REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, February 11, 1937. The meeting was called to order at 11:00 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen C. F. Alford, C. M. Bartholomew, Simon Gillis, Mayor Tom Miller, 4; absent, Councilman Oswald G. Wolf, 1. The Minutes of the regular meeting of February 4 were read and upon motion of Councilman Alford were adopted as read by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, 4; naye, none; Councilman Wolf absent, 1. A committee of Boy Scouts, composed of Joe MoSpadden, Bill Studer, Harold Brelsford, Randolph Alford, and DeLong Anderson, extended greetings to the City Council on the occasion of the Twenty-seventh Anniversary of the Boy Scouts of America. Councilman Alford moved that the following named persons be granted taxicab driver'a permite, in accordance with the recommendation of Roy J. Smith, Captain of Police, Traffic Division: Shelton E. Ayres, 1200 South Ist Street; Walter LaRue Harwell, 2200 Nueces Street; Floyd B. Morse, 412 West Mary Street. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, G1111s, and Mayor Miller, 4; nays, none; Councilman Wolf absent, 1. Councilman Gillis offered the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Compahy be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in GARDEN STREET from Mildred Street east 80 feet, the centerline of which gas main shall be 19 feet south of and parallel to the north line of said Garden Street. Said gas main described above shall have a cover of not less than 2 feet. (2) A gas main in THE CIRCLE across the the centerline of which gas main shall be 7 to the west line of The Circle. south side of Academy Drive, feet east of and parallel Baid gas main described above shall have a cover of not less than 2 feet. (3) A gas main in MELISSA LANE across the north side of Academy Drive, the centerline of which gas main shall be 7t feet east of and parallel to the west line of said Melissa Lane. Said gas main described above shall have a cover of not less than 20 feet. (4) A gas main in HILLSIDE DRIVE across the north side of Academy Drive, the centerline of which gas main shall be 20 feet west of and parallel to the east line of said Hillside Drive. Said gas main described above shall have a cover of not less than 2 feet. (5) A gas main in JESSIE STREET from Barton Springs Road north 270 feet, the centerline of which gas main shall be 7 feet west of and parallel to the east line of said Jessie Street. Said gas main described above shall have a cover of not less than 20 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the 233 234 minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas maine, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Miller, 4; naye, none; Councilman Wolf absent, 1. Councilman Alford offered the following resolution: WHEREAS, taxes have been assessed in the name of K. Cox, on Lot 8, Block 1, Outlot 60, Division "0", Plat 17, in the City of Austin, Travis County, Texas, and also certain personal property, for the years 1932, 1933, 1934, and 1935, in the aggregate amount of $53.17; and WHEREAS, on said taxes becoming delinquent, penalties and interest thereon have accrued in the sum of $7.40; and WHEREAS, during the flood in the Colorado River in June, 1935, said property was seriously damaged, entailing considerable financial loss on said K. Cox; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the penalty and interest on the aforesaid property for the aforesaid years in the sum of $7.45 should be and is hereby remitted, and the Tax Assessor and Collector is hereby authorized and directed to charge said penalty and interest off of his tax rolls and to accept the taxes due on said property for said years in full of said assessment. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, 4; nays, none; Councilman Wolf absent, 1.
