SPECIAL MEETING OF THE CITY COUNCIL: i Austin, Texas, April 28, 1939. The City Council convened in special session, at the regular meeting place in the City Hall, on Friday, April 28, 1939, with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen Chas. F. Alford, C. M. Bartholomew, Simon Gillis, and Mayor Tom Miller; absent, Councilman Oswald G. Wolf. Councilman Bartholomew moved that the firm of Maxwell & Cox, Accountants, be employed to make monthly audits of all City accounts, for the total sum of $1500 per year. The motion prevailed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; nays, none; Councilman Wolf absent. Mayor Miller moved that the request of Dave Reed for a setback on Lot 8, Shoal Creek Boulevard, of 15 feet, instead of the required 25 feet according to the Zoning Ordinance, be granted for the reason that the lot is very irregular in shape and cannot be used unless this setback variation is allowed. The motion prevailed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller; nays, none; Councilman Wolf absent. Upon motion, seconded and carried, the meeting was recessed, subject to call of the Mayor. Approved: Jom milla. Mayor Attest: City Clerk. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; absent, none. Upon motion of Mayor Miller, the City Clerk was instructed to acknowledge, with thanks, the receipt of a beautiful basket of gladioluses from Mr. W. R. Nabours upon the occasion of the inauguration of the newly-elected City Council. Mayor Miller announced that the next order of business would be the installation of said newly-elected City Council. Judge A. L. Love, City Attorney, then administered the oath of office to Councilmen-elect Chas. F. Alford, C. M. Bartholomew, Simon Gillis, Tom Miller, and Oswald G. Wolf. The election of a Mayor and Mayor Pro Tem. for the ensuing two years was the next order of business. Councilman Gillis nominated Councilman Tom Miller as Mayor, to succeed himself. 525 526 The nomination was seconded by Councilman Bartholomew, and was confirmed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Wolf; nays, none; Councilman Miller present but not voting. Councilman Bartholomew nominated Councilman Oswald G. Wolf as Mayor Pro Tem., to succeed himself. The nomination was seconded by Councilman Gillis, and was confirmed by the following vote: Ayes, Councilmen Alford, Bartholomew, G1111s, and Mayor Miller; naye, none; Councilman Wolf present but not voting. The City Council then proceeded with the election of the following officers: Councilman Gillis nominated Judge J. W. Maxwell as Judge of the Corporation Court, to succeed himself. The nomination was seconded by Councilman Bartholomew, and was confirmed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. Councilman Gillis nominated Judge D. H. Doom as Assistant Judge of the Corporation Court, to act as Judge of said Court until such time as Judge Maxwell is able to resume his duties as such. The nomination was confirmed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. Councilman Wolf nominated Fred A. Griffith as Clerk of the Corporation Court. The nomination was seconded by Councilman G1111s, and was confirmed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. Councilman Gillis nominated 0. P. Bonner as Assistant Clerk of the Corporation Court. Councilman Wolf nominated Hallie McKellar as City Clerk. Councilman Gillis nominated Guiton Morgan as City Manager. The nomination was confirmed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; naye, none. Councilman Wolf nominated Dr. Ben M. Primer as Acting City Health Officer. The nomination was confirmed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. Councilman Gillis nominated Kurt R. Meyer as a member of the Board of Equalization for the two-year term beginning May 1, 1939, and ending May 1, 1941. The nomi- nation was confirmed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none.
