REGULAR MEETING OF THE CITY COUNCIL: Approved: low milla. Austin, Texas, September 9, 1937. The meeting was called to order at 10:30 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen C. F. Alford, Simon G11118, Mayor Tom Miller, 3; absent, Councilmen C. M. Bartholomew and Oswald G. Wolf, 2. The reading of the Minutes was dispensed with. Mrs. J. D. Claybrook appeared before the Council relative to a change in the zoning of property owned by her on Park Place from "A" Residence District to "B" Residence District, and she was advised to submit the matter to the Board of Adjustment. Councilman Alford moved that upon the recommendation of Roy J. Smith, Captain of Police, Traffic Division, the following named persons be granted taxicab driver's permite: William Barnard, 1108 East 9th Street; Moore D. Harper, 1307 Canterbury Street; Edwin A. Hohmann, 107 Mildred Street; and Ronzo Wade, 214 Archway. The motion carried by the following vote: Ayes, Councilmen Alford, G11118, and Mayor Miller, 3; naye, none; Councilmen Bartholomew and Wolf absent, 2. Mayor Miller announced the public hearing on the proposal of the City Council to amend the Zoning Ordinance in the following particulars, called for this day, open: To amend the "Use" designation of the west one-half of Block 32, Division "E", Original City, fronting on San Antonio Street between 16th and 17th Streets, so as to change same from "B" Residence District to "C" Commercial District. No one appearing to protest the proposed change, Councilman Alford moved that the City Attorney be instructed to prepare the proper ordinance making the proposed change effective. The motion carried by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor Miller, 3; nays, none; Councilmen Bartholomew and Wolf absent, 2. Councilman Gillis offered the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: : (1) A gas main in ROSEWOOD AVENUE from Leona Street west 98 feet, the centerline of which gas main shall be 17 feet south of and parallel to the center- line of Rosewood Avenue. Said gas main described above shall have a covering of not less than 20 feet. (2) A gas main in ROSEWOOD AVENUE from Leona Street to salina Street, the centerline of which gas main shall be 17 feet south of and parallel to the centerline of said Rosewood Avenue. Said gas main described above shall have a covering of not less than 21 feet. (3) A gas main in EAST 3rd STREET from Attayac Street to Navasota Street, the centerline of which gas main shall be 13 feet south of and parallel to the north line of said East 3rd Street. Said gas main described above shall have a covering of not less than 21 feet. (4) A gas main in ANGELINA STREET from Hackberry Street.north 138 feet, the centerline of which gas main shall be 25 feet west of and parallel to the east line of said Angelina Street. Said gas main described above shall have a covering of not less than 2 feet. (5) A gas main in COMAL STREET from Hackberry Street south 100 feet, the centerline of which gas main shall be 20 feet east of and parallel to the west line of said Comal Street. Said gas main described above shall have a covering of not less than 2 feet. (6) A gas main in COMAL STREET from New York Avenue north 122 feet, the centerline of which gas main shall be 20 feet east of and parallel to the west line of said Comal Street. Said gas main described above shall have a covering of not less than 20 feet. (7) A gas main in GLENVIEW STREET northerly 73 feet from a point 227 feet north of the north line of West 30th Street, the centerline of which gas main shall be 72 feet west of and parallel to the east line of said Glenview Street. Said gas main described above shall have a covering of not less than 20 feet. (8) A gas main in EAST 10TH STREET easterly 60 feet from a point 156 feet east of the east line of Trinity Street, the centerline of which gas main shall be 19 feet north of and parallel to the south line of said East 10th Street. Said gas main described above shall have a covering of not less than 20 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevation or working pointe from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. 435 436 AND THAT whenever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas maine, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, 3; nays, none; Councilmen Bartholomew and Wolf absent, 2. Councilman Gillis offered the following resolution: WHEREAS, the curb and sidewalk specifications of the City of Austin which have been previously adopted by the City Council of the City of Austin require that all curbs and sidewalks be constructed of concrete unless a special permit has been secured from the City Council of the City of Austin to construct curbs, sidewalke and ramps of other materials; and WHEREAS, Mrs. F. M. Floore, owner of Lots 1 and 2, Block 12, of Fruth addition, a subdivision within the City of Austin, Travis County, Texas, which property abuta the north side of West 31st Street east of Whitis Avenue and being locally known as 208 West 31st Street, has requested the City Council of the City of Austin to grant permission to construct a flagstone walk from the curb line to the property line at the above described location; and WHEREAS, the City Council of the City of Austin has investigated and approved the construction of said flagstone walk; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Mrs. F. M. Floore, owner of Lots 1 and 2, Block 12, of Fruth Addition, a subdivision within the City of Austin, Travis County, Texas, which property abuts the north side of West 3lat Street east of Whitis Avenue and being locally known as 208 Weat 31st Street, is hereby granted permission to construct a flagstone walk from the property line to the curb line at the above described location and said walk 18 to be constructed under the supervision and direction of the City Engineer of the City of Austin and in accordance with lines and grades furnished by the Engineering Department of the City of Austin, and further subject to the following conditions: That the stone shall be laid in a smooth and workmanlike manner and shall conform to the sidewalk grades and curb grades as given by the Engineering Department of the City of Austin in order that same will not create a hazard to pedestrians. That the stone shall be placed upon a 4" concrete base and that all work within the City streets shall be done by a bonded sidewalk contractor and in accordance with the instructions and directions of the City Engineer of the City of Austin. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor Miller, 3; naye, none; Councilmen Bartholomew and Wolf absent, 2. Councilman Alford offered the following resolution: WHEREAS, Milton B. Porter, owner of Lots 17 and 18 (A), in Sunset Hill, a subdivision within the City of Austin, Travis County, Texas, which property abuts the south side of West 24th Street at a location between Poquonock Road and West 24th Street and being locally known as 2402 Windsor Road, has made application to the City Council of the City of Austin for permission to construct a stone curb adjacent 437 i to the above described property; and WHEREAS, the ordinance which regulates the construction of ourbs upon or within streets in the City of Austin requires that anyone desiring to construct any curb other than a concrete curb shall get special permission to do so from the City Council of the City of Austin; and WHEREAS, the City Council has investigated and approved the construction of a stone curb at the aforesaid location; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Milton B. Porter, owner of Lots 17 and 18 (A), in Sunset Hill, a subdivision within the City of Austin, Travis County, Texas, which property abute the south aide of West 24th Street and located between Poquonook Road and West 24th Street, and being locally known as 2402 Windsor Road, is hereby granted permission to construct a stone curb adjacent to that portion of his property which faces West 24th Street; provided, however, that said stone curb shall be constructed upon a concrete base and shall have an exposure of 8 inches above the gutter and shall be 10 inches wide at the top in accordance with the standard design for rock curbs as adopted by the City of Austin and as detailed upon the plan hereto attached marked 2-B-94, which plan is hereby made a part of this resolution; and further provided that all work shall be done by a bonded curb and sidewalk contractor and that said curb shall be constructed under the supervision of the City Engineer of the City of Austin and in accordance with lines and grades furnished by him. : The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor Miller, 3; naye, none; Councilmen Bartholomew and Wolf absent, 2. Dowell, for the consideration of Eight Hundred Dollars ($800.00), the following described property: Lot No. Eleven (11) of the Shoal Oreek Boulevard Lots Addition to the City of Austin, as shown by the partial re-plat of said Addition recorded in Book 4, at page 4, of the Plat Records of Travis County, Texas. Councilman Gillis offered the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorized and directed in behalf of the City of Austin to sell and convey by warranty deed to Morris Midkiff, for the consideration of Eight Hundred Dollars ($800.00) cash, the following described property: Lot No. 19, of the Shoal Creek Boulevard Lots Addition to the City of Austin, as shown by a plat recorded in Book No. 3, at page 218, of the Plat Records of Travis County, Texas; and all of Lot No. 18 of said Shoal Creek Boulevard Lots Addition, except a strip of land lying between Outlots 28 and 29, in Division "D" of the Government Outlots adjoining the Original City of Austin, which said excepted portion was rededicated as a public street of the City of Austin, being a portion of West 22nd Street, by ordinance passed by the City Council of the City of Austin June 10, 1937, and recorded in Book "K" at pages 185-186 of the Ordinance Records of the City of Austin. 438 The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor Miller, 3; nays, none; Councilmen Bartholomew and Wolf absent, 2.
