    Five new councilmen (Chas. F. Alford, C. M. Bartholomew, Simon Gillis, Tom Miller, and Oswald G. Wolf) were officially declared elected to serve two-year terms starting May 1, 1935.
  • Travis Heights Apartment Approval

    Despite strong opposition from 37 residents concerned about property values and the neighborhood's residential character, the council approved a zoning change in Travis Heights to allow a four-unit apartment building.
  • Commercial to Residential Zoning Deferred

    A proposal to rezone a large area near 45th and Red River Streets from commercial to residential was postponed for 45 days, pending the finalization of a property sale contract under the existing commercial zoning.

96 WHEREAS, said returns, and the canvass thereof, also show that the following named persons severally received the total votes set opposite their names, respectively, towit: Chas. F. Alford received 1228 votes Jimmy Alred received 1 vote C. M. Bartholomew received 1.234 votes Em11 Barnhardt received 1 vote Simon 011118 received 1239 votes Tom Miller received 1233 votes Ed Schutze received 1 vote Oswald G. Wolf received 1231 votes Total Vote cast at Election 1247 ; and WHEREAS, it appears that Chas. F. Alford, C. M. Bartholomew, Simon Gillis, Tom Miller, and Oswald G. Wolf have received the highest number of votes cast for councilmen at said election; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT in accordance with said returns, as received and canvassed, the following named persons are hereby declared duly elected, and authorized to qualify for the positions of councilmen for the City of Austin, for the term of two years, beginning May 1, 1935: Chas. F. Alford, C. M. Bartholomew, Simon Gillis, Tom Miller, and Oswald G. Wolf. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Pro tem Wolf, 4; nays, none; Mayor Miller absent, 1. There being no further business, Councilman Alford moved to recess subject to call of the Mayor. Attest: Fallee I Oity Clerk SPECIAL MEETING OF THE CITY COUNCIL: Approved way. Walf Mayor Pro tem Austin, Texas, April 6, 1935. The meeting was called to order with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen C. F. Alford, Simon Gillis, Mayor Tom Miller, and Councilman Oswald G. Wolf, 4; absent, Councilman C. M. Bartholomew, 1. The hearing on the proposal of the City Council to amend the Zoning Ordinance of the City of Austin in the following particulars: To amend the Use designation of Lot 8, Block 28, of Travis Heights Subdivision, in the City of Austin, Travis County, Texas, so as to change same from "A" Residence District to "B" Residence District was declared open in accordance with published notice thereof. Jno. T. Smith, owner of the property in question, requested the change in order to permit the erection of a four-unit apartment house at 1017 Travis Boulevard, declaring that the proposed structure would be an asset to the community; that there was a need for this type of building in this locality; and that would not be used as a rooming or boarding house. 97 W. D. Hart, Attorney for applicant, Jno. T. Smith, plead for the change on the grounds that applicant had complied with all of the building provisions in his deed; that the proposed building is to be used strictly for residential purposes; that it will not be a detriment to the surrounding property, but will benefit the City of Austin in the way of increased taxes. Petitions signed by thirty-seven residents of Travis Heights, protesting the propoвед change on the grounds that it would destroy the value of this section as exclusively residential, were read. Chas. F. Hutter protested the change on the grounds that it would open the way for other changes and would render the Zoning Ordinance null and void. Louis Reuter objected on the grounds that to allow the erection of a four-unit apartment house would place this section in the rental class and depreciate its value as strictly residential. Chas. Betts objected to the change on the grounds that it would open the way for the building of larger units. Geo. F. Zimmermann protested the change on the grounde that it would greatly depreciate values in Travis Heights and cited Enfield as an example of decreased values by reason of apartment houses and plead for the preservation of the ordinance as it now stands. After hearing all arguments for and against the proposed change from Residence "A" to Residence "B" of the above described property, it was moved by Mayor Miller, seconded by Councilman Gillis, that this immediate area be changed from Residence "A" to Residence "B" so. as to permit the erection of the proposed apartment house by Mr. Smith. The motion carried by the following vote: Ayes, Councilmen Alford, G11118, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. The following ordinance was then introduced: AN ORDINANCE AMENDING, IN THE CERTAIN PARTICULARS HEREINAFTER STATED, AN ORDINANCE ENTITLED: "AN ORDINANCE ESTAB- LISHING ZONING REGULATIONS AND DISTRICTS IN ACCORDANCE WITH A COMPREHENSIVE PLAN; AND REGULATING AND DISTRICTING THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE PERCENTAGE OF LOT THAT MAY BE OCCUPIED, THE SIZE OF YARDS, COURTS AND OTHER OPEN SPACES, THE DENSITY OF POPULATION, THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND FOR TRADE INDUSTRY, RESIDENCES AND OTHER PURPOSES; AND DIVIDING THE CITY OF AUSTIN INTO DISTRICTS OR ZONES, AND REGULATING AND DISTRICTING THE ERECTION, CONSTRUCTION, RECONSTRUCTION, ALTERATION, REPAIR AND USE OF BUILDINGS, STRUCTURES OR LAND WITHIN SUCH DISTRICTS OR ZONES; AND PROVIDING UNIFORM REGULATIONS FOR THE SEVERAL CLASSES AND KINDS OF BUILDINGS OR STRUCTURES AND USES WITHIN THE DISTRICTS OR ZONES; AND ADOPTING TWO ZONING MAPS, DISCLOBING RESPECTIVELY THE SEVERAL USE DISTRICTS AND THE SEVERAL HEIGHT AND AREA DISTRICTS, AND THE RESTRICTIONS AND LIMITATIONS AND PROVISIONS APPLICABLE TO SUCH DISTRICTS; AND PROVIDING FOR A BOARD OF ADJUSTMENT AND DEFINING THE POWERS OF SAME; AND PROVIDING CER- TAIN PENALTIES AND REMEDIES; AND DECLARING AN EMERGENCY." The ordinance was read the first time and Councilman Gillis moved a suspension of the rule and the placing of the ordinance on its second reading. The motion carried by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. The ordinance was read the second time and Councilman Gillis moved a further suspension of the rule and the placing of the ordinance on its third reading. The motion carried by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. The ordinance was read the third time and Councilman G1111s moved that same be finally passed. The hearing on the proposal of the City Council to amend the Zoning Ordinance of the City of Austin in the following particulars, to-wit: To amend the Use designation of Lots & to 14, both inclusive, Block 10, of Ridgetop Annex; Lots 8 to 14, both inclusive, Block 9, Ridgetop Annex; Lots 1 to 7, both inclusive, Block 15, Ridgetop Annex; and part of R. M. Hamby 5 acre tract located at the southeast corner of 45th and Red River Streets, in the City of Austin, so as to change same from "C" Commercial District to "A" Residence District was then opened, in accordance with published notice thereof. Petition of owners of property contiguous to East 45th Street and Red River Street, asking that the property lying on the east and west sides of Red River Street and extending from Poponoe Street on the north to Ellingson and Keesby Streets on the south be changed from Commercial "C" to Residence "A", was read. Henry Faulk, Attorney, appeared in the interest of E. J. Honig, owner of property in this area, stating that said owner had entered into contract of sale for the purchase of his property under the present zoning and prior to the request for the change, and that the proposed use of the property would not be detrimental to its residential value. After hearing all interested citizens, it was the sense of the Council that the matter be deferred for forty-five days from date hereof and if contract of sale is not consummated and application for building filed within this time, the matter then be acted on.
