Attrest: Haein Meccar City Clerk REGULAR MEETING OF THE CITY COUNCIL: Approved: Jommilla Mayor Austin, Texas, October 28, 1937. The meeting was called to order with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen C. F. Alford, C. M. Bartholomew, Simon Gillis, and Mayor Tom Miller, 4; absent, Councilman Oswald G. Wolf, 1. The Minutes of August 5 to August 26, inclusive, were read and approved. In accordance with notice duly published, the hearing to all persons owning or claiming any property abutting on or upon and in West Eighth Street from the east curb line of Colorado Street to the west curb line of Congress Avenue, and on West Eighth Street from the east curb line of Lavaca Street to the west curb line of Colorado Street, was opened. The only property owners appearing to be heard were A. 0. Baldwin and Dr. E. J. Lund, who did not protest the proposed paving, but merely asked for certain information connected therewith. This information was given them and they stated they were satisfied. The following resolution was introduced: WHEREAS, the City Council has today examined plans and specifications for the proposed construction of the City Hall and Central Fire Station, being PWA Docket No. 1854, and has found said plans and specifications to be satisfactory; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be authorized and directed to approve and sign said plans and specifications on behalf of the City of Austin and to submit same to the State Director of the Public Works Administration for approval. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Miller, 4; nays, none; Councilman Wolf absent, 1. The following resolution was introduced: : WHEREAS, the Public Works Administration requires that all projects undertaken under its regulations be done in accordance with approved wage scales as published by the Department of Labor of the State of Texas; and WHEREAS, in proposed work on Docket No. 1854, the said Department of Labor has furnished the City of Austin with said schedule; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorized and directed to submit such schedule to the State Director of the Public Works Administration and provide that all bidders on said Docket No. 1854 be notified and directed that such scale of wages must be complied with. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Miller, 4; naye, none; Councilman Wolf absent, 1. The following resolution was introduced: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gaa mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct ite gas mains in and upon the following streets: (1) A gas main in WEST EIGHTH STREET from a point 30 feet east of west line of Lavace Street easterly two blocks to a point 28 feet east of the west line of Congress Avenue, the centerline of which gas main shall be 282 feet south of and parallel to the centerline of said West Eighth Street.. Said gas main described above shall have a covering of not less than 20 feet. (2) A gas main in THE CIRCLE northerly 64 feet from a point 160 feet north of Drake Avenue, the centerline of which gas main shall be 72 feet west of and parallel to the east line of said The Circle. Said gas main described above shall have a covering of not less than 20 feet. (3) A gas main in WALLER STREET southerly 260 feet from a point 103 feet south of Lambie Street, the centerline of which gas main shall be 45 feet east of and parallel to the west line of said Waller Street. Said gas main described above shall have a covering of not less than 2 feet. (4) A gas main in EAST AVENUE northerly 311 feet from a point 274 feet north of the north 1ine of Concordia Avenue, the centerline of which gas main shall be 134 feet west of and parallel to the east line of said East Avenue. Said gaa main described above shall have a covering of not less than 2 feet. (5) A gas main in SPEEDWAY from 43rd Street southerly 136 feet, the centerline of which gas main shall be 30 feet east of and parallel to the west line of Speedway. Said gan main described above shall have a covering of not less than 20 feet. (6) A gas main in EAST SIXTH STREET ALLEY from Trinity Street west 53 feet, the centerline of which gas main shall be 2 feet north of and parallel to the south line of said East Sixth Street Alley. Said gas main described above shall have a covering of not less than 20 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires 478 definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches.. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The petition of a group of citizens in Govalle asking that a street now called "Hungry Hill Lane" be changed to some other name, and giving the suggested names, was received. The City Engineer was instructed to contact said citizens and have them agree on one name and repert back to the Council. The following resolution was introduced: WHEREAS, the curb and sidewalk specifications of the City of Austin which have been previously adopted by the City Council of the City of Austin require that all curbs and sidewalks be constructed of concrete unless a special permit has been secured from the City Council of the City of hustin to construct curbs, sidewalka and ramps of other materials; and WHEREAS, Miss Ruth Key, owner of Lot 23 of Sunset Hill, a subdivision within the City of Austin, Travis County, Texas, which property abuts the west aide of Woodlawn Boulevard at a location south of West 24th Street and being locally known as 2312 Woodlawn Boulevard, has requested the City Council of the City of Austin to grant permission to construct a brick sidewalk between the curb and property line at the above described location; and : WHEREAS, the City Council of the City of Austin has investigated and approved the construction of said brick sidewalk; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN:.. THAT Miss Ruth Key, owner of Lot 23 of sunset Hill, a subdivision within the City of Austin, Travis County, Texas, which property abuts the west side of Woodlawn Boulevard at a location south of West 24th Street, being locally known as 2312 Woodlawn Boulevard, is hereby granted permission to construct a brick eidewalk between the curb and property line at the above described location and said sidewalk is to be constructed under the supervision and direction of the City Engineer of the City of Austin and in accordance with lines and grades furnished by the Engineering Department of the City of Austin, and further subject to the following conditions: That the brick shall be laid in a smooth and workmanlike manner and shall conform to the sidewalk grades and curb grades as given by the Engineering Department of the City of Austin in order that same will not create a hazard to pedestrians. That the brick shall be placed upon a 4" concrete base and that all work within the City streets shall be done by a bonded sidewalk contractor and in accordance with the instructions and directions of the City Engineer of the City of Austin. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Miller, 4; naye, none; Councilman Wolf absent, 1. Mr. D. K. Price of the Social Science Research Council was present at the meeting and advised the Council that he, together with Mr. and Mrs. Harold Stone, is touring the United States, visiting thirty cities having the City Manager form of government, for the purpose of doing research work and obtaining information regarding the political and social background of the officials and administration of these cities.. The City Attorney was instructed to prepare resolutions on the deaths of Judge O. S. Lattimore and Mr. Sam Johnson, father of Congressman Lyndon Johnson, for adoption at the next regular meeting. The motion was seconded by Councilman Gillis, The motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes, Councilmen C. F. Alford, C. M. Bartholomew, Simen Gillis, Mayor Tom Miller, and Councilman Oswald G. Wolf, 5; Nays, nonu. The resolution is as follows: RESOLUTION PROVIDING THAT NOTICE BE GIVEN OF THE INTENTION OF THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS, TO SUBMIT TO THE QUALIFIED VOTERS OF SAID CITY OF AUSTIN FOR ADOPTION OR REJECTION A CERTAIN AMENDMENT TO ARTICLE I, SECTION 1, OF THE EXIST- ING CHARTER OF SAID CITY. WHEREAS, the City Council deems it advisable to submit to the qualified voters 479
