REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, April 28, 1938. The City Council of the City of Austin, Texas, met in regular session at the regular meeting place in the City Hall in said City on April 28, 1938, at 10:30 A. M., with Mayor pro tem. Oswald G. Wolf, presiding. Roll call showed the following members present: Councilmen C. F. Alford, Simon Gillis, and Mayor pro tem. Wolf, 3; absent, Councilman C. M. Bartholomew and Mayor Tom Miller, 2. The Minutes of the regular meetings of April 7, April 14, and April 20 were read, and, upon motion of Councilman Gillis, were adopted as read, by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor pro tem. Wolf, 3; naye, none. Councilman Gillis offered the following resolutiont WHEREAS, the Southwestern Bell Telephone Company has presented to the City Couno 11 tentative maps or plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be, and the same is hereby, permitted to construct its pole lines in the following streets: A telephone pole line in STOKES DRIVE from Kuhlman Avenue to Hargrave Street, the centerline of which pole line shall be 9 feet west of and parallel to the east line of said Stokes Drive. THAT the work and construction of said pole lines, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed, shall be under the supervision and direction of the City Manager and in accordance with the ordinances and regulations of the City of Austin governing such construction. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor pro tem. Wolf, 3; nays, none. Councilman Gillis offered the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following strects: (1) A gas main in WEST 41ST STREET from Alice Avenue easterly 45 feet, the centerline of which gas main shall be 20 feet south of and parallel to the north line of said West 41st Street. Said gas main described above shall have a covering of not less than 2 feet. (2) A gas main in EAST 23RD STREET from Red River Street easterly 190 feet, the centerline of which gas main shall be 15 feet south of and parallel to the north line of said East 23rd Street. Said gas main described above shall have a covering of not less than 22 feet. (3) A gas main in JOSEPHINE STREET from Juliet Street southerly 264 feet, the centerline of which gas main shall be 7 feet west of and parallel to the east line of said Josephine Street. Said gas main described above shall have a covering of not less than 2 feet. (4) A gas main in CURVE STREET from Olive Street southerly 144 feet, 1 2 the centerline of which gas main shall be 10 feet west of and parallel to the east line of said Curve Street. Said gas main described above shall have a covering of not less than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depthe may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Publio Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor pro tem. Wolf; naye, none. The written application of Bradfield & Brush, Agents for the Owners, to have the zoning of two tracts of land on the north and south sides of Windsor Road Just east of the intersection of said road with the Missouri Pacific Railroad changed from "A" Residence District to "C" Commercial District, was received and referred to the Board of Adjustment for recommendation. The following petitions were received: "604 Scarbrough Building April 1, 1938 Honorable Guiton Morgan City Manager Austin, Teхав Dear Mr. Morgan: I attach hereto an application to the Mayor and City Council to change the name of Hillview Street, and to designate the block on which my home is located to Hillview. I attach also a statement from all who have built homes on the street consenting to the change. The Westenfield Development Company, who platted the subdivision and named the street, authorizes me to say that they have no objection to changing the name. In this connection permit me to say that we gave this name to our property at about or before the time the street was named, and have used it in our correspondence, and have had it carved on a stone pillar at the front entrance. We have developed an attachment for the name. For these reasons, and because no one else who might be interested has any preference for it, we will appreciate the Council granting this request. Will you please lay this request before the Council at your early convenience, and I hope with your recommendation that it be granted. TO THE MAYOR AND CITY COUNCIL OF AUSTIN: Cordially yours, (Signed) R. B. Cousins, Jr. 11 "Austin, Texas March 15, 1938 The undersigned does hereby petition your Honorable Body to change by ordinance the name of Hillview Street in Tarrytown, a residential subdivision of the City of Austin, so that hereafter it shall be Mountainview, and that the name or designation of "Hillview" be assigned to that block of property bounded by Exposition Boulevard, Gilbert Street, Meadowbrook Drive, and Clearview Street. Cousins, Jr. 11 "TO THE MAYOR AND CITY COUNCIL OF AUSTIN, GENTLEMEN: We, the undersigned, who have built residences or the improvements on Hillview Street in Tarrytown, a residential subdivision of Austin, do hereby consent to the change of the name of Hillview Street to any other suitable name acceptable by the Counc11. Vaughn Carl Edward Bock 11 Councilman Gillis offered the following resolution: WHEREAS, in Plat Book 3, page 224, of the Plat Records of Travis County, Texas, there appears a map or plat of a subdivision known as Tarrytown No. 2; and WHEREAS, in Book 3, page 231, of the Plat Records of Travis County, Texas, there appears a map or plat of a subdivision of land known as Tarrytown No. 3; and WHEREAS, upon each of said maps or plats of Tarrytown No. 2 and Tarrytown No. 3 there appears a street or road known as Hillview Road; and WHEREAS, R. B. Cousins, Jr., et al., has petitioned the City Council of the City of Austin to change the name of the aforesaid Hillview Road to that of Mountainview Road; and WHEREAS, said petition has been reviewed and considered by the City Council of the City of Austin; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the name Hillview Road, as appears on the map or plat of Tarrytown No. 2, which map or plat is of record in Book 3, page 224, of the Plat Records of Travis County, Texas, and the name Hillview Road, as appears on the map or plat of Tarrytown No. 3, which map or plat is of record in Book 3, page 231, of the Plat Records of Travis County, Texas, be changed to that of Mountainview Road. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor pro tem. Wolf; 3; nays, none. Mayor pro tem. Wolf introduced the following ordinance: AN ORDINANCE AMENDING IN THE CERTAIN PARTICULARS HEREINAFTER STATED AN ORDINANCE ENTITLED "AN ORDINANCE ESTABLISHING ZONING REGULATIONS AND DISTRICTS IN ACCORDANCE WITH A COMPREHENSIVE PLAN; AND REGULATING AND DISTRICTING THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE PERCENTAGE OF LOT THAT MAY BE OCCUPIED, THE SIZE OF YARDS, COURTS AND OTHER OPEN SPACES, THE DENSITY OF POPULATION, THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND FOR TRADE INDUSTRY, RESIDENCES AND OTHER PURPOSES; AND DIVIDING THE CITY OF AUSTIN INTO DISTRICTS OR ZONES; AND REGULATING AND DISTRICTING THE ERECTION, CONSTRUCTION, RECONSTRUCTION, ALTERATION, REPAIR AND USE OF BUILDINGS, STRUCTURES OR LAND WITHIN SUCH DISTRICTS OR ZONES; AND PROVIDING UNIFORM REGULATIONS FOR THE SEVERAL CLASSES AND KINDS OF BUILDINGS OR STRUCTURES AND USES WITHIN THE DISTRICTS OR ZONES; AND ADOPTING TWO ZONING MAPS, DISCLOSING RESPECTIVELY THE SEVERAL USE DISTRICTS AND THE SEVERAL HEIGHT AND AREA DISTRICTS, AND THE RESTRICTIONS AND LIMITATIONS AND PROVISIONS APPLICABLE TO SUCH DISTRICTS; AND PROVIDING FOR A BOARD OF ADJUSTMENT AND DEFINING THE POWERS OF SAME; AND PROVIDING CERTAIN PENALTIES AND REMEDIES; AND DECLARING AN EMERGENCY." The ordinance was read the first time, and upon motion of Councilman Gillis, seconded by Councilman Alford, the ordinance was passed to its second reading, by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor pro tem. Wolf, 3; nays, none. 3 4 Councilman Alford offered the following resolution: WHEREAS, the Public Works Administration requires that all projects undertaken under its regulations be done in accordance with approved wage scales as published by the Department of Labor of the State of Texas; and WHEREAS, in proposed work on Docket No. 1854, the said Department of Labor has furnished the City of Austin with said schedule, but which said schedule did not contain certain classes of labor which will be necessary to be used in the proposed work under Docket No. 1854; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be, and he is hereby, authorized and directed to submit such additional schedule to the State Director of the Public Works Administration, and provide all contractors and sub-contractors on said Docket No. 1854 be notified and directed that such scale of wages must be complied with. Smith, Captain of Police, Traffic Division: Ernest Alvin Barnard, 702) San Antonio Street; Paul Johnson, 2610 Willow Street; and Kurt Hobert Meyer, 1007 San Jacinto Street. The motion carried by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor pro tem. Wolf, 3; nays, none.
