358 the State Highway Commission to recommend to the Secretary of Agriculture for approval., and upon approval, to construct with said funds allotted under the terms of said relief Act, the following described improvement project in the City of Austin, Texas, to-wit: Description of Project Grade separation on Enfield Road and I. G. N. RR., in City of Austin; Be it further resolved that the City Council of the City of Austin, Texas, for and in consideration of the construction of the above described improvement by the State Highway Department, hereby agrees and covenants to hold and save the State Highway Commission and the State Highway Department of Texas harmless from any and all damages or claims for damages to adjoining or abutting property by reason of, or in any manner growing out of, the construction and maintenance of such improvement project. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none; Upon motion duly made and seconded, the Council recessed subject to call of the Mayor. The meeting was called to order with Mayor Tom Miller presiding. Roll call showed the following members present: Councilman Simon Gillis, Mayor Tom Miller, and Councilman Oswald G. Wolf, 3; absent, Councilmen C. F. Alford and C. M. Bartholomew, 2. The Minutes of the special meeting of January 2 and the regular meeting of January 9 were read and upon motion of Councilman Gillis were adopted as read by the following vote: Ayes, Councilman Gillis, Mayor Miller, and Councilman Wolf, 3; nays, none; Councilmen Alford and Bartholomew absent, 2. Councilman Wolf moved that in accordance with the recommendation of Roy J. Smith, Captain of Police, Traffic Division, Eugene Arechiga, 814 East 7th Street, be granted a Taxicab Driver's Permit. The motion carried by the following vote: Ayes, Councilman Gillis, Mayor Miller, and Councilman Wolf, 3; nays, none; Councilmen Alford and Bartholomew, absent, 2. Councilman Wolf moved that the provision of the Taxicab Ordinance that applications remain on file five days prior to being acted upon be waived and license be granted to Jesus Guzman, 1005 East 6th Street, to operate as a taxicab a 1935 Ford Fordor Sedan, Motor No. 18-1905439, State Highway No. 968-211. The motion carried by the following vote: Ayes, Councilman Gillis, Mayor Miller, and Councilman Wolf, 3; naye, none; Councilmen Alford and Bartholomew absent, 2. Councilmen Gillis offered the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in BURNETT ROAD, beginning at a point 97 feet north of the north line of West 41st Street and 15 feet west of the east line of said Burnett Road; Thence in a southerly direction with the centerline of a cas main, which centerline shall be 15 feet west of and parallel to the east line of Burnett Rond to a point that 18 326 feet south of the south line of West 41st Street. Said gas main desoribed above shall have a cover of not less than 22 feet. (2) A gas main in LINSCOMB AVENUE, beginning at a point 7 feet west of the east line of Garner Avenue and 7f feet south of the north line of Linscomb Avenue; Thence in an easterly direction with the centerline of a gas main, which centerline shall be 7 feet south of and parallel to the north line of said LinBoomb Avenue, for a distance of 417 feet. Said gas main described above shall have a cover of not less than 22 feet. (3) A gas main in BOULDIN AVENUE, beginning at a point 18 feet east of the west 1ine of said Bouldin Avenue and 100 feet north of the north line of West Annie Street; Thence in a northerly direction with the centerline of a gas main, which centerline shall be 18 feet east of and parallel to the west line of said Bouldin Avenue, for a distance of 100 feet. Said gas main described above shall have a cover of not less than 2 feet. (4) A gas main in CHICON STREET from Garden Street to Canterbury Street, the centerline of which gas main shall be 11 feet west of and parallel to the east line of said Chicon Street. Said gas main described above shall have a cover of not less than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best recorde we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets ofter said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The resolution was adopted by the following vote: Ayes, Councilman Gillis, Mayor Miller, and Councilman Wolf, 33; nays, none; Councilmen Alford and Bartholomew abment, 2. Councilman Gillis offered the following resolution: WHEREAS, in Book 3, at page 144, of the Plat Records of Travis County, Texas, there appears a map or plat of a subdivision of land known as Enfield A and being within the City limits of the City of Austin; and WHEREAS, upon said map or plat of Enfield A there appears a street or road known as 359 360 Windsor Road; and WHEREAS, said Windsor Road has its origin at West 12th Street, and is a direct continuation of Blanco Street; and WHEREAS, much confusion is onused among postal deliveries and among delivery service in general by having two different names for the same street; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT that portion of Windsor Road beginning at West 12th Street and extending in a northerly direction a distance of approximately three blocks to Enfield Road as shown upon the map or plat of Enfield A appearing in Book 3, at page 44, of the Plat Records of Travis County, Texas, be known and designated hereafter as BLANCO STREET. The resolution was adopted by the following vote; Ayes, Councilman Gillis, Mayor Miller, and Councilman Wolf, 3; nays, none; Councilmen Alford and Bartholomew absent, 2. Mr. August Free came before the Council and asked that the fine imposed against George Warren on January 8, 1936, in the Corporation Court in Cause No. 41540 for drunkenness, amounting to $11.80, be remitted in view of the extenuating circumstances in the case. It was moved by Councilman Wolf that the fine assessed against the defendant in said Cause be remitted with the understanding that said defendant will deliver his next two pay checks to the said August Free, his bondsman, who, in turn, will deliver same to the family of the defendant. The motion carried by the following vote: Ayes, Councilman Gillis, Mayor Miller, and Councilman Wolf, 3; nays, none; Councilmen Alford and Bartholomew absent, 2. Mayor.
