It was moved by Mayor Miller that, in observance of Good Friday, March 26, all city activities, including all street and other outside work except such indispensable activities as the police, fire, and emergency work of the water and light division, stop at noon and be suspended for the entire afternoon of that day in deference to the religious beliefs of the city employees. The motion was unanimously adopted by a rising vote of the Counc11. Mayor Miller offered the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of $1550 be and the same is hereby appropriated out of the General Fund, not otherwise appropriated, for the purpose of paying the City's part of the cost of widening West Eighth Street from Congress Avenue to Lavaca Street. The Mayor declared the public hearing open, in accordance with published notice thereof, on the proposal of the City Council to amend the Zoning Ordinance of the City of Austin in the following particulars: To amend the "Use" designation of the lots comprising the east one-half of Block 68, Division "E", fronting on East Avenue between East 15th Street and East 16th Street, so as to change same from "B" Residence District to "C" Commercial District, said lots being described on the map of the City Tax Assessor and Collector as Lots 6, 7, 8, 9, 10, and 11, Block 68, Division "E". Mrs. J. W. Vaughan, property owner at 1602 East Avenue, appeared to protest the proposed change unless it were stipulated that all business buildings in this ares would be of brick construction and no cheap, undesirable business establishments allowed. Mrs. W. E. Williamson, owner of Lot 7 and proponent of the proposed change, 263 stated that the change мав песоввary in order to sell her property for commercial purposes, which called for the erection of a brick building thereon. It was moved by Councilman Gillis that the proposed change in zoning of the property included in today's hearing apply to Lot 7 only, and that no change be made in the zoning of the remaining lots, pending requests from the owners of said property. Ben Gregg appeared before the Council and asked that in lieu of his former request for contribution to the National Guard Units, the City contribute the sum of $1.000 for the building of lockers. The matter was referred to the City Manager to have the City Attorney pass upon the legality of same. Councilman Alford moved that the following named persons be granted taxicab driver's permits, in accordance with the recommendation of Roy J. Smith, Captain of Police, Traffic Division: Curtis Ray LaRue, 1006 San Antonio Street; Oliver Doyle Sheffield, 209 East 13th Street: The motion carried by the following vote: Ayen, Councilmen Alford, Bartholomew, 01111s, and Mayor Miller, 4; nays, none; Councilman Wolf absent, 1. By general consent, the resolution certifying to the adequacy of Austin's water supply which the Public Works Administration/requested be adopted, was laid on the table, pending a statement from the Public Works Administration as to the purpose of the resolution. Mayor Miller brought before the Council the question of a pension setup for city employees, to include all departments of the city government, but if this is found to be impracticable at the present time, to include at least the police and fire departments. After some discussion, Councilman Gillis moved that the matter be referred to the City Manager to work out a plan for a pension or retirement setup, as suggested by Mayor Miller, and submit his report to the Council in the near future. Councilman Gillis introduced the following ordinance: AN ORDINANCE APPOINTING ELECTION JUDGES AND CLERKS TO SERVE AT THE VARIOUS POLL- ING PLACES IN THE VARIOUS ELECTIONS TO BE HELD IN THE CITY OF AUSTIN DURING THE TERM OF TWO YEARS. The ordinance was read the first time and Councilman Gillis moved that the rule be suspended and the ordinance be passed to its second rending. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Miller, 4; nays, none; Councilman Wolf absent, 1. The ordinance was read the second time and Councilman Gillis moved that the rule be further suspended and the ordinance be passed to its third reading. Councilman Alford offered the following resolution: WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council 264 tentative maps and plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be, and the same is hereby permitted to construct its pole lines in the following streets: (1) A telephone pole line and an underground cable line in NUECES STREET from Weet 28th Street to Guadalupe Street, the centerline of which pole line and underground cable line shall be 14 feet west of and parallel to the east line of said Nueces Street. THAT the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed, shall be under the supervision and direction of the City Manager and in accordance with the ordinances and regulations of the City of Austin governing such construction. Councilman Gillis offered the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plane showing the proposed construction of its gas mains in the streete in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in NILES ROAD from Wethersfield Road east 64 feet, the centerline of which gas main shall be 12 feet south of and parallel to the north line of said Niles Road. feet. Said gas main described above shall have a cover of not less than 22 (2) A gas main in RIVERVIEW STREET westerly 162 feet from a point 228 feet east of the east line of Chalmers Avenue, the centerline of which gas main shall be 70 feet north of and parallel to the south line of said Riverview Street. Said gas main described above shall have a cover of not less than 20 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. 265 : The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Miller, 4; nays, none; Councilman Wolf absent, 1. Councilman Alford offered the following resolution: WHEREAS, taxes for the years 1935 and 1936 on the hereinafter described property are shown by the assessment rolls of the City of Austin, Travis County, Texas, to have been аввеввed against G. F. Zimmerman; and WHEREAS, said property was owned by the City of Austin for street purposes during. said years 1935 and 1936, and the assessment of taxes thereon against G. F. Zimmerman was erroneous; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the taxes erroneously assessed on Lot 10, Block 6, Edgemont Addition to the City of Austin, Travis County, Texas, assessed against G. F. Zimmerman, be and the same are hereby cancelled, and Tax Collector of the City of Austin is authorized and directed to strike same from the tax rolls.
