142 The protest of William Kutalek, 61 East Avenue, against the assessment on the improvements on Lot 10, Block 2, Outlot 43, Division "O", Spence Addition, Plat 21, was submitted. Mr. Kutalek appeared to protest alleged damages to his property by reason of work done by the Engineering Department. The Council deferred consideration of the matter. Councilman Alford offered the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of $1,990.00 be and the same is hereby appropriated out of the General Fund, not otherwise appropriated, for the purpose of making improvements and alterations at the municipal abattoir. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. Mayor Miller moved that the City Manager be instructed to write a letter of thanks to Mr. Julian Montgomery, State Director, Federal Emergency Administration of Public Works, for the additional grant allotted to Docket No. 1758-Sewers, and for the splendid cooperation and assistance given the City of Austin in the construction of its various projects, without which it would have been impossible for the City of Austin to have financed the same. The motion carried by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1. Councilman Wolf offered the following resolution: WHEREAS, there appears to be City taxes levied against Lots 1 and 2, Block "N", J. E. Bouldin Addition, Plat 115, and Lot 15, Block "H", J. E. Bouldin Addition, Plat 116, in the City of Austin, Texas, for the years 1919 to 1935, inclusive; and WHEREAS, said property has been assessed during the aforesaid time against James E. Bouldin; and WHEREAS, under decrees of foreclosure in the District Court of Travis County, Texas, in Cause No. 20933, said land was conveyed to the City of Austin by G. S. Matthews, Sheriff of Travis County, Texas, who conveyed said land to the City of Austin by unknown owner, which deeds have never been recorded, and by reason of their execution, the right of the City to tax said land for any period since the execution of said deeds is doubtful; and WHEREAS, it is considered that, in view of the above facts, the penalties and one-half of the interest on said taxes should be remitted; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT all penalties and one-half of the interest on the taxes for the years 1919 to 1935, inclusive, on Lots 1 and 2, Block N, J. E. Bouldin Addition, Plat 115, and Lot 15, Block H, J. E. Bouldin Addition, Plat 116, in the City of Austin, assessed in the name of James E. Bouldin, be and the same are hereby remitted; provided that said taxes and the one-half interest thereon be paid in full on or before the 4th day of January, 1937; otherwise, said taxes, penalty and interest shall remain as shown on the recorde of the Tax Collector. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf, 4; nays, none; Councilman Bartholomew absent, 1.
