364 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, April 04, 1940. The Oity Council convened in regular session, at the regular meeting place in the Council Room at the Municipal Building, on Thursday, April 4, 1940, at 10:50 A. M., with Mayor Tom Miller presiding. Roll call showed the following members presents Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; absent, Councilman Wolf. The Minutes of the regular meeting of March 28, 1940, were read, and upon motion of Councilman G11118 were adopted, as read, by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Millert naye, none; Councilman Wolf absent. The following resolution was introduced by Councilman Gillist WHEREAS, heretofore by dedication of a plat as recorded in Book 4, page 46, of the Plat Records of Travis County, Texas, an easement for all public utilities of three feet on either side of the dividing lines and on all the back lines of all lots in Bryker Woode "O" Addition to the City of Austin, Travis County, Texas, was granted to the City of Austin; and WHEREAS, it has become apparent that the City of Austin does not now need or desire said easement in its entirety as provided for Bryker Woods "C", except as hereinafter specifically described; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorised and directed in the name of the City of Austin, Texas, to release and quitclaim to the owners of all lots in Bryker Woods "C" Addition to the City of Austin, Travis County, Texas, their heirs and successors, all the right, title, interest, claim and demand in and to the casement described by the dedication of said Bryker Woods "C" Addition, recorded in Book 4, page 46, of the Plat Records of Travis County, Texas, to which plat and dedication reference is here made for all purposes, SAVE AND EXCEPT the following specific easement which is specifically retained and not released by the City of Austint A11 casements along the back line of all lots in Bryker Woods "O" Addition to the Oity of Austin, Travis County, Texas; and all casements between Lots Nos, 19 and 20 in Block 1 of said Addition; and all easements between Lots Nos. 7 and 8 and between 19 and 20 in Block 2 of said Addition. Upon roll call, the resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, 01111s, and Mayor Miller; nays, none; Councilman Wolf absent. The written application of W. 8. Gatewood for a change in soning of the property at 302 East 17th Street, legally described as Lot No. 3, Block 57, Original Oity, from "B" Residence District to "0" Commercial District, was received; and the matter was referred to the Board of Adjustment for consideration and recommendation. The following resolution was introduced by Mayor Millers WHEREAS, the City of Austin, in conjunction with the County of Travis, by resolution of the City Council has heretofore entered into a preliminary agreement with the Federal Surplus Commodities Corporation providing for the establishment of the Food Stamp Plan in the City of Austin, Travis County; and WHEREAS, the United States Government has approved said tentative agreement and has designated the City of Austin and Travis County as an area in which the Food Stamp Plan will operate and has submitted to the City of Austin and Travis County final contract agreements entered into by the parties above referred to; and WHEREAS, said contract is considered to be satisfactory; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and is hereby authorised and directed to execute said contract and duplicates thereof, acting for and on behalf of the Oity of Austin, Texas. The following communication from J. F. Springfield, General Manager of the Austin Transit Company, successor to the Austin Street Railway Company, was receiveds "Austin, Texas Apr11 4, 1940 To the Honorable Mayor and City Couno11 City of Austin Austin, Texas Gentlement Relative to the extensions and changes on the south end of the Main Line, we beg to submit the route and schedule sheet for the Holly Street Line, which represents a new operations In addition to changes already submitted on the Main Line schedule, we are making these additional extensions and changes on the south end; To avoid congestion at First Street and Congress Avenue, we suggest that the Main Line buses turn east on Second Street from Congress Avenue to San Jacinto Street, south on San Jacinto Street to East First Street, and follow the former street car line out East First Street as far as Canadian Street, We believe the following extension will be expedients East on East First Street from Canadian Street to Pedernales Street; North on Pedernales Street to East Second Street; East on East Second Street to San Saba Street; South on San Saba Street to East First Street; West on East First Street over the outbound route to the Center of the City. Beginning February 8, 1940, the Holly Street Bus Line will operate: Beginning at 6th Street, south on Congress Avenue to Fifth Street; Fast on Fifth Street to East Avenue; South on East Avenue to Holly Street; East on Holly Street to Anthony Street; North on Anthony to Garden Street; East on Garden to Canadian Strest; South on Canadian to Holly. The following resolution was introduced by Councilman Alfords WHEREAS, the City Council has seen fit during past years to postpone the penalty on current taxes from April 1 until June 1; and 365 366 WHEREAS, it appears to the City Council that such a procedure in 1940 applicable to the 1939 taxes is advisable; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the 5% penalty on 1939 taxes, which are payable in 1940, be postponed until midnight of June 1, 1940. The postponment of said penalty does not waive the prescribed 6% interest charges, as all unpaid 1939 taxes will be charged 6% interest in accordance with the City Charter. The City Manager is hereby authorised and instructed to act in accordance with this resolution. Upon roll call, the foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; nays, none; Councilman Wolf absent. The following resolution was introduced by Councilman 0111ist WHEREAS, H. D. Ainsworth has offered to purchase a portion of the northeast corner of Outlot 61, in Division "B", of the City of Austin, Texas, located at the southwest intersection of Rosewood Avenue and Chicon Street, for the sum of Six Hundred Dollars ($600). Said location faces approximately sixteen feet (161) on Rosewood Avenue and is approximately forty-six feet (461) deep along Chicon Street, and is the remaining portion of the lot purchased by the City for the purpose of widening this street intersection; and WHEREAS, the Oity Council considers said price equitable; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and is hereby authorised to convey the unused part of this lot to H. D. Ainsworth for the consideration above stated. Upon roll call, the foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; nays, none; Councilman Wolf absent. The following resolution was introduced by Councilman Gillist BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves the erection of a loading platform in the sidewalk area on the Fourth Street side of the property situated at the northwest corner of the intersection of West Fourth Street and Nueces Street, which property is owned by O. G. Hanseler and Company and is designated as Lot 4, Block 37, of the Original Oity of Austin, Travis County, Texas, and hereby authorizes the said O. G. Hanseler and Company to construct and maintain said loading platform, subject to the same's being constructed in compliance with all the ordinances relating thereto, and further subject to the foregoing attached recommendations; and the Building Inspector is hereby authorized to issue a building permit for the crection of this loading platform after full compliance with all the provisions of this resolution, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of the proper polics, traffic and fire regulations, and the right of revocation is retained if, after hearing, it is found by the City Council that the said O. G. Hanseler has failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances. (Building Inspector's Recommendations attached) Mr. Guiton Morgan City Manager Austin, Texas Dear Sirs "Austin, Texas Apr11 4, 1940 We, the undersigned, have considered the application of 0. G. Hanseler and Company, through Olin Boase, agent, for permission to construct and maintain a warehouse with loading platform in the sidewalk area along West Fourth Street and situated at the northwest corner of the intersection of West Fourth Street and Nueces Street within the corporate limits of the City of Austin, Travis County, Texas, which property is known as Lot 4, in Block 47, of the Original City of Austin, and we hereby in advise that the following conditions exists The property upon which this warehouse is to be located is designated as "C-2" Commercial Use District, as shown upon the soning maps of the City of Austin. This neighborhood is essentially a warehouse district, in which a number of warehouses now exist with loading platforms extending out over the sidewalk area. We recommend that O. G. Hanseler and Company be granted permission to construct and maintain said loading platform on the sidewalk area on the Fourth Street side of the above described property subject to the following conditions: (1) That the plans as submitted be revised so as to provide for a set of steps on the west end of the loading platform, not less than 4 feet wide, and that the remaining ond of the platform be provided with a suitable handrail to prevent any one walking off same. (2) That all grades and lines for the curb in front of this property be constructed along the lines given and with the approval of the Engineering Department of the City of Austin. The following resolution was introduced by Councilman Alford: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in EXPOSITION BOULEVARD from a point 121 feet north of Clearview Drive, northerly 302 feet, the centerline of which gas main shall be 7 feet west of and parallel to the east property line of said Exposition Boulevard. Said gas main, described above shall have a covering of not less than 20 feet. (2) A gas main in MOUNTAIN VIEW ROAD, from a point 196 feet south of Gilbert Street, southerly 59 feet, the centerline of which gae main shall be it feet west of and parallel to the east property line of said Mountain View Road. Said gas main described above shall have a covering of not less than 2 feet. (3) A gas main in BRIDLE PATH from Exponition Boulevard easterly 315 feet, the conterline of which gas main shall be if fost south of and parallel to the north property line of said Bridle Path. Said gas main described above shall have a covering of not less than 20 feet/ (4) A gas main in FRENCH PLACE from East 30th Street northerly 167 feet, the centerline of which gas main shall be 1 foot west of and parallel to the east property line of said French Place. Said gas main described above shall have a covering of not less than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department notless than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. 74. 367 368 THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Upon roll call, the foregoing resolution was adopted by the following voter Ayes, Councilmen Alford, Bartholomew, 01111s, and Mayor Miller; nays, none; Councilman Wolf absent. The following resolution was introduced by Councilman Alfords WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps or plans showing the proposed construction of its pole lines in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its pole lines in the following streetss (1) A telephone pole line in KHATING LẠNH from Windsor Road to Indian Trail, the center1ine of which pole line shall be 8 feet west of and parallel to the east property line of said Keating Lane. THAT the work and construction of said pole line, including the excavation of the streets and the restoration and maintenance of said streets after said pole lines have been constructed, shall be under the supervision and direction of the City Manager and in accordance with the ordinances and regulations of the City of Austin governing such construction. Upon roll call, the foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; nays, none; Councilman Wolf absent. The following resolution was introduced by Councilman Bartholomew: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the Oity of Austin hereby approves the erection of commercial boat docks and boat slips on the property leased by Mr. D. T. Prade as described in the Travis County Deed Records, Volume 409, page 235, located approximately two miles above the Dam, near the mouth of Taylor slough, on the shore of Lake Austin, and hereby authorizes the said Mr. D. T. Prade to construct, maintain, and operate the boat docks and boat slips subject to same's being constructed in compliance with all the ordinances relating thereto, and further subject to the foregoing attached recommendations; and the Building Inspector is hereby authorized to issue an occupancy permit for the erection of these boat docks and boat slips after full compliance with all the provisions of this resolution. Said permission shall be held to be granted and accepted subject to all necesвагу, reasonable and proper, present and future, regulations and ordinances of the City of Austin, Teхав, in the enforcement of the proper police, fire and health regulations, and the right of revocation is retained if, after hearing, it is found by the City Council that the said Mr. D. T. Prade has failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances. T. Prade, the lessee of a piece of property abutting on Lake Austin, as recorded in the Travis County Deed Records, Volume 409, page 235, owned by Dr. Z. T. Scott, for permission to construct and maintain commercial boat docks and boat slips projecting out into the Lake, located approximately two miles above the Dam, near the mouth of Taylor slough. We recommend that Mr. D. T. Prade be granted permission to construct and maintain said commercial boat docks and boat slips, subject to the following conditions: (1) That the shed to be erected over the above mentioned boat slips be constructed in sections of not over 50 feet in length entirely separated from any other section. (2) That nothing but creosoted piles and heavy iron bolts be used in the construction of this pier, dook or wharf. (3) That no business, such as a restaurant, dance hall, concessions stand, or any other enterprise, for the sale of goods, wares and merchandise, except marine supplies and tackle, and no living quarters of any character, shall be erected on any pier, dock, wharf, float, island, piling, or other structure extending into or above Lake Austin. (4) That every structure shall be equipped with proper lights which show all around the horizon for night use and shall be equipped with flags or other warnings for daylight นธ. In keeping with the day to be celebrated throughout the Nation, and as an expression of the gratitude of the Oity of Austin for the services rendered the country by the National Guard, the Regular Army, and all other branches of military service, the Mayor was authorized to issue a proclamation, proclaiming SATURDAY, APRIL 6, as "ARMY DAY." The ordinance was read the first time and Councilman Gillis moved that the rules be suspended and the ordinance be passed to its second reading. The motion was seconded by Councilman Alford, and the same prevailed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; nays, none; Councilman Wolf absent. The ordinance was read the second time and Councilman G111is moved that the rules be further suspended and the ordinance be passed to its third reading. The ordinance was read the third time and Councilman G1111s moved that the ordinance be finally passed. The following ordinance was introduced by Councilman G111188 AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE ENTITLED "AN ORDINANCE REGULATING THE HEREOTION, CONSTRUCTION, ENLARGEMENT, ALTHERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, LOCATION AND MAINTENANCE OF BUILDINGS AND STRUCTURES IN THE OITY OF AUSTIN, THIXAS; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR; DECLARING AND ESTABLISHING FIRE DISTRICTS; PROVIDING PENALTIES FOR THE VIOLATION THERNOF; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH," WHICH WAS PASSED BY THE CITY COUNCIL APRIL 30, 1931, AND IS RECORDED IN BOOK "I", PAGES 387-536, INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, BY ADDING TO SECTIONS 1602 (b) AND 1603 (a) NEW SECTIONS REGULATING THE CONSTRUCTION OF OPEN LUMBER SHEDS IN THE CITY OF AUSTIN; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH AND EXPRESSLY REPRALING THAT ONRTAIN ORDINANCE PASSED BY THE CITY COUNCIL FEBRUARY 8, 1940, AND RECORDED IN BOOK "K", PAGES 601-602, or THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, AND DECLARING AN EMERGENCY.
