The City Council convened in regular session, at the regular meeting place in the Council Room at the Municipal Building, on Thursday, May 9, 1940, at 10:50 λ. Μ., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf; absent, Councilman Bartholomew. The following resolution was introduced by Councilman Gillis: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in SCHULLE AVENUE from Stevenson Avenue southerly 287 feet, the center1ine of which gas main shall be 7 feet west of and parallel to the east property line of said Schulle Avenue. Baid gas main described above shall have a covering of not less than 20 feet. (2) A gas main in SHOALWOOD AVENUE from a point 227 feet north of West 45th Street southerly 321 feet, the centerline of which gas main shall be 7 feet west of and parallel to the east property line of said Shoalwood Avenue. Said gas pain described above shall have a covering of not less than 20 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department notless than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the super- vision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the Oity of Austin. Upon motion of Councilman Gillis, the resolution was adopted by the following vote: Ayes, Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf; naye, none; Councilman Bartholomew absent. The following resolution was introduced by Councilman Wolfs WHEREAS, in October, 1929, the City of Austin entered into a contract with Q. C. Boatman for furnishing water on a certain line outside of the City limits of the City of Austin; and WHEREAS, this line is now in the area of the Travis County Water Control and Improvement District and same has been cancelled by virtue of the creation of said District and serving of customers in the District by water lines constructed by the District; and WHEREAS, Q. C. Boatman, W. E. Williamson, A. P. Campbell, S. W. Redd, S. W. Redd, Jr., and H. L. Presnell built a water line at their own expense for servicing their property and in consideration of the furnishing of water through said line and the maintenance of said line by the City of Austin conveyed the line to the City; and WHEREAS, said line is no longer needed to serve these and other persons subsequently connected to same; therefore BE IT RESOLVED BY THE CITY COUNCIL: THAT the Oity Manager be and is hereby authorised and directed to quitclaim and release to the original conveyors to said line above enumerated all right, title, and interest of the Oity of Austin to said line for the reasons above stated. Upon motion of Councilman Wolf, the resolution was adopted by the following vote: Ayes, Councilmen Alford, Gi111s, Mayor Miller, and Councilman Wolf; nays, none; Councilman Bartholomew absent. Raymond Brooks, representing the Lower Colorado River Authority, came before the Council and submitted a proposal that the Oity pay one-half the cost, amounting to $1950, of a neon sign to be placed on Lamar Park advertising the City of Austin as "The Gateway to the Lake Region." The matter was taken under advisement. The following resolution was introduced by Councilman Alfords WHEREAS, the taxes on Lot 19, Block 1, Outlot 14, Division "D" (Fruth), in the City of Austin, Travis County, Texas, was assessed in the name of the University Baptist Church for the year 1928 to 1939, both inclusive; and WHEREAS, said property was deeded to the University Baptist Church to be used as a parsonage; and WHEREAS, under all the circumstances, it is deemed equitable and advisable that the taxes against said property for the years 1931 to 1939, both inclusive, be charged off the rolls; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT T. B. Marshall, City Tax Assessor and Collector, is hereby authorised to charge off the tax rolls the assessment upon said real estate for the years 1931 to 1939, both inclusive, provided that the taxes, penalty and interest for the years 1928, 1929 and 1930 be paid on or before the 15th day of May, 1940. Upon motion of Councilman Alford, the resolution was adopted by the following vote: Ayes, Councilmon Alford, Gillis, Mayor Miller, and Councilman Wolf; nays, none; Councilman Bartholomew absent. The following resolution was introduced: WHEREAS, Oity of Austin taxes were assessed in the name of John C. Butler for the years 1936 to 1939, both inclusive, on Lote 1 and 2, Block 5, Outlots 41, 42, 53, Riverview; Lot 12, Block 2, Outlots 41, 42, 53, Riverview; Lot 7, Block 14; Lot 5, Block 5, Outlots 23, 24, Fairgrounds; Lot 1, Block 2, Travis Heights, Oity of Austin, Travis County, Texas; together with personal property, in the City of Austin, Travis County, Texas, said taxes being for the sum of $653.94; and for non-payment of same at maturity penalty in the sum of $22.72 has been assessed, and interest in the sum of $53.31, making the total amount of taxes, penalty and interest $729.97; and WHEREAS, the Oity Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $22.72, and one-half of the interest in the sum of $26.65; therefore "ו BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $22.72, and one-half of the interest in the sum of $26.65, are hereby romitted, and the Tax Assessor and Collector of the City of Austin is authorized and directed to charge said penalty in the sum of $22.72, and one-half of the interest in the sum of $26.65, off his rolls and to issue to the party entitled to receive same a receipt in full upon the payment of said taxes and one-half of the interest, as aforesaid. E. Martin, located at the northeast corner of West Live Oak and South First Streets, more particularly described as Lot 1, Block 3, Davis & Dawson Addition of the City of Austin, Texas, which was continued from the last regular meeting, was continued to the next regular meeting. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen Alford, Gillis, Mayor Miller, and Councilman Wolf; absent, Councilman Bartholomew. The Minutes of the regular meeting of May 9, 1940, were read, and upon motion of Councilman Alford, were adopted, as read, by the following vote: Ayes, Councilmen Alford, G1111s, Mayor Miller, and Councilman Wolf; nays, none; Councilman Bartholomew absent. A public hearing on the proposed amendment to the Plumbing Ordinance was called for the next regular meeting, Thursday, May 23. The application of Roland R. Freund for a change in soning of the property at the southeast corner of the intersection of 34th Street and Shoal Oreek Drive, said property facing 143.42 feet on 34th Street and 162.82 feet on Shoal Oreek Drive, from Residential to "C" Commercial, was received; and the matter was referred to the Board of Adjustment for consideration and recommendation. The application of W. E. Thompson for a change in zoning of Lots 31, 32, and 33, of N. A. Ladd Addition, said property fronting 115 feet on the Lower Georgetown Road and facing Capitol Court Street, from "0" Commercial to "C-2" Commercial, was received; and the matter was referred to the Board of Adjustment for consideration and recommendation. A petition asking for the closing of the alley running through Block 1 of Tobin & Johnson's Addition, extending from Schulle Street to Pecos Street, between Enfield Road and Bonnie Road, signed by Iline Cameron, et al., property owners, was received. A petition protesting the closing of the aforementioned alley, signed by A. C. Cade, et al., was received, also.
