing must be held at which opportunity shall be given the public to offer any objections to said amendment; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT a public hearing be held on this amendment at the City Hall at 11:00 A. M. on Thursday, March 7, 1935, and that notice of such hearing be completed by publication as required by the terme of said Zoning Ordinance. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Bartholomew, G11118, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Alford absent, 1. The following report was read: "Austin, Texas February 13, 1935 Mr. Guiton Morgan City Manager Austin, Texas. Dear Sir: We, the undersigned, have considered the application of J. S. Woodard for permission to construct, maintain and operate a drive-in gasoline filling station and to construct commercial driveways, sidewalks and curbs in conjunction therewith, which filling station is to be located at the northeast intersection of Guadalupe Street and West 45th Street within the City of Austin, Travis County, Texas, and we hereby advise that the following conditions exist: The property upon which this filling station is to be located is designated as "C" Commercial Use District upon the zoning map of the City of Austin. A storm sewer exists in Guadalupe Street and in West 45th Street adjacent to the property upon which this filling station is to be located. We recommend that J. S. Woodard be granted permission to construct, maintain, and operate said drive-in gasoline filling station and to construct curbs, ramps, sidewalks and driveways in conjunction therewith, subject to the following conditions: (1) That all buildings and equipment shall be placed inside of the property line, correct lines to be obtained before construction starts or equipment is installed. Lines and grades to be obtained from the City Engineering Department for entrances and driveways, building lines to be approved by the City Building Inspector. That the applicant shall confer with the City Engineering Department as to the future grades of the sidewalks and gutters on the adjacent streets before he starts any construction relative to the filling station. (2) That all construction of the filling station improvements shall be in accord with the Building Ordinance, the Zoning Ordinance, the Filling Station Ordinance, and in accord with the ordinance prohibiting the disposal of commercial water or oils upon the City streets. (3) That the grades of the station shall be such that no waste oils or water or any floor washings shall ever pass over the City sidewalk area and that all of said oils and water shall be concentrated into a combined grease and sand trap which shall be constructed in accordance with our standard plan 2-H-146, and shall be conducted by a pipe connection from said sand trap to the nearest storm sewer at the expense of the applicant. Before commencement of any construction the applicant shall apply to the City Engineer for an estimate of the cost of that portion of the storm sewer which will have to be built within any City street or alley and shall deposit in escrow a sum equal to said estimate with the City Finance Director. (4) That all filling station improvements, ts, pumps, driveways, ramps, gutters, sidewalks and curbs shall be constructed of concrete at the expense of the applicant as as set forth upon the plan hereto attached, which plan bears the City Engineer's file number 2-0-568. (5) Expansion Joints shall be constructed as shown upon the plan hereto attached marked 2-0-568 and shall be of the pre-moulded type. (6) That before use of said station the owner shall apply to the Building Inspector for final inspection when he considers that he has complied with all the requirements of the City. Councilman Wolf then offered the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 1 THAT the City Council of the City of Austin hereby approves as a filling station site the property situated at the northeast intersection of West 45th Street and Guadalupe Street within the City of Austin, Travis County, Texas, which property is owned by J. S. Woodard and is a portion of the Thos. Gray Survey and hereby authorizeв J. S. Woodard to construct, maintain, and operate a drive-in gasoline filling station and to construct curbs, ramps, sidewalks and driveways in conjunction therewith, subject to the same's being constructed in compliance with all the ordinances relating thereto and further subject to the foregoing attached recommendations and plans; and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of this fi11ing station after full compliance with all the provisions of this resolution, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that the said J. S. Woodard has failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances. Councilman Gillis offered the following resolution: 47 48 i WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its pole lines in the following streets: (1) A telephone pole line in SOUTH FIFTH STREET south approximately one-quarter block from West James Street, the centerline of which pole line shall be 9 feet east of and parallel to the west line of said South 5th Street. (2) A telephone pole line in WEST THIRTY-FIRST STREET from San Gabriel Street west approximately two blocks, the centerline of which pole line shall be 1 foot north of and parallel to the south line of said West 31st Street. THAT the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed, shall be under the supervision and direction of the City Manager, and in accordance with the ordinances and regulations of the City of Austin governing such construction. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Alford absent, 1. The application of Ira L. Duett, 802 West Johanna Street, for permit to operate as a taxicab a 1933 Chevrolet sedan, Engine No. 3775204, State Highway License No.773-853, was read. Councilman Wolf moved that a temporary permit be granted during the term of the Legislature, the same to become permanent whenever a vacancy occurs in the quota of forty allowed. The motion carried by the following vote: Ayes, Councilmen Bartholomew, G11118, Mayor Miller, and Councilman Wolf, 4; naye, none; Councilman Alford absent, 1. A committee from the Boy Scouts Organization, composed of Land and Sea Scouts, came before the Council upon the occasion of their Twenty-Firth Anniversary to express their appreciation for the assistance that the City has given them, especially for the hut at Zilker Park, and to offer their services at Lake Austin whenever needed. Councilman Wolf then moved that the Council indorse the following proclamation to be issued by the Mayor. The motion was seconded by Councilman Gillis and carried by the following vote: Ayes, Councilmen Bartholomew, G11118, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Alford absent, 18 #The Boy Scouts of America, incorporated February 8, 1910, and chartered by Congress June 15, 1916, have during the past twenty-five years rendered notable service to the Nation. They have done effective work in this community and throughout the country in rendering various civic service good turns. The Boy Scouts have not only demonstrated their worth to the Nation, but have also contributed to a deeper appreciation by the American people of the higher conception of good citizenship. The objective of the present Ten Year Program of the Boy Scouts of America 18 to provide for the Nation a citizenry in which one of every four of the new male citizens each year will have had at least four years of Scout training. During the past twenty-five years 6,530, 330 persons through the various branches of Scouting have enjoyed Adventure, Hiking, Camping, Swimming, Woodcraft, Handicraft, Fellowship, Health and Safety, and have learned how to be helpful to others and have been trained to be participating citizens. During this week the Boy Scouts of America are celebrating their Twenty-Fifth Anniversary, continuing with a year of special activities, including a National Jamboree in Washington, D. C., as announced by President Roosevelt. THEREFORE, I, Tom Miller, Mayor of the City of Austin, do hereby recommend that the citizens of this city observe this Boy Scout Week and Anniversary Year for the purpose of strengthening the work of the Boy Scouts of America. I earnestly recommend that our civic organizations, our churches and our schools cooperate in carrying out a program for a definite recognition of the effective service rendered by the Boy Scouts of America, in order that the work of the Boy Scout Program may be extended to a larger proportion of the boyhood of this City. The Boy Scout Movement offers unusual opportunity for volunteer service. It needs men to serve in various capacities as leaders of boys. I hope that all who can will, through the organization with which they are connected, enlist for such personal service. Anything that is done to increase the effectiveness of the Boy Scouts of America w111 be a genuine contribution to the welfare of this City, the State, and the Nation. IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of this City to be affixed. Mayor Miller declared the hearing open at 11 o'clock A. M., relative to street improvements to be constructed on the following street: EAST FOURTH STREET from east property line of Red River Street to the east property line of Sabine Street; and thereupon stated that all persons desiring to protest the levying of assessments against abutting property on the above mentioned street and within the limits above stated, or who desired to be heard with reference to the improvements proposed to be assessed against said property and the owners thereof, or any other matters or things authorized by the provisions of Article XXIV of the Charter of the City of Austin to be urged and considered at this hearing would now be heard from and thereupon the following persons appeared and were heard: Judge Houghton Brownlee and E. F. Smith, Attorneys for Texas & New Orleans Railway Company, protested the assessment against said Company on the grounds that said Company was not financially able to pay for same and asked for an adjustment. After considerable discussion, the hearing was receased until 2 o'clock P. M., at which time the matter would be furtherdiscussed at a conference between the Attorneys for the Railroad Company and the City Manager, City Attorney, City Engineer, F. W. Sternenberg, property owner, and C. A. Maufrais, contractor. The request of the Texas Transient Bureau for a renewal of the agreement between the City and the owners of the Security Trust Company Building located at 8th Street and Congress Avenue, whereby the City agreed to remit the taxes on that portion of sald building occupied by the Texas Transient Bureau, was referred to the City Manager and City Attorney to have the matter attended to. Councilman Wolf offered the following resolution: WHEREAS, in the course of transactions between the City of Austin and the Travis County Relief Committee proceeds from the sale of hides, resulting from the slaughtering of cattle for the said Relief Committee, in the amount of $1,068.38, have accumulated and said Committee has this sum remaining after expense payments; and WHEREAS, it appears that this money should be deposited by the Committee to the credit of the General Fund of the City of Austin; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be directed to notify said Committee, through C. H. Page, Chairman at the time of said transaction, of their decision that said balance amounting to $1,068.38, be credited to the City of Austin, and that said Committee be furnished a copy of this resolution.
