Wolf presiding. Roll call showed the following members present: Councilmen C. F. Alford, C. M. Bartholomew, Simon G11118, Mayor Pro tem Oswald G. Wolf, 4; absent, Mayor Tom Miller, 1. The reading of the Minutes was dispensed with. The following bids for the purchase of Seventy-five Thousand Dollars ($75,000.00) City of Austin, Texas, Public Market 4%, 20-year, serial coupon bonds, dated January 1,1935 of the denomination of One Thousand Dollars ($1,000.00) each, were opened and read: Stern Bros. & Co., Kansas City, Garrett & Company, Dallas - par and accrued interest from date of Bonds to to date of delivery at Austin, Texas, plus a cash premium of $3,577.50; A. W. Councilman Gillis moved that the bid of The Capital National Bank of Austin, Texas, for par and accrued interest from date of Bonds to date of delivery at Austin, Texas, plus a cash premium of $3,875.00, be accepted and the checks of the unsuccessful bidders be returned to them. The motion carried by the following vote: Ayes, Councilmen Alford, 94 Bartholomew, Gillis, Mayor Pro tem Wolf, 4; nays, none; Mayor Miller absent, 1. The hearing called for this day on the proposal of the City Council to amend the Zoning Ordinance in the following particulars, to-wit: To amend the Use designation of all property on the south side of 19th Street from San Antonio Street to Rio Grande Street for a depth of 150 feet and on the north side of 19th Street from San Antonio Street to Rio Grande Street consisting of Original Lot 23, Outlot 22, Original Lots 21, 20 and the south 20 feet of Lot 19, all of Lot 7, the south 40 feet of Lot 8, and all of Lot 6, Outlot 23, in Division "D" of the City of Austin so as to change same from "B" Residence District to "C" Commercial District was declared open. No one appearing to protest, Councilmen G1111s moved that the City Attorney be directed to prepare an ordinance amending the Zoning Ordinance in the particulars stated. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, G1111s, and Mayor Pro tem Wolf, 4; nays, none; Mayor Miller absent, 1. M. R. Otto appeared before the Council and asked for the appointment of an assistant plumbing inspector. The matter was referred to the City Manager for recommendation. Don Gillum, representing the American Legion, asked for permission to use Barton Springs pavilion during the summer for their weekly dances. The matter was referred to the City Manager and the Superintendent of Recreation • Councilman Alford offered the following resolution: WHEREAS, J. S. Woodard has made application to the City Council of the City of Austin for permission to construct a commercial driveway across the north sidewalk area of West 45th Street at a location immediately east of the east line of Guadalupe Street, which sidewalk is adjacent to a parcel of land owned by the said J. S. Woodard, which land abute the east side of Guadalupe Street and the north side of West 45th Street, and being located within the City Limits of the City of Austin, Travis County, Texas, and which driveway, curbs, gutters and sidewalks are to be constructed as shown in color upon the plan hereto attached marked 2-0-568, which plan is hereby made a part of said request; and WHEREAS, the City Council of the City of Austin has favorably considered the granting of said request; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT permission is hereby granted J. S. Woodard to construct a commercial driveway and to build curbe, sidewalks and gutters in conjunction therewith across the north sidewalk area of West 45th Street at a location immediately east of the east line of Guadalupe Street, which commercial driveway is to be constructed adjacent to a parcel of land owned by the said J. S. Woodard, which parcel of land abuts the east side of Guadalupe Street and the north side of 45th Street and is located within the City Limite of the City of Austin, Travis County, Texas, subject to the construction of concrete ramps, curbs, gutters, sidewalks and expansion Joints as shown in color upon the plan hereto attached marked 2-0-568, which plan is hereby made a part of this resolution, and that all concrete curb, ramp, driveway, sidewalk and gutter construction done within the City streets shall be done by a bonded curb and sidewalk contractor under the direction and supervision of the City Engineer of the City of Austin and in accordance with lines and grades furnished by the Engineering Department of the City of Austin. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Pro tem Wolf, 4; nays, none; Mayor Miller absent, 1. Councilman Gillis offered the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; 0 therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in OLDHAM STREET, beginning at a point 15 feet south of and 10 feet east of the intersection of the north line of East 23rd Street and the west line of Oldham Street; Thence in a northerly direction with the centerline of a gas main, which centerline shall be 10 feet east of and parallel to the west line of said Oldham Street, for a distance of 239 feet. Said gas main described above shall have a cover of not less than 20 feet. (2) A gas main in CROSS STREET, beginning at a point 20 feet west of and 107 feet south of the intersection of the east line of Cross Street and the south line of Garden Street; Thence in a southerly direction with the centerline of a gas main, which centerline shall be 20 feet west of and parallel to the east line of said Cross Street for a distance of 42 feet. Said gas main described above shall have a cover of not less than 22 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground ut111ties, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company 1s further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas maine, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager and under all pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Mayor Pro tem Wolf offered the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Councilmen Alford, Bartholomew, 01111s, and Mayor Pro tem Wolf be and they are hereby appointed as a committee to canvass the returns of the election held in the City of Austin, Texas, on April 1, 1935, and they are hereby instructed to report to the City Council the result of such canvass. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomer Gillis, Mayor Pro tem Wolf, 4; naye, none; Mayor Miller absent, 1. Mayor Pro tem Wolf offered the following resolution: WHEREAS, by virtue of an election held in the City of Austin, Texas, on the 1st day of Apr11, 1935, for the purpose of electing five Councilmen, the official returns from the election officials certify and show, and thereafter a canvass of said returns by the Committee appointed by the City Council to canvass said returns also show, that there were cast at said election a total of 1247 votes; and 95 96 WHEREAS, said returns, and the canvass thereof, also show that the following named persons severally received the total votes set opposite their names, respectively, towit: Chas. F. Alford received 1228 votes Jimmy Alred received 1 vote C. M. Bartholomew received 1.234 votes Em11 Barnhardt received 1 vote Simon 011118 received 1239 votes Tom Miller received 1233 votes Ed Schutze received 1 vote Oswald G. Wolf received 1231 votes Total Vote cast at Election 1247 ; and WHEREAS, it appears that Chas. F. Alford, C. M. Bartholomew, Simon Gillis, Tom Miller, and Oswald G. Wolf have received the highest number of votes cast for councilmen at said election; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT in accordance with said returns, as received and canvassed, the following named persons are hereby declared duly elected, and authorized to qualify for the positions of councilmen for the City of Austin, for the term of two years, beginning May 1, 1935: Chas. F. Alford, C. M. Bartholomew, Simon Gillis, Tom Miller, and Oswald G. Wolf. Roll call showed the following members present: Councilmen C. F. Alford, Simon Gillis, Mayor Tom Miller, and Councilman Oswald G. Wolf, 4; absent, Councilman C. M. Bartholomew, 1. The hearing on the proposal of the City Council to amend the Zoning Ordinance of the City of Austin in the following particulars: To amend the Use designation of Lot 8, Block 28, of Travis Heights Subdivision, in the City of Austin, Travis County, Texas, so as to change same from "A" Residence District to "B" Residence District was declared open in accordance with published notice thereof. Jno. T. Smith, owner of the property in question, requested the change in order to permit the erection of a four-unit apartment house at 1017 Travis Boulevard, declaring that the proposed structure would be an asset to the community; that there was a need for this type of building in this locality; and that would not be used as a rooming or boarding house.
