REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, January 23, 1936. The meeting was called to order with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen C. F. Alford, C. M. Bartholomew, Simon G11118, Mayor Tom Miller, and Councilman Oswald G. Wolf, 5; absent, none. The Minutes of the last regular meeting were read and upon motion of Councilman Wolf, seconded by Councilman Gillis, the same were adopted as read by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. James, Jr. 2,691.50 Following a discussion of the various bids submitted, Mayor Miller offered the 361 362 following resolution: WHEREAS, the City Council heretofore caused to be advertised proposal for bids for the purchase of $350,000 City of Austin School Bonds, Series 1936, dated January 1, 1936, said bids to be received until, and opened at, 10 o'clock A. M., January 23, 1936; and WHEREAS, at said time and hour, all such bids received were opened before the City Council in regular session, and thereupon it was found that the bid of Blyth & Co., Inc., and Miller, Moore & Brown, Inc., a syndicate, was the highest and best bid submitted for the purchase of said bonde, said bid being as follows: "Honorable Mayor and City Council Austin, Teхав. Gentlemen: For Three Hundred Fifty Thousand Dollars ($350,000.00) legally issued, City of Austin School Bonds Series 1936, dated January 1, 1936, of the denomination of One Thousand Dollars ($1,000.00) each, interest payable semi-annually, on the first day of January and July, the first interest coupon becoming due July 1, 1936, and maturing serially in accordance with the schedule attached hereto, we will pay the following price: For bonde bearing an interest rate of three per centum (3%) per annum, par and aocrued interest from date of Bonds to date of delivery at Austin, Texas, plus a cash premium of $3610.00. We agree to purchase the Bonds upon the approving opinion of Thomson, Wood and Hoffman, New York, the cost of such opinion to be borne by the City of Austin, together with the cost of printing the Bonds. We agree that delivery of Bonds will be made to us at Austin, Texas. As evidence of our good faith, we are attaching hereto cashier's or certified check in the sum of Seventeen Thousand Five Hundred Dollars ($17,500.00), said check to be held uncashed pending the delivery of the Bonds to us in accordance with this bid. Should we fail to comply with the terms of this bid within fifteen days from date of delivery of approving opinion to us by Messrs. Thomson, Wood and Hoffman, the above mentioned check may be cashed and proceeds used as full and complete liquidated damages by the City of Austin. January 23, 1936. BLYTH & CO., INC. Upon motion of Councilman Wolf, seconded by Councilman Alford, the resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; naye, none. Mayor Miller then moved that the checks of the unsuccessful bidders be returned to them and the thanks of the City Council be extended to them for the attractive offers submitted, with an invitation to participate in the next bond sale. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; naye, none. , Bryan Blaylock, Attorney for Jesse Thompson, colored, came before the Council and asked that in view of the circumstances in the case, Four Dollars ($4.00) of the fine imposed against his client in the Corporation Court for negligent collision be refunded. Councilman Gillis moved, seconded by Councilman Bartholomew, that the matter be referred to the Legal Department. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, G11118, Mayor Miller, and Councilman Wolf, 5; nays, none. It was moved by Councilman Gillis, seconded by Councilman Alford, that, upon the recommendation of Roy J. Smith, Captain of Police, Traffic Division, the following named persons be granted Taxicab Driver's Permits: Howard L. Caffey, 42 East Avenue; Willie Evalt Neie, 1013 West 10th Street; Sidney Buford Hawkins, 105 Neches Street; and Waymon Joel Taylor, 4519 Avenue B. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. Councilman Wolf offered the following resolution: WHEREAS, the Texas Relief Commission has available certain inventories of equipment and other expendable materials and supplies which, under certain conditions, are available to local governmental subdivisions desiring to sponsor sewing room projects, or canning projects, under the WPA program; and WHEREAS, CITY OF AUSTIN, TEXAS, proposes to sponsor a Sewing Room project; THEREFORE, BE IT RESOLVED: That in consideration of the transfer of such expendable items, and the loan of such equipment and tools, the City of Austin, Texas, hereby author1zes. and agrees to the following stipulations: 1. A11 non-expendable tools and equipment owned by the Texas Relief Commission, and located in the Texas Relief Commission Sewing Room plant at Austin, Texas, are to be borrowed from the Texas Relief Commission upon execution of the receipt in the following form: "The following listed property is loaned to CITY of AUSTIN, TEXAS, which property is owned by the Texas Relief Commission, and the State of Texas. The title to this property shall at all times remain in the name of the Texas Relief Commission, Austin, Texas, and the State of Texas, and is loaned to the CITY OF AUSTIN, TEXAS, for their use only. When said CITY of AUSTIN, TEXAS, shall have no further need for said property, or at any time upon written request by the Texas Relief Commission, or the State of Texas, this property shall be returned to the Texas Relief Commission, Austin, Texas, and the State of Texas, in as good condition as when received, with the exception of general wear." and the City Manager of CITY of AUSTIN, TEXAS, is hereby authorized to execute such receipt on behalf of CITY of AUSTIN, TEXAS. 2. All expendable materials and supplies on hand in the plant at Austin, Texas, and 364 owned by the Texas Relief Commission, and which are to be used in the fabrication of the finished product, are to be transferred to the CITY of AUSTIN, TEXAS, as the sponsor of the WPA project, this transfer to be on the basis of a physical inventory count made Jointly by the representatives of the Texas Relief Commission and the Texas WPA. 3. All products produced in the operation of the project, and which accrue to the sponsor, will be delivered to the distribution organization of the Texas Relief Commission. 3-a. Products produced principally from materials and supplies transferred from the Texas Relief Commission, first, will be distributed by the Texas Relief Commission to families or individuals eligible for relief under regulations of the Texas Relief Commission, and residing within the legal boundaries of the sponsoring governmental subdivision; and, second, any surplus will be available for transfer to other points of distribution on direction of the Texas Relief Commission. 3-b. Products produced principally from materials furnished by the sponsor or WPA will be distributed according to the Texas Relief Commission regulations to families, individuale, or public institutions within the legal boundaries of the sponsoring governmental subdivision, and will not be available for transfer out of these boundaries. 4. The WPA of Texas is herewith authorized to deliver to accredited representatives of the Texas Relief Commission all finished products derived from the operation of this plant and accruing to the sponsor, such products to be distributed as set forth above. 5. Excepting for the loan of the tools and equipment and the transfer of materials and supplies herein provided, the sponsor agrees to hold the Texas Relief Commission free and harmless from all liability and responsibility for rent, light, water, fuel, building repairs and appliances and services incident to these items. 6. Upon termination of the project, sponsor agrees to return to the Texas Relief Commission in good condition all unused expendable materials and supplies previously secured from the Texas Relief Commission.
