REGULAR MEETING OF THE CITY COUNCIL: 271 Austin, Texas, October 10, 1935. The meeting was called to order at 10:30 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen C. F. Alford, Simon Gillis, Mayor Tom Miller, and Councilman Oswald G. Wolf, 4; absent, Councilman C. M. Bartholomew, 1. The Minutes of the regular meetings of September 26 and October 3 were read and upon motion of Councilman Gillis, seconded by Councilman Alford, were adopted as read by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; naye, none; Councilman Bartholomew absent, 1. Councilman Wolf introduced the following ordinance: AN ORDINANCE ORDERING AN ELECTION TO OBTAIN THE CONSENT OF THE QUALIFIED VOTERS OF THE CITY OF AUSTIN, TEXAS, TO THE ISSUANCE OF BONDS BY THE CITY COUNCIL FOR THE PURPOSE OF THE CONSTRUCTION AND IMPROVEMENT OF PUBLIC FREE SCHOOL BUILDINGS IN THE CITY OF AUSTIN, AND THE PURCHASE OF GROUNDS AND EQUIPMENT THEREFOR The ordinance was read the first time and Councilman Wolf moved that the rule be suspended and the ordinance be passed to its second reading. The motion was seconded by Councilman Gillis, and same carried by the following vote: Ayes, Councilmen Alford, G1111s, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. The ordinance was read the second time and Councilman Wolf moved a further suspension of the rule and the placing of the ordinance on its third reading. The ordinance was read the third time and Councilman Wolf moved that same be finally passed. Councilman Wolf introduced the following ordinance: AN ORDINANCE REGULATING THE RATES TO BE CHARGED CONSUMERS FOR NATURAL GAS AND GAS SERVICE WITHIN THE CITY OF AUSTIN, TEXAS, AND REPEALING CERTAIN PROVISIONS OF THE ORDINANCE IN CONFLICT HEREWITH The, ordinance was read the first time and upon motion of Councilman Wolf, seconded by Counoilman Alford, the rule was suspended and the ordinance passed to its second reading by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. The ordinance was read the second time and Councilman Wolf, moved, seconded by Councilman Gillis, that the rule be further suspended and the ordinance be passed to its third reading. Councilman Gillis offered the following resolution: WHEREAS, the curb and sidewalk specifications of the City of Austin have previously been adopted by the City Council of the City of Austin require that all curbs and sidewalks be constructed of concrete unless a special permit has been secured from the City Council of the City of Austin to construct ourbs and sidewalks of other materials; and 272 WHEREAS, Rex Shields, owner of Lot 53, of Enfield F, a subdivision within the City of Austin, Travis County, Texas, which Lot 53 abuts the west side of Wethersfield Road at a location south of Niles Road, has requested the City Council of the City of Austin to grant permission for the construction of a flagstone walk from the property line to the curb line on the west side of said Wethersfield Road at the above described property; and WHEREAS, the City Council of the City of Austin has investigated and approved the construction of said flagstone walk; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Rex Shields, owner of Lot 53, of Enfield F, which property abuts the west side of Wethersfield Road at a location south of Niles Road, and being locally known as 1706 Wethersfield Road, is hereby granted permission to construct a flagstone walk from the curb line to the property line at the above described location and said walk is to be constructed under the supervision and direction of the City Engineer of the City of Austin and in accordance with lines and grades furnished by the Engineering Department of the City of Austin, and further subject to the following conditions: That the stone shall be laid in a smooth and workmanlike manner and shall conform to the sidewalk grades as furnished by the Engineering Department of the City of Austin in order that said flagstone walk will not create a hazard to pedestrians. That the stone shall be placed upon a 4" concrete base and that all work within the City street area shall be done by a bonded sidewalk contractor. The resolution was adopted by the following vote: Ayes, Councilmen Alford, G1111sm Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. Councilman Alford offered the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in PALMA PLAZA, beginning at a point 19 feet south of the north 11ne of Palma Plaza and 143 feet east of the east line of Hartford Road; Thence in a westerly direction with the centerline of a gas main, which centerline shall be 19 feet south of and parallel to the north line of Palma Plaza, for a distance of 265 feet. Said gas main described above shall have a cover of not less than 20 feet. (2) A gas main in WEST FORTY-FOURTH STREET from Alice Avenue to Maybelle Avenue, the centerline of which gas main shall be 15 feet south of and parallel to the north iine of said West 44th Street. Said gas main described above shall have a cover of not less than 20 feet. (3) A gas main in MAYBELLE AVENUE, beginning at a point 15 feet west of the east line of Maybelle Avenue and 57 feet north of the north line of Weet 44th Street; Thence in a southerly direction with the centerline of a gas main, which centerline shall be 15 feet west of and parallel to the east line of said Maybelle Avenue, to a point that is 114 feet south of the south line of West 44th Street. Said gas main described above shall have a cover of not less than 2 feet. (4) A gas main in Comal Street from East 3rd Street to East 4th Street, the centerline of which gas main shall be 22 feet east of and parallel to the centerline of said Comal Street. Said gas main described above shall have a cover of not less than 2 feet. (5) A gas main in HASKELL STREET, beginning at a point 20 feet south of the north line of Haskell Street and 14 reet east of the east line of Lynn Street; Thence in an easterly direction with the centerline of a gas main, which centerline shall be 20 feet south of and parallel to the north line of Haskell Street, for a distance of 196 feet. 273 Said gas main described above shall have a cover of not less than 2 feet. (6) A gas main in WEST TENTH STREET, beginning at a point 11 feet south of the north line of said West 10th Street and 185 feet west of the west line of West Lynn Street; Thence in a westerly direction with the centerline of a gas main, which centerline shall be 11 feet south of and parallel to the north line of West 10th Street, for a distance of 60 feet. Said gas main described above shall have a cover of not less than 20 feet. (7) A gas main in UNIVERSITY AVENUE, beginning at a point 19 feet west of the east line of University Avenue and 95 feet south of the south line of West 31st Street; Thence in a southerly direction with the centerline of a gas main, which centerline shall be 19 feet west of and parallel to the east line of University Avenue, for a distance of 75 feet. Said gas main described above shall have a cover of not less than 20 feet. (8) A gas main in SOUTH FIFTH STREET, beginning at a point 25 feet west of and 15 feet south of the intersection of the east line of South 5th Street and the north line of West Johanna Street; Thence in a southerly direction with the centerline of a gas main, which centerline shall be 25 feet west of and parallel to the east line of said South 5th Street for a distance of 135 feet. Said gas main described above shall have a cover of not less than 2 feet. (9) A gas main in CHICON STREET from Canterbury Street to Willow Street, the centerline of which gas main shall be 11 feet west of and parallel to the east line of said Chicon Street. Said gas main described above shall have a cover of not less than 22 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground ut111ties, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is out in the vicinity of a firs plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. Councilman Alford offered the following resolution: WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the proposed construction of its conduit lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its conduit lines in the following streets: (1) An underground telephone conduit in DAVID STREET ALLEY from West 22nd Street 274 south approximately 100 feet, the centerline of which underground conduit shall be 2 feet west of and parallel to the east line of said David Street Alley. THAT the work and construction of said conduit lines, including the excavation of the streets and the restoration and maintenance of said streets after said conduit lines have been constructed, shall be under the supervision and direction of the City Manager and in accordance with the ordinances and regulations of the City of Austin governing such construction. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. Councilman Wolf moved that, upon the recommendation of Roy J. Smith, Sergeant of Police, Traffic Division, George Alfred Wappler be granted a Taxicab Driver's Permit. The motion carried by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. Norman Jackson requested that a storm sewer be built on Oldham Street to prevent the flooding of his premises at 2408 Sabine Street. The matter was referred to the City Manager. Councilman Wolf offered the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the authority and commission is hereby given to Guiton Morgan, City Manager of the City of Austin, Texas, to execute as City Manager on behalf of the City of Austin, all papers and documents that may be necessary and required by the Federal Emergency Administration of Public Works, in all projects of the City of Austin before such Administration, and particularly under P.W.A. Docket No. _, State Eng. Ref. No.1300-Техав. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. Mayor Miller moved that the City Attorney be instructed to write a letter to Capt. Tom Neal expressing the regret of the City Council at his resignation from the Traffic Division of the Police Department and congratulating him upon his promotion to the United States Department of Justice.
