78 REGULAR MEETING OF THE CITY COUNCILI Austin, Texas, July 07, 1938 The City Council of the City of Austin, Texas, convened in regular session at the regular meeting place in the City Hall, on July 7, 1938, at 10:30 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen C. F. Alford, Simon Gillis, and Mayor Tom Miller; absent Councilmen C. M. Bartholomew and Oswald Wolf, 2. The reading of the Minutes was dispensed with. Mr. Adolph Schutze, Miss Lena Wattinger and several other property owners appeared before the Council requesting that West 5th street, between Crookett street and the intersection of 5th street with West 6th street, or at least between Crockett and Walsh streets, be topped as the dust nuisance was causing them to lose their tenants. This matter was referred to the City Manager with the request that the City Engineer be instructed to contact the property owners on this street in an effort to have this street topped. Mr. F. W. King appeared again before the Council to discuss the action of the Council at their meeting of June 30 regarding the zoning of the Fredericksburg Road from the intersection of Hether street to the city limits, which was designated as "C" Commercial to a depth of 150 feet. The Mayor advised Mr. King that the Council felt that their action in the matter was for the best interest of all property owners and, therefore, would not reopen the question. The Mayor declared the public hearing open on the proposal of the City Counc11 to amend the Zoning Ordinance in the following particulars: To amend the "USE" District designation of the following describe a property so as to change same from "A" Residence District to "B" Residence District: The entire block bounded by The Cirole, Hillside Drive, Drake Avenue and Park Lane, in Fairview Park Addition, South Austin. There being no one present to protest the changing of the zoning of this property Mayor Miller asked that the roll be called on the proposal to change the zoning of the entire block bounded by The Circle, Hillside Drive, Drake Avenue and Park Lane, in Fairview Park Addition, South Austin, from "A" Residence District to "B" Residence District, those in favor of said change voting "aye", and those opposed, "nay". The result was as follows: Ayes, Councilmen Alford, Gillis, and Mayor Miller; nays, none. Absent, Councilmen C. M. Bartholomew and Oswald Wolf, 2. The City Attorney was instructed to prepare an amendment to the Zoning Ordinance emboyding the proposed change. Councilman Alford offered the following resolution: WHEREAS, the curb and sidewalk specifications of the City of Austin which have been previously adopted by the City Council of the City of Austin require that all ourbs and sidewalks be constructed of concrete unless a special permit has been secured from the City Council of the City of Austin to construct curbs, sidewalks and ramps of other materials; and WHEREAS, John C. Aycock, owner of all of Lot 6 and a portion of Lot 5, Block 19, Pemberton Heights, Section 5, a subdivision within the City of Austin, Travis County, Texas, which property is situated on the south side of Wathen Avenue located west of McCallum Drive, has requested the City Council of the City of Austin to grant permission to construct a flag stone walk from the curb line to the property line at the above described location; and 1 WHEREAS, the City Council of the City of Austin has investigated and approved the construction of said flag stone walk; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT John C. Aycook, owner of all of Lot 6 and a portion of Lot 5, Block 19 of Pemberton Heights, Section 5, a subdivision within the City of Austin, Travis County, Texas, which property is situated on the south side of Wathen Avenue located west of McCallum Drive, is hereby granted permission to construct a flag stone walk from the property line to the curb line at the above described location and said walk is to be constructed under the supervision and direction of the City Engineer of the City of Austin and in accordance with lines and grades furnished by the Engineering Department of the City of Austin, and further subject to the following conditions: That the stone shall be laid in a smooth and workmanlike manner and shall conform to the sidewalk grades and curb grades as given by the Engineering Department of the City of Austin in order that same will not create a hazard to pedestrians. That the stone shall be placed upon a 4" concrete base and that all work within the City streets shall be done by a bonded sidewalk contractor and in accordance with the instruction and directions of the City Engineer of the City of Austin. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor Miller; nays, none; absent Councilmen Bartholomew and Wolf, 2. Counci 1man Gillis presented the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in TRAVIS HEIGHTS BOULEVARD southerly 70 feet from a point 138 feet south of the south line of Algarita Avenue, the centerline of which gas main shall be 30 feet west of and parallel to the east line of said Travis Heights Boulevard. Said gas main described above shall have a covering of not less than 2-1/2 feet. (2) A gas main in EAST 39TH STREET easterly 100 feet from a point 98 feet east of the east line of Becker Avenue, the centerline of which gas main shall be 17 feet south of and parallel to the north line of said East 39th street. Said gas main described above shall have a covering of not less than 2-1/2 feet. (3) A gas main in OWEN AVENUE northerly 100 feet from a point 205 feet north of the north line of West 34th Street, the centerline of which gas main shall be 17 feet west of and parallel to the cast line of said Owen Avenue. Said gas main described above shall have a covering of not less than 2-1/2 feet. (4) A gas main in JESSIE STREET southerly 100 feet from a point 258 feet south of the south line of Juliet Street, the centerline of which gas main shall be 7-1/2 feet west of and parallel to the east line of said Jessie Street. Said gas main described above shall have a covering of not less than 2-1/2 feet. (5) A gas main in SOUTH 5th STREET northerly 114 feet from a point 26 feet north of the north line of Columbus Street, the centerline of which gas main shall be 7-1/2 feet west of and parallel to the east line of said South 5th Street. Said gas main described above shall have a covering of not less than 2-1/2 feet. (8) A gas main stub across Dam Boulevard at West 7th Street. Said gas main stub described above shall have a covering of not less than 2-1/2 feet. (9) A gas main in DAM BOULEVARD as follows: Beginning at a point 240 feet southerly from and 68 feet westerly from the intersection of the cast line of Dam Boulevard and the south line of the entrance to the Municipal Golf Course; thence in a northwesterly direction angling 450with the centerline of Dam Boulevard to a point 7-1/2 feet east of the west line of Dam Boulevard. Said gas main described above shall have a covering of not less than 2-1/2 feet. (10) A gas main in DAM BOULEVARD across the intersection of Enfield Road, the centerline of which gas main shall be 7-1/2 feet west of and parallel to the east line of said Dam Boulevard. Said gas main described above shall have a covering of not less than 2-1/2 feet. (11) A gas main in PARK STREET across Dam Boulevard intersection, the centerline of which gas main shall be 7-1/2 feet north of and parallel to the south line of said Park Street. Said gas main described above shall have a covering of not less than 2-1/2 feet. (12) A gas main in WEST 40th STREET from Rosedale Avenue westerly 40 feet, the centerline of which gas main shall be 13 feet south of and para1lel to the north line of said West 40th Street. Said gas main described above shall have a covering of not less than 2-1/2 feet. (13) A gas main in WEST 40th STREET from Burnet Road easterly 20 feet, the centerline of which gas main shall be 13 feet south of and parallel to the north line of said West 40th Street. Said gas main described above shall have a covering of not less than 2-1/2 feet. (14) A gas main in ROSEDALE AVENUE across West 40th Street intersection, the centerline of which gas main shall be 15 feet west of and parallel to the east line of said Rosedale Avenue. Said gas main described above shall have a covering of not less than 2-1/2 feet. (15) A gas main in BURNET ROAD southerly 110 feet from a point 67 feet north of the north line of West 40th Street, the centerline of which gas main shall be 15 feet west of and parallel to the east line of said Burnet Road. Said gas main described above shall have a covering of not less than 2-1/2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special point s. When the Texas Public Service Company requires definite in- formation upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the City Engineering Department notless than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. 1 THAT the work and laying of said gas mains, including the excavation in the streets, and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchises granted to said company by the City of Austin. The resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor Miller; nays, none; Councilmen Bartholomew and Wolf absent, 2. Upon motion of Councilman Alford, J. E. Haire, 219 Congress Avenue, and Walter Owens, 503 Lavaca street, were granted a license to operate a taxicab, by the following vote, Ayes, Councilmen Alford, Gillis, and Mayor Miller; nays, none; Councilmen Bartholomew and Wolf absent, 2. Mayor Miller moved that Lee Milton Covington, 202 Attoyac street, be granted a taxicab driver's permit in accordance with the recommendations of the Traffic Division of the Police Department; Upon roll call, the following vote was recorded; Ayes, Councilmen Alford, Gillis, and Mayor Miller; nays, none; Councilmen Bartholomew and Wolf absent, 2. The City Manager reported that all of the electrical work at the Central Fire Station had been satisfactorily completed according to the plans and specifications, and that payment could now be made to the Curtis Electrical Company on their final estimate in accordance with the resolution of the City Council at their meeting of June 19, 1938. Mr. Harry Kelly and several other interested citizens appeared before the Council and requested the Mayor to proclaim the period from July 15 to August 15 "National Salesman's Crusade" in order to stimulate buying among our citizens and in that way to create work for men, not only in Austin but in the manufacturing centers of our country. The Mayor stated that the Council was thoroughly in accord with the movement and would do everything in their power to help in this splendid program. Mr. John Butler appeared requesting permission from the City to buy sand and gravel from the City out of the 40-acre tract of land on the north side of the river which was acquired by the City from Mr. A.
