471 THAT the penalty aggregating $65.29, and 1/2 the interest aggregating $125.84 on the delinquent taxes on the above property for the years 1930, 1931, 1933, 1934, 1935, and 1936, is hereby remitted, and the Tax Assessor and Collector is authorized and directed to strike same from his assessment rolls and to issue a receipt in full to the party entitled thereto, on his payment to the City of Austin of the sum of $1431.96, in accordance with the terms of this resolution. Mayor Austin, Texas, October 21, 1937. The meeting was called to order at 10:30 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen C. F. Alford, C.M. Bertholomew, G1111s, Mayor Miller, and Councilman Wolf, 5; absent, none. The Minutes of the regular meetings of July 8 to August 5, inclusive, were read, and upon motion of Councilman Alferd were adopted, as read, by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. Steve Heffington, Tax Assessor and Collector of Travis County, submitted a request that the boundaries of the Cityle voting wards be changed to conform to the boundaries of Travia County voting wards within the City recently established by the County Commissioner's Court. The matter was taken under advisement. Councilman Wolf moved that temporary taxicab permit, No. 44, issued to J.E. Haire be made permanent. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. Mayor Miller moved that the Lightsey Cab Company be granted one additional taxicab license. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. Messrs. Wm. Kessler and Gee. E. Shelley appeared before the Council relative to their application for a change in the zoning of the W. L. Moore property en South Congress 472 Avenue, being Lots 12, 13, 14, and 15, Block 1, of the La Prelle Addition, from "A" Residence to "C" Commercial Districts.. After considerable discussion, at the request of the applicants, the abstract of the property was referred to the City Attorney for examination, and the setting of a date for a public hearing on the proposed change was postponed. Councilman Alford offered the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct ite gas mains in and upen the following streets: (1) A gas main in HARTFORD ROAD south 210 feet from a peint 63 feet frem apoint=63-feet south of the south line of Watchh111 Road, the centerline of which gas main shall be 25 feet east of and parallel to the west line of said Hartferd Read. Said gas main described abeve shall have a covering of not less than 20 feet. (2) A gas main in EAST 37TH STREET from Hampton Road westerly 135 feet, the centerline of which gas main shall be 7 feet north of and parallel to the south line of said East 37th Street. Said gas main described above shall have a covering of not less than 2 feet... (3) A gas main in AVENUE "H" southerly 85 feet from a peint 270 feet south of the south line of East 52nd Street, the centerline of which gas main shall be 14 feet east of and parallel to the west line of said Avenue "H". Said gas main described above shall have a covering of not less than 2 feet. (4) A gas main in EAST 14TH STREET from Red River Street easterly 114 feet, the centerline of which gas main shall be 23 feet south of and parallel to the centerline of said East 14th Street. Said gas main described above shall have a covering of not less than 2 feet. (5) A gas main in OLIVE STREET from Branch Street easterly 83 feet, the centerline of which gas main shall be 10 feet south of and parallel to the north line of said Olive Street. Said gas main described above shall have a covering of not less than 2 feet. (6) A gas main in BRANCH STREET from Olive Street northerly 215 feet, the centerline of which gas main shall be 10 feet west of and parallel to the east line of said Branch Street. Said gas main described above shall have a covering of not less than 20 feet. (7) A gas main in KERBEY LANE from West 30th Street northerly 538 feet, the centerline of which gas main shall be 7½ feet west of and parallel to the cast line of said Kerbey Lane. Said gas main described above shall have a covering of not less than 25 feet. (8) A gas main in JULIET STREET westerly 380 feet from a point 140 feet west of the west line of Fredericksburg Road, the centerline of which gas main shall be 79 feet south of and parallel to the north line of said Juliet Street. Said gas main described above shall have a covering of not less than 20 feet, (9) A gas main in EAST SIDE DRIVE southerly 155 feet from a point 127 feet south of the south line of East Monree Street, the centerline of which gas main shall be 4 feet east of and parallel to the west line of said East Side Drive. Said gas main described above shall have a covering of not less than 2 feet. (10) A gas main in WEST 33RD STREET easterly 100 feet from a point 110 feet east of the east line of Wabash Avenue, the centerline of which gas main shall be 15 feet north of and parallel to the south line of said West 33rd Street. Baid gas main described above shall have a covering of not less than 20 feet. (11) A gas main in BARROW AVENUE southerly 218 feet from a point 56 feet south of the south line of East 45th Street, the centerline of which gas main shall be 19 feet west of and parallel to the east line of said Barrow Avenue. Said gas main described above shall have a covering of not less than 2 feet. (12) A gas main in PEOPLES STREET easterly 64 feet from a point 45 feet east of the east line of Lincoln Street, the centerline of which gan main shall be 6 Street. feet south of and parallel to the north line of Peoples Said gas main described above shall have a covering of not less than 20 feet. (13) A gas main in LEONA STREET across East 19th Street intersection, the centerline of which gas main shall be 18 feet west of and parallel to the east line of said Leena Street, Said gas main described above shall have a covering of not less than 2 feet. (14) A gas main in EAST 18TH STREET acress Salina Street intersection, the centerline of which gas main shall be 7t feet south of and parallel to the nerth line of said East 18th Street. Said gas main described above shall have a covering of net less than 2 feet. (15) A gas main in HARTHAN STREET from West 6th Street nertherly 475 feet, the centerline of which gas main shall be 7 feet west of and parallel to the east line of said Harthan Street. Said gas main described above shall have a covering of not less than 24 feet. The Texas Public Service Company is hereby put upen notice that the City of. Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depthe may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the, location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upen notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gen mains, including the excavation in the strecte and the restoration and maintenance of said strcete after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Councilman Gillis offered the following resolution: , WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps and plans showing the preposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore 473 474 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be, and the same is hereby, permitted to construct its pole lines in the following streets: (1) A telephone pele line in WOODROW AVENUE from Northloop Boulevard northerly one block, the centerline of which pole line shall be 2 feet east of and parallel to the west line of said Woodrow Avenue. (2) A telephone pole line in LOWER GEORGETOWN ROAD from West 45th Street northerly to Charles Street, the centerline of which pole line shall be 2 reet east of and parallel to the west line of said Lewer Georgetown Road. THAT the work and construction of said pele lines, including the excavation of the streets and the restoration and maintenance of paid streets after said pele lines have been constructed, shall be under the supervision and direction of the City Manager and in accordance with the ordinances and regulations of the City of Austin governing such construction. Councilman Gillis offered the following resolution: WHEREAS, Schwarzer & Barron are the Contractors for the construction of a building located at 1001 Colerado Street and desire a portion of the alley working space abutting Let 4, Bleck 124, of the Original City of Austin, during the construction of the building, such space to be used in the work and for the storage of materials therefer; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 1. THAT space for the uses hereinabove enumerated be granted to said Schwarzer & Barron, the boundary of which is described as follows: Alley Working Space West half of alley running east and west between 10th and 11th Strenta and adjacent to the above described property and 10 feet of the alley running north and south and adjoining the above described property. 2. THAT the above privileges and allotment of space are granted to said Schwarzer & Barron, hereinafter termed "Contractor," upon the following express terms and conditions: (1) That the Contracter shall construct a 4 foot fence within the outer boundaries of the above described werking space, such fence to be substantially braced and anchored. (2) That the Contractor shall in no way obstruct any fire plugs or other public utilities in the construction of such guard fence. (3) That provision shall be made for the normal flew of all storm waters in the gutter and the Contractor will be responsible for any damage done due to obstruction of any such storm waters. (4) That the Contractor shall place on the outside corners of any walkway, barricades or obstructions, red lights during all periode of darkness. (5) That the Contractor is permitted to construct a temporary work office within such alleted working space provided such work office is not within 25 feet of any corner street intersection. (6) That the Contracter be permitted to block off during the day time that portion of the north and south alley which laye between his working space and the east line of said alley, using a hinged gate for this purpose. This space is to remain open at night and at all times when no work is being done in the alley 475 and no material is to be stored in this space. (7) That the Contracter shall remove all fences, barricades, loose materials and other obstructions on the sidewalk and street immediately after the necessity for their existence in said alley has ceased, such time to be determined by the City Manager, and in any event all such sidewalk, barricades, materials, equipment and other obstructions shall be removed not later than March 1, 1938. (8) That the Contractor shall restore all public and private property injured during the use of such space to as good condition as the same existed before the use of such space began. : (9) That the City reserves the right to revoke at any time any and all the privileges herein granted or to require the erection or installation of additional barriers or safeguards if the conditions demand it. (10) That the Contractor shall furnish the City of Austin a surety bond in the sum of Five Thousand ($5,000.00) Dollars, which shall protect, indemnity and hold harmless the City of Austin from any claims for damages to any person by reason of the exercise of the privileges granted to the Contractor by the City of Austin and shall guarantee the replacement of all sidewalks, pavement, and all other public property and public utilities disturbed or removed during the construction work and shall further guarantee the construction of a guard fence and other safeguards during the eccupancy of the space. Councilman Wolf introduced the following erdinance: AN ORDINANCE AUTHORIZING GUY A. THOMPSON, TRUSTEE, INTERNATIONAL-GREAT NORTHERN RAILROAD COMPANY, DEBTOR, TO CONSTRUCT, MAINTAIN AND OPERATE CERTAIN RAILWAY INDUSTRIAL OR HOUSE TRACK UPON AND ACROSS PAUL STREET, IN THE CITY OF AUSTIN, ΤΟ SERVE PROPERTY BETWEEN PAUL STREET AND PRESSLER STREET, IN THE CITY OF AUSTIN, SUBJECT TO CERTAIN CONDITIONS; AND DECLARING AN EMERGENCY. , The ordinance was read the first time and upon motion of Councilman Wolf the rule was suspended and the ordinance was passed to its second reading by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. The ordinance was read the second time and upon motion of Councilman Wolf the rule was further suspended and the ordinance was passed to its third reading by the following vote: Ayes, Councilmen Alford, Bartholomew, G1111s, Mayor Miller, and Coune 11man Wolf, 5; nays, none. The erdinance was read the third time and upon motion of Councilman Wolf the erdinance was finally passed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none, Mayor Miller moved that the following named persons be granted taxicab driver'a permits, in accordance with the recommendation of Roy J. Smith, Captain of Police, Traffic Division: Howard Bensen, 415 West Mary Street; and Manuel Euresti, 2206 East Ninth Street. The motion carried by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf, 5; nays, none. The application of N. O. Crumley for a change in the zoning of Let 10, Block M, Bouldin Addition, from "A" Residence District to "C" Commercial District, was received, and upon motion of Councilman Wolf the matter was referred to the Board of Adjustment for recommendation by the following vote; Ayes, Councilmen Alford, Bartholomew, , 476 Gillis, Mayer Miller, and Councilman Wolf, 5; nays, none. The Minutes of August 5 to August 26, inclusive, were read and approved. In accordance with notice duly published, the hearing to all persons owning or claiming any property abutting on or upon and in West Eighth Street from the east curb line of Colorado Street to the west curb line of Congress Avenue, and on West Eighth Street from the east curb line of Lavaca Street to the west curb line of Colorado Street, was opened. The only property owners appearing to be heard were A. 0. Baldwin and Dr. E. J. Lund, who did not protest the proposed paving, but merely asked for certain information connected therewith. This information was given them and they stated they were satisfied. The following resolution was introduced: WHEREAS, the City Council has today examined plans and specifications for the proposed construction of the City Hall and Central Fire Station, being PWA Docket No. 1854, and has found said plans and specifications to be satisfactory; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be authorized and directed to approve and sign said plans and specifications on behalf of the City of Austin and to submit same to the State Director of the Public Works Administration for approval.
