The City Council convened in regular session on November 23, 1938, at 10:30 A.Μ., for its first meeting in the new Municipal Building. As Thursday was Thanksgiving Day, the meeting was held on the Wednesday preceding. Mayor Miller presided at the meeting. The roll was called, and the following members answered present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; absent, none. The reading of the Minutes was dispensed with. Messrs. A. T. Knies and Walter E. Long, President and Secretary, respectively, of the Austin Chamber of Commerce, were present to extend congratulations to the City Council and the citizens of Austin upon the completion of the new Municipal Building, which, they declared, was made possible by the efforts of the City Council. Upon motion of Councilman Alford, Carl E. Vanlandingham, 207 East Third Street, was granted a license to operate as a taxi-cab a Plymouth Sedan, 1936 Model, Engine No. P2-477949, State Highway License No. 580752, by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, liayor Miller, and Councilman Wolf; nays, none. Upon motion of Councilman Alford, the following named persons were granted taxi-cab driver's permits: Raymond Cherry, 2512 San Gabriel Street; John Golden Farmer, 2620 Salado Street; and Virgil Henry Wingrouth, 219) Congress Avenue. 244 Councilman Gillis introduced the following resolutiont WHEREAS, Gabriel F. Thornhill, owner of Lot 35 of Enfield 0, a Subdivision within the City of Austin, Travis County, Texas, which property abuts the east side of Pense Road at a location north of Enfield Road, and being locally known as 1603 Pease Road, has made application to the City Council of the City of Austin for permission to construct a stone curb at the above described location; and WHEREAS, the ordinance which regulates the construction of ourbe upon or within streets in the City of Austin requires that anyone desiring to construct any curb other than a concrete ourb shall get special permission to do so from the City Council of the City of Austin; and WHEREAS, the City Council has investigated and approved the construction of a stone curb at the aforesaid location; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Gabriel F. Thornhill, owner of Lot 35 of Enfield 0, a Subdivision within the City of Austin, Travis County, Texas, which property abuts the east side of Pease Road at a location north of Enfield Road, and being locally known as 1603 Pease Road, is hereby granted permission to construct a stone curb at the above described location; provided, however, that said stone curb shall be constructed upon a concrete base and shall have an exposure of 8 inches above the gutter and shall be 10 inches wide at the top in accordance with the standard design for rock curbs as adopted by the City of Austin and as detailed upon the plan hereto attached marked 2-0-501, which plan is hereby made a part of this resolution; and further provided that all work shall be done by a bonded curb and sidewalk contractor and that said curb shall be constructed under the supervision of the City Engineer of the City of Austin and in accordance with lines and grades furnished by him. The foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, G11118, Mayor Miller, and Councilman Wolf; naye, none. Upon motion of Councilman Alford, the application of Mrs. Floree Haire to operate two additional taxi-cabs was granted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. Councilman Bartholomew introduced the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT, in order to more fully protect and safeguard the very valuable and irreplaceable records of the City Government stored in the basement of the Municipal Building from loss by fire, all city employees are hereby prohibited, under a severe penalty, from smoking while in said basement; and BE IT FURTHER RESOLVED: THAT the City Manager be, and he is hereby, directed to see that these instructions are complied with. The following resolution was introduced: WHEREAS, City of Austin taxes were assessed in the name of D. H. Caswell, for the years 1934, 1935, 1936, and 1937, on 95 feet on West Avenue back to the east line of property sold to the City of Austin, being east part of (D) (.997ac.), Outlot 9, Division "E", and on Lots 3 and 4, Block 5, Outlot 3, Division "0" Central Row, and on (A) 2.67 acres, C. J. Strother Survey 90-1, all in the City of Austin, Travis County, Texas, and also on personal property, said taxes amounting to the sum of $1294.65, and for non-payment of said taxes at maturity, penalty in the sum of $64.73 has been assessed, and interest in the sum of $158.82, making the total amount of taxes, penalty and interest, $1518.20; and WHEREAS, the City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $64.73, and one-half the interest, in the sum of $79.41, provided said taxes and one-half the interest thereon, in the sum of $1374.06, are promptly paid; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $64.73 and one-half the interest in the sum of $79.41 is hereby remitted, and the Tax Assessor and Collector of the City of Austin, Texas, is hereby authorized and directed to charge said penalty of $64.73 and one-half the interest in the sum of $79.41 off his rolls, and to issue to the party entitled to receive same a receipt in full on the payment of said taxes and one-half the interest, as aforesaid.
