322 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, December 06, 1935. The meeting was called to order by Mayor Tom Miller and on roll call the following answered present: Councilmen C. F. Alford, C. M. Bartholomew, Simon G1111s, Mayor Tom Miller, and Councilman Oswald G. Wolf, 5; absent, none. The reading of the Minutes was dispensed with. E. A. Murchison, President of the Board of Trustees of the Austin Independent School District, submitted the following: "Austin, Tехав, December 6,1935. Honorable Tom Miller, Mayor & the City Council Austin, Texas Gentlemen: We submit for your consideration the recommendation of A. W. Harris, of Giesecke & Harris, architects, herewith attached, in regard to the lowest acceptable bids presented at the bid letting on the school improvement construction under Texas Docket 1300 of the Public Works Administration, held at 10 A.M., December 5, 1935, at the Austin High School. This recommendation was presented by Mr. Harris to the School Board at a called meeting of the Board held at 7:30 P. M., on December 5, 1935, at the School Board offices, the entire membership of the Board being present, as follows: E. A. Murchison, President; R. G. Mueller, Vice-President; Mrs. Eleanor H. Wells, Secretary; Mrs. A. P. Robinson; L. H. Blenderman; J. Harris Gardner; Carl T. Widen. Mr. L. H. Blenderman, chairman of the Building and Grounds Committee, presented the following resolution: "Be it resolved that the recommendation of A. W. Harris, of Giesecke & Harris, architects, in regard to the lowest acceptable bids presented at the bid letting on the school improvement construction under Texas Docket 1300 of the Public Works Administration, held at 10 A. M., December 5, 1935, at the Austin High School, be approved, with the exception of that on the Govalle School, No. 1300-12 General for $13,394.00, on which the Board hereby rejects all bids offered." This resolution on motion of Mr. Blendermann, seconded by J. Harris Gardner, was unanimously adopted. Your attention is called to the fact that while the total of all low bids, $295,599.46, exceeds the estimated cost by 30%, or $12,366.96, with the omission of the bid on Govalle, amounting to $13,394.00, the total of all bids will be less than the estimated cost by $1027.04. The following report and resolution were read: "Austin, Texas November 26, 1935 Mr. Guiton Morgan City Manager Austin, Texas Dear Sir: We, the undersigned, have considered the application of Henry Viscardi for permission to construct, maintain and operate a drive-in gasoline filling station and to construct curbs, ramps and commercial driveways in conjunction therewith, which filling station is to be located on the west side of West Lynn Street and the south side of West 12th Street upon property known as a portion of Lot 15 of a subdivision of 252 acres out of the Geo. IV. Spear League within the City of Austin, Travis County, Texas, and we hereby advise that the following conditions exist: The property upon which this filling station is to be located is designated as "C" Commercial Use District as shown upon the zoning maps of the City of Austin. A storm sewer inlet exists on the south curb line of West 12th Street near the west line of West Lynn Street and a storm sewer inlet exists on the west curb line of West Lynn Street at or near the north line of the first alley south of West 12th Street. We recommend that Henry Viscardi be granted permission to construct, maintain and operate said drive-in gasoline filling station and to construct curbs, ramps and commercial driveways in conjunction therewith, subject to the following conditione: (1) That all buildings and equipment shall be placed inside of the property line, correct lines to be obtained before construction starts or equipment is installed. Lines and grades to be obtained from the City Engineering Department for entrances and driveways, building lines to be approved by the City Building Inspector. That the applicant shall confer with the City Engineering Department as to the future grades of the sidewalks and guttere on the adjacent streets before he starts any construction relative to the filling station. (2) That all construction of the filling station improvements shall be in accord with the building ordinance, the Zoning Ordinance, the Filling Station Ordinance, and in accord with the ordinance prohibiting the disроваї of commercial water or oile upon the City streets. (3) The grades of the station shall be such that no waste oils or water or any floor washings shall ever pass over the City sidewalk area and that all of said oils and water shall be concentrated into a combined grease and sand trap which shall be constructed in accordance with our standard plan 2-H-146, and shall be conducted by a pipe connection from said sand trap to the nearest storm sewer at the expense of the applicant. Before commencement of any construction, the applicant shall apply to the City Engineer for an estimate of the cost of that portion of the storm sewer or drain from the grease trap in case any of said drain or storm sewer is to be constructed within any street or alley and shall deposit in escrow with the City Finance Director a sum equal to said estimate. (4) That all filling station improvements, pumps, driveways, ramps, gutters, sidewalke and ourbe shall be constructed of concrete at the expense of the applicant as set forth upon the plan hereto attached, which plan bears the City Engineer's file number 2-0-67. (5) Expansion Joints shall be constructed as shown upon the plan hereto attached merked 2-G-67 and shall be of the pre-moulded type. (6) That before use of said station the owner shall apply to the Building Inspector for final inspection when he considers that he has complied with all the requirements of the City. Hamby Building Inspector " 327 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves as a filling station site the property situated on the west side of West Lynn Street and the south side of West 12th Street, which property is owned by Henry Viscardi and is known as a portion of Lot 15 of a subdivision of 252 acres out of the Geo. W. Spear League within the City of Austin, Travis County, Texas, and hereby authorizes the said Henry Viscardi to construct, maintain and operate a drive-in gasoline filling station and to construct curbs, rampe and commercial driveways in conjunction therewith, subject to the same's being constructed in com- pliance with all the ordinances relating thereto, and further subject to the foregoing attached recommendations and plans; and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of this filling station after full compliance with all the provisions of this resolution, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that the said Henry Viscardi has failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances. No one appearing to protest the above matter, Councilman Wolf moved that the above resolution be adopted. The motion was seconded by Councilman 01111s and carried by the following vote: Ayes, Councilmen Alford, Bartholomew, 1111s, Mayor Miller, and Councilman Wolf, 5; nays, none. Mayor Miller moved that at the written request of Mrs. T. H. McGregor, Member of the Library Commission, the resignation of the said Mrs. T. H. McGregor as a member of said body be accepted and the City Clerk be directed to convey to her the thanks of the City Council for past services. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. Councilman Wolf moved that upon the recommendation of Sergeant Roy J. Smith of the Traffic Division the following named persons be granted Taxicab Drivers' Permits: Frank L. Weir, 200 West 7th Street; Eugene Harry Carlson, 501 East 3rd Street; Sam Ferdinandtsen, 206 Waller Street; Alfred C. H111, 109 West 8th Street; Wesley Willard Look, 304 East 18th Street; James Leslie Marshall, 2216 Canterbury Street; Raymond A.Miller, 907 Willow Street; Vince Parsons, 34th and Exposition Boulevard; Melvin Timothy Powell, Route 2, Box 168; Lawrence T. Mayor Miller moved that action on the application of Shirley Anthony Puryear, 2109 Garden Street, be deferred until the next regular meeting. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gill.is, Mayor Miller, and Councilman Wolf, 5; nays, none. Councilman Wolf introduced the following ordinance: AN ORDINANCE REPEALING "AN ORDINANCE AUTHORIZING THE ISSUANCE OF BONDS OF THE CITY OF AUSTIN, TEXAS, TO THE AMOUNT OF THREE HUNDRED AND FIFTY THOUSAND DOLLARS, ($350,000.00), for THE PURPOSE OF THE CONSTRUCTION AND IMPROVEMENT OF PUBLIC FREE SCHOOL BUILDINGS IN THE CITY OF AUSTIN, AND THE PURCHASE OF GROUNDS AND EQUIPMENT THEREFOR, AND PROVIDING FOR THE PAYMENT OF SAID BONDS. " 328 The foregoing ordinance was read the first time and Councilman Wolf moved that the rule be suspended and the ordinance be passed to its second reading. The ordinance was read the second time and Councilman Wolf moved a further suspension of the rule and the placing of the ordinance on its third reading. The ordinance was read the third time and Councilman Wolf moved that same be finally passed. The ordinance was read the second time and Councilman G11118 moved that the rule be further suspended and the ordinance be passed to its third reading. The ordinance was read the third time and Councilman Gillis moved that same be finally passed, The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. Councilman Wolf moved that that provision of the Taxicab Ordinance requiring that applications remain on file five days prior to being acted upon be waived and license be granted to P. J. Reyes, 807 East 6th Street, to operate as a taxicab Fordor Ford Sedan, 1935 model, Engine No. 1379302, State Highway License No. 958-114. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; naye, none. Councilman Alford offered the following resolution: WHEREAS, the Southwestern Bell Telephone Company has presented to the City Counc11 tentative maps and plans showing the proposed construction of its pole lines in the streete in the City of Austin hereafter named, and said mape or plans have been considered by the City Engineer; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the name is hereby permitted to construct its pole lines in the following streets: (1) One telephone pole in BENELVA DRIVE at a location south of 32nd Street, the center of which pole shall be 3 feet east of the west line of Benelva Drive. That the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed, shall be under the supervision and direction of the City Manager and in accordance with the ordinances and regulations of the City of Austin governing such 329 construction. Councilman Gillis offered the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative mape or plans showing the proposed construction of its gas mains in the streets in the Oity of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in WEST MARY STREET, beginning at a point 20 feet south of the north line of West Mary Street and 115 feet east of the east line of Eva Street; Thence in an easterly direction with the centerline of a gas main, which centerline shall be 20 feet south of and parallel to the north line of said West Mary Street, for a distance of approximately one-half block to the west line of South Congress Avenue. Said gas main described above shall have a cover of not less than 2 feet. (2) A gas main in WEST MARY STREET, beginning at a point 20 feet west of the east line of Eva Street and 10 feet south of the north line of West Mary Street; Thence in a westerly direction with the centerline of a gas main, which centerline shall be 10 feet south of and parallel to the north line of West Mary Street, for a distance of approximately 3 blocks to a point 18 feet west of the east line of South Ist Street. Said gas main described above shall have a cover of not less than 2 feet. (3) A gas main in WEST MARY STREET, beginning at a point 10 feet south of the north line of West Mary Street and 18 feet west of the east line of South 3rd Street; Thence in an easterly direction with the centerline of a gas main, which centerline shall be 10 feet south of and parallel to the north line of West Mary Street, for a distance of approximately 2 blocks to a point 18 feet west of the east line of South Ist Street. Said gae main described above shall have a cover of not less than 2 feet. (4) A gas main in WEST MARY STREET, beginning at a point 20 feet north of the south line of West Mary Street and 15 feet east of the east line of South 4th Street. Thence in a westerly direction with the centerline of a gas main, which centerline shall be 20 feet north of and parallel to the south line of said West Mary Street, to a point that is 10 feet west of the west line of South 4th Street. Baid gas main described above shall have a cover of not less than 2 feet. (7) A gas main across WEST MARY STREET at South 2nd Street, the centerline of which gas main shall be 10 feet west of and parallel to the east line of South 2nd Street. Said gas main described above shall have a cover of not less than 2 feet. (8) A gas main across WEST MARY STREET at South 4th Street, the centerline of which gas main shall be 10 feet west of and parallel to the east line of South 4th Street. Said gas main described above shall have a cover of not less than 22 feet. (9) A gas main across WEST MARY STREET at South 5th Street, the centerline of which gas main shall be 10 feet west of and parallel to the east line of South 5th Street. Said gas main described above shall have a cover of not less than 22 feet. Said gas main described above shall have a cover of not less than 24 feet. (13) A gas main in WEST ANNIE STREET, beginning at a point on the west line of South Congress Avenue and 10 feet south of the north line of West Annie Street; Thence in a westerly direction with the centerline of a gas main, which centerline shall be 10 feet south of and parallel to the north line of said West Annie Street, for a distance of 160 feet. Said gas main described above shall have a cover of not less than 20 feet. (14) A gas main in KINNEY AVENUE from Barton Springs Road south to the City limits near the south line of Linscomb Avenue, the centerline of which gas main shall be 7 feet east of and parallel to the west line of said Kinney Avenue. Said gas main described above shall have a cover of not less than 20 feet. (15) A gas main in STERZING STREET from Barton Springs Road north a distance of approx imately 450 feet, the centerline of which gas main shall be 7 feet east of and parallel to the west line of said Sterzing Street. Said gas main described above shall have a cover of not less than 22 feet. (16) A gas main in BARTON BOULEVARD from Barton Springs Road to Sunset View, the centerline of which gas main shall be 7 feet west of and parallel to the east line of Barton Boulevard. Said gas main described above shall have a cover of not less than 2 feet. (17) A gas main in SUNSET VIEW from Barton Boulevard to Barton Boulevard Alley, the centerline of which gas main shall be 64 feet north of and parallel to the south line of said Sunset View. Said gas main described above shall have a cover of not less than 22 feet. (18) A gas main in BARTON BOULEVARD ALLEY from Sunset View to Linscomb Avenue, the centerline of which gas main shall be 3 feet west of and parallel to the east line of said Barton Boulevard Alley. Said gas main described above shall have a cover of not less than 20 feet. (19) A gas main in LINSCOMB AVENUE from Barton Boulevard Alley to Garner Avenue, the centerline of which gas main shall be 7 feet south of and parallel to the north line of said Linscomb Avenue. Said gas main described above shall have a cover of not less than 20 feet. (20) A gas main across LINSCOMB AVENUE at Garner Avenue intersection, beginning at a point 72 feet south of and 7 feet west of the intersection of the north line of Linscomb Avenue and the east line of Garner Avenue; Thence in a southerly direction with the centerline of a gas main, which centerline shall be 74 feet west of and parallel to the east line of Garner Avenue, for a distence of approximately 35 feet to the south City limits of the City of Austin. Said gas main described above shall have a cover of not less than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervale during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excevation in the streets 331 and the restoration and maintenance of said streets after anid moins have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Councilman Wolf offered the following resolution: WHEREAS, the curb and sidewalk specifications of the City of Austin which have been previously adopted by the City Council of the City of Austin require that all curbs and sidewalks be constructed of concrete unless a special permit has been secured from the City Council of the City of Austin to construct curbs and sidewalks of other materials; and WHEREAS, O. L. Tietz, owner of Lot 48, of Enfield F, a subdivision within the City limits of the City of Austin, Travis County, Texas, which property abuts the west side of Wethersfield Road and being situated north of Enfield Road, and being locally known as 1610 Wethersfield Road, has requested the City Council of the City of Austin to grant permission to construct a flagstone walk from the curb line to the property line on the west side of said Wethersfield Road at the above described location; and WHEREAS, the City Council of the City of Austin has investigated and approved the consteuction of said flagstone walk; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT O. L. Tietz, owner of Lot 48 of Enfield F, a subdivision within the City limits of the City of Austin, Travis County, Texas, which property abuts the west side of Wethersfield Road and being situated north of Enfield Road, and being locally known as 1610 Wethersfield Road, is hereby granted permission to construct a flagstone walk from the property line to the curb line on the west side of said Wethersfield Road at the above described location and said walk is to be constructed under the supervision and direction of the City Engineer of the City of Austin and in accordance with lines and grades furnished by the Engineering Department of the City of Austin, and further subject to the following conditions: That the stone shall be laid in a smooth and workmanlike manner and shall conform to the sidewalk grades as furnished by the Engineering Department of the City of Austin in order that said flagstone walk will not create a hazard to pedestrians. That the stone shall be placed upon a 4" concrete base and that all work within the City street area shall be done by a bonded sidewalk contractor. The Council, by rising vote, adopted the following resolution: BE IT RESOLVED, That the City Council learns with very deep regret of the sudden and untimely death on November 7, 1935, of the Reverend Harris Masterson, Jr., who was one of the most active and valued members of the Library Commission, having served as the Secretary of said Commission for several years; and BE IT FURTHER RESOLVED, That a copy of this resolution be spread upon the minutes of this Body and that a copy be sent to the Reverend Mr. Masterson'a family as a testimonial of our sincere appreciation of his usefulness, not only as a member of our Library Commission, but also as a beloved citizen and minister of this City.
