1 446, REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, September 23, 1937. The meeting was called to order at 10:10 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen C. F. Alford, C. M. Bartholomew, Simon Gillis, Mayor Tom Miller, and Councilman Oswald G. Wolf, 5; absent, none. The reading of the Minutes was dispensed with. Hardy Hollers, Attorney for Greenwood Wooten, presented five petitions, bearing a total of approximately three hundred and five signatures, protesting the installation of parking meters and asking that the matter be submitted to a vote of the people. Messrs. L. J. Kiger, Arthur Merchants, W. C. Currie, Mrs. Eunice Hausman, and Representative Skaggs of Red River County, submitted proteste against the parking meters. Mrs. Sam J. Smith, Messrs. Joe Dacy, A. S. Hull, G. A. Bahn, F. J. Comte, Murray Graham, and the Reverend M. A. Gary spoke in favor of the parking meters. Following the discussion, the matter was taken under advisement. Councilman Alford offered the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct ite gas mains in and upon the following streets: (1) A gas main in EAST FORTY-SEVENTH STREET from Clarkson Avenue west a distance of approximately 25 feet, the centerline of which gas main shall be 15 feet south of and parallel to the north line of said East 47th Street. Said gas main described above shall have a cover of not less than 2t feet. (2) A gas main in CLARKSON AVENUE from East 47th Street south 75 feet, the centerline of which gas main shall be 18 feet east of and parallel to the west line of said Clarkson Avenue. Said gas main described above shall have a cover of not less than 20 feet. (3) A gas main in CHALMERS AVENUE across Garden Street intersection, the centerline of which gaa main shall be 132 feet west of and parallel to the east line of said Chalmers Avenue. Said gas main described above shall have a cover of not less than 2t feet. (4) A gas main in JULIET STREET easterly 153 feet from a point 310 feet west of the west line of Kinney Avenue, the centerline of which gas main shall be 15 feet south of and parallel to the north line of said Juliet Street. Said gas main described above shall have a cover of not less than 20 feet. (5) A gas main in JULIET STREET from Fredericksburg Road west 140 foot, the centerline of which gas main shall be 7t feet south of and parallel to the north line of said Juliet Street. Said gas main described above shall have a cover of not less than 2t feet. (6) A gas main in GARDEN STREET easterly from a point 42 feet west of the west line of Chalmers Avenue to a point 106 feet east of the east line of Chalmers Avenue, the centerline of which gas main shall be 18 feet north of and parallel to the south line of said Garden Street. Said gas main described above shall have a cover of not less than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the 447 minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, G11118, Mayor Miller, and Councilman Wolf; nays, none. Mayor Miller declared the public hearing open on the proposal of the City Council to amend the Zoning Ordinance in the following particulars: 1 To amend the USE designation of the property at the four corners of the inter section of Chicon and Haskell Streets so as to change same from "A" Residence District to "C" Commercial District, said property being more particularly described as follows: the east one-half of Lot 11, Block 6, Outlot 60, Divis1on "0", V. E. Taylor Subdivision; Lot 8, Block 1, Outlot 60, Division "0", Driving Park Addition; Lot 9, Block G, Outlot 60, Division "O" Driving Park Addition; Lot 48, Block 59, Outlot 59, Division "0", Pope's Resubdivision. No one appearing to protest the proposed change, the following report of the Board of Adjustment was then read: "Austin, Texas September 23, 1937 Hon. Mayor and City Couno 11 Austin, Texas Gentlemen: The Board of Adjustment, at a meeting held on September 21, 1937, passed the following resolution, which is hereby submitted for your consideration: RESOLUTION. WHEREAS, the City Council of the City of Austin, pursuant to the terms of Section 30 of the Zoning Ordinance of the City of Austin, has referred to the Board of Adjustment for its consideration a petition of Mrs. G. E. Doss for a change in the "Use" designation of her property located at 2103 Garden Street, being at the intersection of Chicon and Haskell Streets, Austin, Texas, from "A" Residence District to "C" Commercial District; and WHEREAS, the Board of Adjustment, at a meeting held on September 21, carefully considered the changing of the "Use" District designation of this property, and has viewed the premises and carefully studied the conditions and developments surrounding same and considered this change from all points of view from sound zoning principles; therefore, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT: THAT the Board sees no objection to the change in the "Use" District of the above described property provided this change be extended to include the other three corners of the intersection of Haskell and Chicon Streets, for the following reasons: 1. That to change the single piece of property of the appellant would be undesirable spot zoning and that owing to the prominence of Chicon Street as a main artery of traffic and thoroughfare leading out of the southeast portion of the City and the trend toward commercial development along this street, it seems desirable to establish a community center at this point which should include all four corners of the intersection of Chicon and Haskell Streets; and 2. That, while there are other designated community centers in this section of the City which have not developed and no business is now being conducted therein, it is apparent that their locations may not have been desirable nor in conformity to the convenience and necessity of the residents of that area, and therefore may at some later date be changed back to residential property; and 443. 3. That the creation of this community center would seem to meet the needs of the Community better and would not be a detriment to the interest of property owners in that section. Respectfully submitted, BOARD OF ADJUSTMENT By H. F. Kuehne Chairman. M Councilman Alford moved that the City Attorney be instructed to prepare an amendment to the Zoning Ordinance making the proposed change in zoning of the foregoing de- scribed property effective. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, G11118, Mayor Miller, and Councilman Wolf; nays, none. Councilman Wolf moved that J. E. Haire of the Congress Taxicab Company be granted two additional taxicab licenses. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. The following resolution was introduced: WHEREAS, it has been determined that the assessment for taxes against the improvementa on House No. 3209 on State land, in the City of Austin, for the years 1926, 1927, 1929, 1930, 1931, 1932, 1933, 1934, 1935, and 1936, now in the name of C. R. Bouchard and D. A. Bouchard, are excessive, and that same should now be corrected for each of said years; therefore : BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the assessments for taxes on said property for the years aforesaid be, and the same are hereby, reduced and corrected from the present assessed value as follows: For the year 1926, from $350.00 to $240.00; For the year 1927, from $360.00 to $240.00; For the year 1929, from $360.00 to $240.00; For the year 1930, from $360.00 to $240.00; For the year 1931, from $360.00 to $240.00; For the year 1932, from $360.00 to $240.00; For the year 1933, from $305.00 to $200.00; For the year 1934, from $265.00 to $175.00; For the year 1935, from $265.00 to $175.00; For the year 1936, from $265.00 to $175.00; and that the City Assessor and Collector of Taxes is authorized and directed to make such changes on the tax rolls. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, G11118, Mayor Miller, and Councilman Wolf; nays, none. Mayor Miller moved that the following members of the City Plan Commission be reappointed for the term ending December 31, 1938: H. F. Kuehne, Chairman; Murray Ramsey, and Gillespie Stacy; and that the following new members be appointed to fill the vacancies existing on said Commission for said term ending December 31, 1938: B. J. Rupert, T. B. Warden, C. A. Bohutze, W. M. Graham; Ex-Offic10,J. E. Motheral and Trueman O'Quinn. The motion carried by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, Councilmen Bartholomew and Wolf; nays, none.
