REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, November 27, 1940. The City Council convened in regular session, at the regular moeting; place in the Council. Room at the Municipal Building, on Wednesday, November 27, 1940, At 10:40 A. ::., preceding the Thanksgiving Holiday, with Mayor Tom Miller presiding. Roll call showed the following mombers present: Councilmon Alford, Bartholomew, Gillis, Mayor Miller, and Councilmen Wolf; absent, none. The Minutes of the special meeting of November 15, and the regular meeting of November 20, 1940, were road, and upon motion of Councilman Alford, were adopted as read by the following vote: Ayes, Councilmon Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; najs, none. Councilman Alford nominated Dr. Harold Wood as City Health Officer of the City of Austin, to Berve during the absence of Dr. Ben M. Primer, City Health Officer, who is on leave of absence for military service. The nomination was seconded by Councilman Gillis, and the same was confirmed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none, absent, none. The oath of office as City Health Officer of the City of Austin was then administered to Dr. Harold Wood by City Attorney O'Quinn. Councilman Alford moved that the application of Claud Allen Mauldin, Route 2, Box 420-0, for a Taxicab Driver's Permit be granted, in accordance with the recommandation of the Acting City Managor. The motion provailed by the following vote: Ayer, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. Councilman Alford moved that the application of Russell Mustin Lewis, Jr., 2407-2, Sabine Street, for a Taxicab Driver's Permit be granted, in accordance with the recommendation of the acting City Manager. The motion prevailed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. Councilman Alford moved that the application of Hanford Morris, 302 Wost 17th Street, for a Taxicab Driver's Permit be granted, in accordance with the recommendation of the Acting City Manager. The motion prevailed by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilmen Wolf; naye, none. Councilman Bartholomew moved that the application of C. H. Barfield, 110 West Sixth Street, for a license to operate a private boat on Lake Austin be granted, subject to the approval of same by the Lake Austin Navigation Board. The notion prevailed by the following votot Ayen, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; naye, none. The following resolution was introduced by Councilman Gillis: WHEREAS, Texas Public Service Company has presented to the City Council tentative mapa or plane showing the proposed construction of its gas mains in the streets in the City of Amstin horeafter named, and said mape or plane lave leon considered by the City Cormeil; therefor PE I'M RESOLVED BY THE CITY COMICIL OF THE CITY OF AUSTIN; THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its Cha maine in and on the following strootss (1) A gus main in EAST 13TH STREET from a point 209 feet enst of San Bernard Street westorly 42 feet, the centerline of which as main shall be 22 feet north of, and parallel to, the south property line of said East 13th Street. Said gas main described above shall lave a covorin, of not less than 2 foct. (2) A as nain in COLE STREET from a point 265 feet south of East 30th Street southerly 170 feet, the centerline of which gas main shall be 7; feat west of, all parallel to, the cast property line of said Cole Street. : Said gas main described above shall have a covering of not less than 2 feet. (3) A gas mein in BERTETT AVENE from a point 262 feet north of East 6th Street, southerly 29 feet, the centerline of which gus main shall to 7. feat west of, and parallel to, the east property line of said Eennett Avenue. 605 606 Said gus main described above shall have a covering of not less than 2 foot. (4) A sam main in GRISWOLD LAVE from Sharon Lane castorly 164 foet, the centerline of which gus main shall be 74 feet south of, and parallel to, the north property line of enid Griswold Lane. Said Gas main described above shall have n covering of not loss than 2 foot. (5) A gas main in SHARON LANE from Griswold Lano northerly 25 feet, the centerline of which gas main shall be one foot west of, and parallel to, the cast property line of said Sharon Lane. Said gas main described above shall have a covering of not less than 2 foot. (6) Agus main in WEST AVENUE from West 12th Street northerly 350 feet, the centerline of which gas main shall bo 13 fost east of, and parallel to, the wost property line of Raid Wort Avenue. Said gas main described above shall have a covering of not less than 2 fest. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not loss than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to hear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the rostoration and maintenance of said streets after said mains have been laid, shall be under the supervis- ion and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Upon motion of Councilman Gillis, the foregoing resolution was adopted by the following vote: Ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. Councilman Gillis moved that the date for hearing appeals of taxpayers from the decision of the Board of Equalization on property valuations for the year 1940 be set for Thursday, December 19, 1940, at 7:30 P. ; that notice of such hearing be had by publication three times in the daily newspapers; and that the Tax Assessor and Collector be instructed to send written notices of such hearing to all protestants. The motion prevailed by the following voto: Ayes, Councilmen Alford, Bartholomow, Gillis, Mayor Miller, and Councilman Wolf; nays, none. It was the sense of the meeting that the regular meeting of the City Council for Thursday, December 26, 1940, be held on Tuesday, December 24, 1940, instead. The City Attorney was instructed to secure an abstract of title to property of the Butler Estate for the Lamar Boulovard right-of-way. Upon motion, odd coreled, the meeting VAR PUNCHROL at 11:10.
