520 REGULAR MENTING OF THE CITY COUNCIL: Austin, Texas, September 05, 1940. The City Council convened in regular session, at the regular meeting place in the Council Room at the Municipal Building, on Thursday, September 5, 1940, at 10:30 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; absent, NONE. The Minutes of the regular meeting of August 29 were read, and upon motion of Councilman Alford, were adopted as read by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. G. H. Kinney and other property owners on Kinney Avenue appeared before the Council and asked that the work of paving said street be started at once, as a majority of the property owners had agreed to deposit their pro rata of the cost of same. The matter was referred to the City Engineer for further attention. A large delegation of property owners from South Austin, with W. I. Kocurek, President of the South Austin Civic Club, as spokesman, appeared before the Council and petitioned for the paving of the streets in South Austin, particularly Bouldin Avenue, all of the property owners on said street, except one, having agreed to pay their pro rata of the cost, and for legislation to compel property owners to pay for paving other than permanent paving. After considerable discussion, the mattor was referred to the City Engineer and the City Attorney, with instructions that the work of paving Bouldin Avenue be started before January 1, 1941, if all the other property owners deposit their part of the cost; and that an assessment be levied against the property in question and the matter carried to court as a test case, if necessary. The City Engineer was instructed to prepare a list of the paving jobs pending and those that have been completed since the first of the year, and submit same to the Council weekly. J. C. Barnes, property owner, petitioned the Council for the paving of Nowning Avenue; and he was advised that if all the property owners on said street would deposit their part of the cost, the work would be done. Raymond Canion appeared before the Council and registered a protest against the proposed policy of restricting bids on Brackenridge Hospital construction to local contractors. R. E. Janes, Contractor, and C. A. Schutse, representing local contractors, et al., were heard in support of such policy. and Nurses' Home It was then moved by Councilman Wolf that bide on Brackenridge Hospital 'construction be restricted to local contractors, with the further restriction that such contractors shall not sublet contracts to out-of-town contractors, but may, under same circumstances, sublet same to local contractors if they so desire. The motion prevailed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, nono. W. R. Smith, Attorney for Albert Crumplin, Colored, submitted a request for free medical services and hospitalisation for his client in the performance of an operation of his knee as a result of injuries received while in the employ of the City. It was the sense of the meeting that the request be granted, but that no further financial aid be given. The City Engineer submitted to the Council samples of designs for street markers to be installed. It was the sense of the meeting that the design showing the lettering in red orange on a white background be selected on account of its similarity to the University of Texas colors and its visibility at night. The following ordinance was introduced by Councilman Alford: 521 AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE ENTITLED "AN ORDINANCE REGULATING TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF AUSTIN, PRESCRIBING PENALTIES FOR THE VIOLATION OF SAME, REPHALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND DECLARING AN EMERGENCY," WHICH ORDINANCE WAS PASSED BY THE CITY COUNCIL MAY 6, 1937, AND IS RECORDED IN BOOK "X", PAGES 159-179, INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, BY PROHIBITING PARKING AT ALL TIMES IN THE ALLEY RUNNING LAST AND WEST IN THE 800 BLOCK OF SAN JACINTO STREET AND BRAZOS STREET; REPHALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND DECLARING AN EMERGENCY. The ordinance was read the first time and Councilman Alford moved that the rules be suspended and the ordinance be passed to its second reading. The motion was seconded by Councilman Wolf, and the same prevailed by the following vote: Ayes, Councilmen Alford, Bartholomew, 011118, Mayor Miller, and Councilman Wolf; nays, none. The ordinance was read the second time and Councilman Alford moved that the rules be further suspended and the ordinance bo passed to its third reading. The motion was seconded by Councilman Wolf, and the same prevailed by the following vote: Ayes, Councilmen Alford, Bartholomew, G11118, Mayor Miller, and Councilman Wolf; nays, none. The ordinance was read the third time and Councilman Alford moved that the ordinance bo finally passed. The Mayor declared the ordinance finally passed. It was moved by Councilman Alford that the application of Leo Jack Wright, 4811 Avenue F, for license to operate a taxicab be granted, in accordance with the recommendation of the City Manager. It was moved by Councilman Alford that the application of Herman Owens, 65 Cross Street, for license to operate a taxicab be granted, in accordance with the recommendation of the City Manager. Councilman Bartholomew moved that the following application for license to oporate a commercial hoat on Lake Austin be approved, subject to the approval of same by the Lake Austin Navigation Board: Name and Address of Applicant Disch, W. J., Jr. 2606 Woodmont Description of Boat (Demonstrator) The motion was seconded by Councilman Alford, and the same prevailed by the following votes Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; naye, none. The following resolution was introduced by Councilman Bartholomew: WHEREAS, the United States Congress has recently enacted, and the President has signed, legislation authorizing the President to call officers and men of the National Guard and organized reserves to active service in the army, navy and marine corps of the United States; and 1. 522 WHEREAS, there is pending in the Congress, and the Congress will in all probability onact, a selective service law providing for compulsory service in the armed forcos of the United States of a selected class of registrants between the ages of 21 and 31; and WHEREAS, the City Council recognizes the responsibility of employers toward omployees who may be called away from their jobs for such service, and further is cognizant of the fact that the proposed selective service law provides for the reemployment of men inducted into military service by this process; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City, as a governmental agency and an employer, directs that all men called to active duty, whether in the National Guard, the organized reserves, or through selective service, shall be notified that their positions will be temporarily filled during their period of active service and that upon completion of such service they will be reemployed in their positions when they are released from the service in the military forces of the government. This must, of course, be conditional upon the fact that such men upon their discharge from the military service be in sound mental and physical condition and as well qualified to perform the duties of the job involved as they were when they were granted the leave of absence for the purpose of serving in the United States army, navy, or marine corps. Upon motion of Councilman Bartholomew, the resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, G1111s, Mayor Miller, and Councilman Wolf; nays, none. Walton Lee Harris, 601 Henderson Street, submitted an appeal on the denial of his application for a license to operate a taxicab by the Chief of Police and the City Manager. The matter was referred to the Chief of Police for reconsideration to determine whether applicant should be granted a probational license.
