140 Fund not otherwise appropriated for the purpose of paying said judgment and paving lien on Lot No. Three (3), Block Two (2), of Moore's Subdivision of Outlot No. Ten (10), Division "D", of the City of Austin, Travis County, Texas, and that warrante issue therefor as follows: $228.48 to L. E. Whitham & Co., and $68.97 to Fain-Townsend Co. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; naye, none. Councilman Alford moved that the following named persons be granted taxicab driver's permits, in accordance with the recommendation of Roy J. Smith, Captain of Police, Traffic Divisiont Wesley Collier, 907 West Annie Street; and Eugene Pool, 506 Nueces Street. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, G1111s, Mayor Miller, and Councilman Wolf, 5; nays, none. The matter of temporary taxicab permite came up for discussion and the City Manager was instructed to allow all taxicab operators to operate until January 1, 1937, the City Council to determine then the number of taxicabs to be allowed. SPECIAL MEETING OF THE CITY COUNCIL: Austin, Texas, December 23, 1936. The meeting was called to order at 7:45 P. M. by Mayor Tom Miller, with the following members present: Councilmen Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 4; absent, Councilman Alford, 1. The following appeals from the action of the Board of Equalization in placing valuations upon taxable property for the year 1936 were heard: Charles Naschke, 2001 Dam Boulevard, protested the valuation of $525 placed on his improvements, stating that $250 represented the cost of such improvements and that he was receiving no rental from same. The matter was referred to Councilman Gillis and the Board of Equalization for a reinspection of the premises. Victor Cluck protested the valuation placed on the improvements on Lot 26, 141 Outlot 7, Division "C", completed on January 1. reconsideration with Mr. of said Board. Country Club Lawns, on the grounds that same was not 66-2/3% The matter was referred to the Board of Equalization for Cluck, the latter agreeing to abide by the final decision Mrs. F. T. Erwin, 1111 Willow Street, protested the valuation placed on a garage apartment on Lot 13, Block 3, Outlot 31-32, Division "O", M. K. & T. Subdivision. The matter was referred to the Board of Equalization for reconsideration. Mrs. Mary Fagg, 1708 Enfield Road, protested the valuation placed on the improvements on the east part of Lot 73 (B) and Lot 74, Enfield "C", Division "Z", declaring that the entire valuation should not exceed $16,000. The matter was referred to Councilman Gillis for reinspection in company with the Board of Equalization to determine whether said improvements are equalized with similar property. William A. Harrison protested the valuation placed on the improvements on Lot & and the north one-half of Lot 7, Block 15, Rosedale "D", including the garage, on the grounds that $1950 would be two-thirds of the actual cost. The matter was referred to Councilman Gillis and the Board of Equalization for a reinspection of the house to determine whether same is equalized with like property. J. W. McCaslin, 2201 Haskell Street, protested the valuation of the improvements on Lot 16, Block B, Division "O", declaring that $700, instead of $950, should have been the valuation. The matter was referred to Councilman G1111s and the Board of Equalization for a reinspection of the premises. The protest of Earl E. Simms against the assessment on the improvements on Lot 7, Block 65, Original City, Plat 9, was referred to Councilman Gillis and the Board of Equalization for an investigation. Marvin L. Smith, 3408 Wabash Avenue, protested the valuation placed on the improvements on Lots 1 and 2, Block 3, Penn Park Subdivision, as being too high, but stated that if same were equalized with like property, he would accept the valuation. S. Winetraub, 1600 Canterbury Street, protested the assessment placed on his improvements at this location on the grounds that same was $600 or $700 in excess of the cost. The matter was referred to Councilmen Gillis and Wolf for an investigation, in company with the Board of Equalization. Mrs. Ruth Petty, 1908 University Avenue, protested the assessment on the improvements on Lot 35, Block B-C, Outlot 20, Division "D", on the grounds that the valuation represented the actual cost of the property. Upon being shown that the correct unit price had been placed upon said improvements, the protest was withdrawn. Max Silberstein, 7 Palma Plaza, protested the assessment placed on the improvements on Lot G, Block 6, Division "E", on the grounds that same was in the flooded section on Rainey Street. The matter was referred to Councilman Gillis and the Board of Equalization for an investigation. M. Irving Smith, 2019 Sabine Street, protested the assessment on improvements on Lot 5, Block 19, Division "C", Christian & Fellman Addition, Plat 44. The matter was referred to Councilman Gillis and the Board of Equalization for investigation. The protest of Mrs. Gertrude Roberson, a non-resident, residing at 1431 Tenth Avenue, San Francisco, California, against the assessment placed on the improvements on Lot 16, Block G, Outlots 8, 9, and 62, Division "B", College Heights, Plat 28, was referred to Councilman Gillis and the Board of Equalization for investigation. 142 The protest of William Kutalek, 61 East Avenue, against the assessment on the improvements on Lot 10, Block 2, Outlot 43, Division "O", Spence Addition, Plat 21, was submitted. Mr. Kutalek appeared to protest alleged damages to his property by reason of work done by the Engineering Department. The Council deferred consideration of the matter. The ordinance was read the first time and Councilman Wolf moved that the same be passed to its second reading.
