334 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, March 14, 1940. The City Council convened in regular session, at the roguar meeting place in the Council Room at the Municipal Building, on Thursday, March 14, 1940, at 10:50 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen Alford, Gillis, and Mayor Miller; absont, Councilmen Bartholomow and Wolf. The reading of the Minutes was dispensed with. Mr. S. G. Kingsbury presented a potition, signed by the owners of property adjacent to Pease Park, and residents who frequently enjoy the privileges of the park, asking that the barriers erected at each ond of East Drive be removed and the remaining barriers continued along the west side of said roadway to completoly inclose the playground area, The matter was taken under advisement. At the request of Mr. M. H. Crockett, et al., action on the proposed ordinance regulating tourist courte was postponed until the next regular moeting for a more thorough study of same. A group of unskilled laborors, with Harlan Armstrong, Leeroy Wier, Frank Lozana, and John M. Vasquez as spokesmon, came before the Council and registered a protest against the Negroes being given preference over the whites for unskilled labor employed on the Housing Authority's, projects. After hearing the complaint, the Council advised the group that the United States Government, and not the City of Austin, had jurisdiction in the matter. The written application of Dr. Z. T. Scott, owner, for a change in zoning of the past half of lot, formed by abandonment of Cole Street north from East 23rd Street, to "C" Commercial and Second Height and Area District, and of the west half of said lot to "A" Residence and First Height and Area Districts, was received, and the matter was referred to the Board of Adjustment for consideration and recommendation. The following ordinance was introduced by Councilman 01111s: AN ORDINANCE PERPETUALLY CLOSING AND VACATING THAT CERTAIN PORTION OF WEST FIFTEENTH STREET, OR NORTH AVENUE, IN THE CITY OF AUSTIN, LYING WEST OF WEST AVENUE AND HAST OF SHOAL CREEK BOULEVARD, AND RELINQUISHING ANY AND ALL INTEREST, RIGHT, TITLE OR CLAIM OF THE CITY OF AUSTIN IN AND TO SAID PORTION OF WEST FIFTEENTH STREET. The ordinance was read the first time and Councilman Gillis moved that the ordinance be passed to its second reading. The motion prevailed by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor Miller; nays, none; Councilmen Bartholomew and Wolf absent. The ordinance was then laid over for its second reading. Councilman Cillis moved that the contract for heating on the Austin-Travis County Tuberculosis Sanatorium, PWA Docket 2070-F, as awarded to Fox-Schmidt, Contractors, be accepted as completed in accordance with the plans and specifications for same, as recommended in the report of Engineers Seuholm and Kinney submitted by the City Manager. The motion was seconded by Councilman Alford, and the same prevailed by the following vote: Ayos, Councilmen Alford, Gillis, and Mayor Miller; nays, none; Councilmen Bartholomew and Wolf absent. Councilman Alford moved that Domingo Urias, 909 Miles Street, be granted a taxicab driver's permit, in accordance with the recommendation of the City Manager. The motion prevailed by the following vote: Ayes, Councilmen Alford, Gillis, and Mayor Miller; nays, none; Councilmen Bartholomew and Wolf absent. Councilman Alford moved that Louis Sconci, 407 East Eighth Street, he granted a taxicab driver's permit, in accordance with the recommendation of the City Manager. Williams, 106 West 17th Street, lo granted a taxicab driver permit, in accordance with the recommendation of the City Manager. The following resolution was introduced by Councilman Gillis: MHEREAS, Mr. A. J. Woohle is the Contractor for the crection and alteration of a building locuted at 1302 Colorado Street, and destros a portion of the sidewalk and alley space abutting the north part of Lots 2 and 3, Block 158, of the Original City of Austin, Travis County, Texas, during the erection and alteration of the building, such space to be used in the work and for the storage of materials therefor; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 1. THAT space for the uses hereinabove enumorated bo granted to said A. J. Woohle, the boundary of which is described as follows: Sidewalk and Alloy Working Space That the Contractor be permitted to block off sidewalk and alloy between his property and the triangular strip of ground wost of the State Capitol. This alley runs north and south and dead-ends at the alley which runs east and wost in Block 158. 2. THAT the above privileges and allotment of space are granted to the said A. J. Wochle, hereinafter tormed "Contractor," upon the following express terms and conditions: (1) That the Contractor shall construct a guard rail within the boundary line along the north, cast, and south lines of the above described space, such guard rail to be at least 4 fost high and substantially braced and anchored. (2) That the Contractor is permitted to construct in his working space a substantial gate, which shall be kept closed at all times when not in use, and at all times that such gate is opon, the Contractor shall maintain a person at this gato to warn pedestrians and vehicles of approaching trucks. This gate is not to open out so as to impode vehiculur or pedestrian traffic. (3) That no vehicles in loading or unloading material at the working space shall park on any part of the street outside of the allotted working space. (4) That "No Parking" signs shall be placed on the street side of the barricados. (5) That the Contractor is permitted to construct a temporary work office within such allotted working space provided such work office is not within 25 feet of any corner street intersection. (6) That the Contractor shall in no way obstruct any firo pluga or other public utilities in the constriction of such barricados. (7) That provisions shall be made for the normal flow of all storm waters in the cutter, and the Contractor will bo responsible for any damage done due to obstruction of any such storm water. (8) That the Contractor shall place on the outside corners of any walkway, barricadou or obstructions, red lights during all periods of darkness and provide 11ghting system for all tunnels. (9) That the Contractor shall remove all fonces, barricades, loose materials and other obstructions on the sidewalk and street immediately after the necessity for their existence on said sidowalk or street has coased, such time to bo determined by the City Manager, and in any event all such sidewalk, harricades, materials, oquipment, and other obstructions ahll be removed not later than August 1, 1940, (10) That the City reserves the right to revoko at any time any and all the privileges herein Granted, or to require the erection or installation of additional barriers or safeguards if the conditions demand it. (11) That the use and enjoyment of the spaces herein granted shall not be exclusive as against public needs, and the City, in making such grant, reserves the right to unter and occupy any part or all of said space any time with its public utilitics, or for other necessary public purposes. 335 336 (12) That any public utility, or public or private proporty, disturbod or injured as a rosult of any of the activities nocessary for the completion of the construction work for said building project, whether done by the Contractor, City forces, or public utilities, shall be replaced or repaired at the Contractor's oxpense. (13) That the Contractor shall furnish the City of Austin a suroty bond in the sum of One Thousand Dollars ($1,000.00), which shall protect, indemnify, and hold harmless the City of Austin from any claims for damages to any person or property that may accrue to or be brought by any porson by rouson of the oxercise of the privileges granted the Contractor by the City of Austin, and shall quarantee the replacement of all sidewalks, pavemont, and all other public property and public utilities disturbed or removed during the construction work, and shall further guarantee the construction of a walkway and other safeguards during the occupancy of the space. The following resolution was introduced by Councilman Alfords WHEREAS, Ed Lorey is the Contractor for the alteration of a building located at 906 Congross Avenue and desires a portion of the sidewalk space abutting Lot B of #2, Block &, of the Original City of Austin, Travis County, Texas, during the alteration of the building, such space to be used in the work and for the storage of materials therefor; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 1. THAT space for the uses horeinabove enumerated be granted to said Ed Lorey, the boundary of which is described as follows: Sidewalk Space Boginning at the southeast corner of the above described property; thence in an easterly direction at right angles to the centerline of Congress Avenue three feet to a point; thence in a northerly direction parallel with the centerline of Congress Avenue approximately twenty-three foot to a point; thonce in a westerly direction at right angles to the conterline of Congreвв Avenue to the northeast corner of the above described property. 2. THAT the above priviloges and allotment of space are granted to the said Ed Lorey, hereinafter tormed "Contractor," upon the following oxpress terms and conditions: (1) That the Contractor shall erect and maintain continuously in good condition during the use of said spaco hereby allotted a fence constructed solidly of 1" material and 8' high. Ho shall be permitted to construct a door within this fence to open inwardly and at all times that such gate is open for the purpose of bringing material to or from the job. The Contractor shall maintain a person at this door to warn pedestrians of any danger. That the Contractor shall be permitted to occupy two parking meter spaces in front of said proporty for the purpose of loading and unloading material during the construction of this work. (2) That the Contractor shall in no way obstruct any fire plugs or other public utilities in the construction of such barricades. (3) That provisions shall be made for the normal flow of all storm waters in the sutter, and the Contractor will be responsible for any damage done due to obstruction of any such storm water. (4) That the Contractor shall place on the outside corners of any walkway, barricades or obstructions, red lights during all periods of darimess and provide lighting system for all tunnels. (5) That the Contractor shall remove all fences, barricades, looso materials, and other obstructions on the sidewalk and stroot immediately after the necessity for their existence on said sidewalk or street has ceased, such time to be determined by the City Manager, and in any event, all such sidewalk, barricades, materials, equipment, and other obstructions shall be removed not later than May 1, 1940. The following resolution was introduced by Councilman Alford; WHEREAS, Toxas Public Service Company has prosented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therofore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is horoby, permitted to lay and construct its gus maine in and upon the following stroetus 1. A gas main in BRIDLE PATH westerly 186 foet from a point 34 feet west of Dillmun Street, the centerline of which cau main shall be 13 feet south of and parallel to the north property line of said Pridle Path. Said gas main described abovo shall have a covering of not loss than 2 feet. 2. A gas regulator pit in WEST 20TH STREET at Whitis Avenue, the center of which regulator pit shall be 9 feet south of and parallel to the north property line of caid Wost 20th Street. 3. A gas regulator pit in MITTIS AVENUE at West 20th Street, the contor of which rogulator pit shall be 9 foot west of and parallel to the cast proporty line of said Whitis Avonuo. 4. A gas main in TOWNES LAIVE from a point 90 feet west of Keating Lane casterly approximatoly 358 foot, the centerline of which gas main shall be 70 feet south of and parallel to the north proporty line of said Townes Lane. Said cas main described above shall have a covering of not loss than 2 foot. 5. A main in INDIAN TRAIL from Koating Iano woutorly 171 fout, the conterling of which Cas main shall be 7 feet south of and parallel to the north property line of suld Indian Tra11.. Said gas main described above shall have a covering of not loss than 2 fout. 6. A gue main in KEATING LANE from Indial Trail to Tormes Lane, the centerline of which ca main shall, bo 74 fout west of and parullel to the cast proporty line of sald Kouting Lunc. Saia sau main described above shall have a covering of not less than 2 foot. The Texas Public Service Company is hereby mit upon notice that the City of Anatia does not mar antee that the space assigned above is clear from other underground utilities, but is based upon the best recorde we have at hand, and that the minimum depth stated duou not have any reference to the fact that greater depthe may not be required at special points. Wher the Texas Public Servico Company requiros definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Toxas Public Service Company is further put 337 338 upon notice that they will bo required to hour the expense of repairs or replacement of any underground utility dumaged during the construction of linos named in this rosolution. AND THAT whonovor pavement is cut in the vicinity of a fire plug, water must bo used at intorvals during the course of backfilling of the ditchos. THAT the work and laying of naid cas mains, including the oxcavation in the streets, and the restoration and maintenance of cuid streets after said mains have been laid, shall bo under the supervision and direction of the City Managor, and undor all the portinent terme and conditions of the cortain franchise granted to said Company by the City of Austin. Upon motion of Councilman Alford, the foregoing resolution was adopted by the following vote: Ayes, Councilmon Alford, Gillis, Mayor Miller; naye, none; Councilmon Bartholomow and Wolf absent. The following resolution was introduced by Councilman 01111st BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves the erection of a roof over a commercial dock on the property of the lessee, Mr. W. W. Bennett, from the City of Austin, on the shore of Lako Austin, and hereby authorizes the said Mr. Bonnett to construct, maintain, and operate this commercial boat dock subject to same's boing constructed in compliance with all the ordinances relating thoroto, and further subject to the foregoing attached recommendations; and the Building Inspector is hereby authorized to issue an occupancy permit for the erection of a roof over a commercial dock after full compliance with all the provisions of this resolution. Said pormission shall be held to be granted and accepted, subject to all necessary, reasonable, and proper, present and future regu lations and ordinances of the City of Austin, Texas, in the onforcement of the proper police, fire, and health regulations, and the right of revocation is retained if, after hearing, it is found by the City Council that the said Mr. Dennett has failed and refused, and will continue to fall and refuse to perform any such conditions, regulations and ordinances. W. Dennott, the losone of a piece of property abutting on Lake Austin and owned by the City of Austin, for permission to erect a roof over his docka projecting out into the Lake. Wo recommend that Mr. W. W. Bennett bo granted pormission to orect roof over his docks with jout to the following conditionst 1. Thut nothing but creosoted piles and heavy tron bolte be used in the construction of this pier, dock or wharf. 1 2. That no business, such as a rostaurant, dance hall, concossion stand, or any othor enterprise for the sule of goods wares, and merchandise, excopt marine supplios and tacklo, and no living quarters of any character, shall be orccted on any pier, dock, Wharf, float, island, piling, or other structure extending into or above Lake Austin. 3. That evory structure shall be equipped with proper lights which show all around the horizon for night use, and chall be equipped with flags or othor warnings for daylight uso. The following rosolution was introduced by Councilman Alford: WHEREAS, the curb and sidewalk specifications of the City of Austin which have been previously adopted by the City Council of the City of Austin requtro that all curbs and sidowalks be constructed of concrete unless a special permit has been secured from the City Council of the City of Austin to construct curbs, sidowalks and rumps of other materials; and WHERFAS, A. N. McQuown, owner of Lot & and part of Lot 3, Block 6, Pemberton Heights Section 1, which property abuts the west sido of Jarratt Avenue at a location worth of West 24th Stroet and being locally known as 2416 Jarratt Avenue, has requested the City Council of the City of Austin to grant permission to construct a flagstone walk across the west sidewalk area from the curb line to tho proporty line at the above described location; and WIDEREAS, the City Council of the City of Austin has investigated and approved the construction of said flagstone walk; therofore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT A. N. Mequown, owner of Lot 8 and part of Lot 9, Block 6, Pemberton Heights Section 1, a subdivision within the City of Austin, Travis County, Texas, which property abuts the west side of Jarratt Avenue at a location north of West 24th Street, and being locally known as 2416 Jarratt Avenue, is hereby granted pormission to construct a flagstone walk from the proporty line to the curb line at the above described location, and said walk is to be constructed under the supervision and direction of the City Engineer of the City of Austin and in accordance with lines and grades furnished by the Engineering Department of the City of Austin, and further subject to the following conditions: That the stone shall be laid in a smooth and workmanlike manner and shall conform to the sidewalk grades and curb grades as given by the Engineering Department of the City of Austin in order that same will not create a hazard to pedostrians. That the stone shall be placed upon a 4" concrete base and that all work within the City stroots shall be done by a bonded sidewalk contractor and in accordance with the instructions and directions of the City Engineer of the City of Austin. Upon the suggestion of Mayor Miller, the Council designated the woek beginning Monday following Easter Sunday as "Clean-up Week," and instructed the City Manager to invite the Junior, and Sonior Chambers of Commerce and all civic clubs to participate, and to have the Sanitary Department do everything possible to make the undertaking a success. The following resolution was introduced by Councilman Alford: WHEREAS, City of Austin taxes were assessed in the name of Hamilton A. Reilly for the years 1931 through 1938, inclusive, on 58 x 93-2/31, Lot 5, N. 1/2 0/1 52, Division "D", Plat 149, in the City of Austin, Travis County, Texas, said taxes being for the sum of $443.31: and for non-payment of same 342 at maturity penalty in the sum of $22.19 has been assessed, and interest in the sum of $120.112, making the total amount of taxes, penalty and interest, $586.42; and WHEREAS, the 01 ty Council of the City of Austin deome it just and equitable to remit said penalty in the sum of $22.19; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty, in the sum of $22.19, is hereby remitted, and the Tax Assessor and Collector of the City of Austin is authorized and directed to charge said penalty, in the sum of $22.19, off his rolls and to issue to the party entitled to receive same a receipt in full upon the payment of said taxes as aforesaid. The following resolution was introduced by Councilman Alfords WHEREAS, Walter 3. Seaholm and Dexter C. Kinney, engineers designated to inspect and report on the Fox-Schmidt contract for the Tubercular Sanatorium, PMA Docket Texas-2070-7, have reported that the contract has now been completed in accordance with the plane and specifications; and WHEREAS, the City Manager concurs in this report and these officials of the City recommend acceptance of said contract and payment therefor; and WHEREAS, the City Council has studied said inspection report and recommendations and is of the opinion that same should be accepted; therefore BM IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT said contract and all work thereunder be and is hereby accepted and the City Hanager is hereby authorised and directed to approve the final estimates and issue warrants in payment therefor; and he is further authorised and directed to release the contractors from any further liability in connection with mid contract, except for such guarantees as are set forth in the plans and specifications pertaining to satisfactory material and workmanship, and to further authorise the cancellation of the contractor's bond.
