316 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, May 13, 1937. The meeting was called to order at 10:30 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen C. F. Alford, 0. M. Bartholomew, Simon Gillis, Mayor Tom Miller, 4; absent, Councilman Oswald G. Wolf, 1. The minutes of the regular meetings of April 22, April 29, and May 6 were read, and upon motion of Councilman Bartholomew, seconded by Councilman Alford, the same were adopted as read by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Miller, 4; nays, none; Councilman Wolf absent, 1. The following resolution of the House of Representatives was received and ordered spread on the Minutes: RESOLUTION. H. S. R. No. 255 WHEREAS, On Thursday evening, May 6, 1937, the members of the House of Representatives, their wives and friends, were the guests of the citizens of Austin at a barbecue dinner, an entertainment, and a dance at Barton Springs; and WHEREAS, This display of hospitality was thoroughly enjoyed by the members of the House of Representatives and wives and friends; and WHEREAS, The association at this entertainment resulted in a closer feeling of friendship and understanding between the members of the Legislature and citizens of Austin; now, therefore, be it RESOLVED by the House of Representatives, That it take this means of expressing its thanks and heartfelt appreciation for the hospitality extended by the citizens of Austin; and be it further RESOLVED, That the Chief Clerk of the House be instructed to send to the Mayor of Austin a copy of this Resolution. It was moved by Councilman Alford that the following named persons be granted taxicab driver's permits, in accordance with the recommendation of Roy J. Smith, Captain of Police, Traffic Division: Clarence Malcolm Glendening, 308 East 11th Street; and William H. Ball, 1013 West 33rd Street. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, G1111s, and Mayor Miller, 4; nays, none; Councilman. Wolf absent, 1. It was moved by Councilman Alford that the taxicab driver's permit issued to Ira P. Sylvester, 96 Red River Street, be revoked, in accordance with the recommendation of Roy J. Smith, Captain of Police, Traffic Division. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Miller, 4; naye, none; Councilman Wolf absent, 1. Counoilman Gillis offered the following resolution: WHEREAS, Texas Public Service Company has presented to the City Couno11 tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in NILES ROAD from Newfield Lane easterly 56 feet, the centerline of which gas main shall be 7 feet south of and parallel to the north 11ne of said Niles Road. Said gas main described above shall have a cover of not less than 2 feet. (2). A gas main in NEWFIELD LANE from Niles Road northerly 65 feet, the centerline of which gas main shall be 7 feet west of and parallel to the east line of said Newfield Lane. Said gas main described above shall have a cover of not less than 20 feet. (3) A gas main in NEWFIELD LANE from Enfield Road northerly 257 feet, 318 the centerline of which gas main shall be 7½ feet west of and parallel to the east line of said Newfield Lane. Said gas main described above shall have a covering of not less than 20 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, 4; nays, none; Councilman Wolf absent, 1. Mayor Miller offered the following resolution: WHEREAS, the City Council of the City of Austin deems it advisable to acquire for the purpose of opening for public use as an alley that certain property lying east of and intersecting with Wilson Street, and being immediately south of Block B-6 of the R. L. Sweetman Addition of the City of Austin, said property being a portion of the Swisher Addition out of the Isaac Decker League within the City of Austin, Travis County, Texas, and also being a portion of that certain 6-acre tract or parcel of land conveyed to Simon G11118 by Mary R. James, by deed dated November 21, 1903, and recorded in Volume 183 at page 514 of the Deed Records of Travis County, Texas; and WHEREAS, title to the property required for such alley is now in Simon Gillis, of Austin, Travis County, Texas; and WHEREAS, the City Council deems it advisable to close and to vacate and abandon the use of all the alley lying between Blocks B-6 and B-7 of the R. L. Sweetman Addition and a portion of the alley lying south of said Block B-7 of the R. L. Sweetman homestead, a subdivision of a portion of the Isaac Decker League within the City of Austin, Travis County, Texas, according to a map or plat of said Sweetman Homestead appearing in Book 1 at page 52 of the Plat Records of Travis County, Texas, with the reservation, however, of an easement for all city utilities, said alley to become a part of Lot 1 of said Block B-6; and WHEREAS, the title to such alley is in the City of Austin; and WHEREAS, the City Council deems it advantageous to the City of Austin to execute an exchange of said properties with said Simon Gillis; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorized and instructed to convey in the name of the City of Austin by proper deed to Simon Gillis for and in consideration of the conveyance to the City of Austin by the said Simon Gillis of certain property hereinafter described, the title of which is now in the said Simon Gillis, the following described land situated in the City of Austin, Texas, with the reservation of an easement for all city utilities, said conveyed land to become a part of Lot 1, Block B-6, of the R. L. Sweetman Homestead, and being 0.096 of an acre of land, and more particularly described as follows: Beginning at the northwest corner of Lot 15, Block B-7, of said Sweetman Homestead, which point of beginning is on the south line of West Johanna Street and is 30 feet distant from the centerline of said West Johanna Street as evidenced by concrete monuments; Thence S. 19° W. 124.68 feet to an iron stake set by the City Engineer of the City of Austin in 1914 for the southwest corner of said Lot 15; Thence following the south lines of Lots 15, 14 and 13, said Block B-7, of Sweetman Homestead, s. 60912 E. 151.31 feet to an iron stake for the southeast corner of said Lot 13; Thence N. 67°01' W. 168.98 feet to an iron stake at the southeast corner of Lot 1, Block B-6 of said Sweetman Homestead; Thence with the east line of said Lot 1, N. 19°00' Ε. 141.50 feet to the northeast corner of said Lot 1, which corner is on the south line of Weat Johanna Street and 30 feet distant from the centerline of said Johanna Street as evidenced by concrete monuments; Thence following the south line of said West Johanna Street, s. 71°00 E. 20 feet to the place of beginning, containing 0.096 (96/1000) of one acre of land. BE IT FURTHER RESOLVED: THAT the City Manager be and he is hereby authorized and directed to accept in exchange for said tract hereinabove described for alley or street purposes, in the name of the City of Austin, from Simon Gillis, for and in consideration of the conveyance by the City of Austin to the said Simon Gillis of the tract of land herein- above described, the title to which is now in the said City of Austin, that certain tract of land consisting of .0.107 of one (1) acre of land, said tract so to be accepted by and conveyed to the City of Austin by the said Simon Gillis for use as an alley, and particularly described as follows: Beginning at an iron stake which marks the southeast corner of Lot 1, Block B-6 of the R. L. Sweetman Homestead, a subdivision of a portion of the Isaac Decker League within the City of Austin, Travis County, Texas, according to a map or plat of said R. L. Sweetman Homestead appearing in Book 1 at page 52 of the Plat Records of Travis County, Texas, and which point of beginning 18 also in the north line of the aforesaid Mary R. James to Simon G1111s tract; Thence following the south lines of Lots 1, 2, 3 and 4, Block B-6, of said Sweetman Homestead, N. 59°56' W. 173.57 feet to an iron stake in the east 1ine of Wilson Street as established upon the ground; Thence following said east line of Wilson Street S. 28°43' W. 17.26 feet to an iron stake; Thence following a line that is 172 feet distant from and parallel to the south lines of Lots 4, 3, 2 and 1, said Block B-6 of Sweetman's Homestead, 8. 59°58' Ε. 173.79 feet to an iron stake;. Thence S. 67°01′ E. 169.46 feet to an iron stake in the south line of the alley south of Block B-7 of the aforesaid R. L. Sweetman Homestead, which south line of said alley is a limitation line agreed to by the City of Austin, and by the owners of property abutting said alley; Thence following said limitation line, same being 172 feet distant from and parallel to the south line of said Block B-7, of Sweetman Homestead, N. 60°12' W. 145.41 feet to an iron stake; Thence N. 67001 W. 23.57 feet to the point of beginning, containing 0.107 (107/1000) of one acre of land. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, and Mayor Miller, 3; nays, none; Councilman Gillis present but 319 320 not voting; Councilman Wolf absent, 1. Mayor Miller offered the following resolution: WHEREAS, the City Council of the City of Austin deems it advisable to extend West Live Oak Street eastward across East Bouldin Creek to intersect Hodges Street; and WHEREAS, the Oity Council deems it advisable to extend Hodges Street north and south from West Live Oak Street to Crockett Street; and WHEREAS, title to the property required for such extensions is now in Simon Gillis of Austin, Travis County, Texas; and WHEREAS, the said Simon Gillis has indicated a desire to convey said property to the City of Austin by deed of gift for the purpose of extending West Live Oak Street and Hodges Street; therefore,. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: : THAT the City Manager be and he is hereby authorized and, instructed to accept on behalf of the City of Austin a deed to the following described land situated in the City of Austin, Travis County, Texas, being 0.380 acres of land out of Lote 6, 12 and 13, of the Simon Gillis Division of Block 3, of Doughty's Subdivision of a portion of the Isaac Decker League within the City of Austin, Travis County, Texas, according to a map or plat of said Simon Gillis Division appearing of record in Book 3 at page 117 of the Plat Records of Travis County, Texas, and being more particularly described as follows: Beginning at an iron stake set on the south line of Crookett Street, which iron stake is also on the north line of Lot 12 of the aforesaid Simon Gillis Division, and from which point of beginning another iron stake at the northwest corner of said Lot 12 bears N. 60°14 พ. 8.00 fect; Thence following a line 52 feet westerly from and parallel to the east linea of Lots 12 and 6, S. 28°41 W. 230.00 feet to an iron stake in the south line of Lot 6, which iron stake is also in the north line of West Live Oak Street; Thence following the south line of said Lot 6, N. 60°14' W. 87.00 feet to a point in the center of East Bouldin Creek; Thence down said East Bouldin Creek and following the centerline of same N. 22945 E. 55.27 feet to a point; Thence continuing down stream with the centerline of said East Bouldin Creek N. 22°29' E. 59.24 feet to a stake; Thence leaving said creek 8. 69°14 E. 49.60 feet to an iron stake; Thence N. 28041 E. 108.69 feet to an iron stake in the north line of Lot 13 of Simon G1111s Division, which iron stake is also in the south line of Crockett Street; Thence following the south line of Crockett Street S. 60°14′ E. 50 feet to the point of beginning. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Mayor Miller, 3; naye, none; Councilman G1111s present but not voting; Councilman Wolf absent. The following resolution was adopted by a vote af 4 ayes; nays, none; Councilman Wolf absent, 18 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorized and directed to purchase in the name of the City of Austin from Sophie Shipman, a feme sole, for the consideration of $800.00 in cash, upon the condition that good title be shown to said land upon examination by the City Attorney, for park development purposes, and upon delivery to the City of the owner's general warranty deed to the following described land, towit: In the City of Austin, Travis County, Texas, and being sixty (60) feet off of the south side of Blook "J", in Fairview Park Addition to the City of Austin, Travis County, Texas, according to the map of said Addition by J. F. Pope, said 60 feet being more particularly described by metes and bounds as follows: Beginning at forty (40) feet south of the southwest corner of Block "K"; thence south sixty (60) feet; thence east to the east line of Block "J"; thence north to the southeast corner of the forty (40) reet sold off of the north side of said land to Lula C. Jackson; thence west to the place of beginning; and being the same property sold to E. R. Shipman by R. H. Pate and wife, by deed of date January 12, 1928, recorded in Volume 473, pages 105-106 of the Deed Records of Travis County, Texав. BE IT FURTHER RESOLVED: THAT the sum of $800.00 be and the same is hereby appropriated out of the Parks and Playgrounds Bond Fund for the purpose above mentioned, and that a warrant in said amount issue therefor payable to Sophie Shipman to be delivered to said Sophie Shipman after approval of title to said land by the City Attorney and delivery by said parties of their general warranty deed to said land. Upon motion, duly seconded and carried, the meeting was recessed at 11:00 A.Μ., subject to call of the Mayor.
