450 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, December 24, 1941. The City Council convened in regular session, at the regular meeting place in the Couno11 Chamber at the Municipal Building, on December 24, 1941, at 10:00 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; absent, none. Thursday being Christmas Day, the meeting was held on Wednesday preceding. The Minutes of the regular meeting of December 18, and the special meeting of December 19, 1941, were read, and upon motion of Councilman Alford, were adopted as read, by the following votes ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; naye, none. In accordance with published notice thereof, the public hearing on the Budget of the City of Austin for the year 1942 was opened. No taxpayers or other interested citizens requesting to be heard at such hearing, the hearing was ordered closed. Councilman Wolf then offered the following resolutions WHEREAS, the tentative Budget of the City of Austin, Texas, for the year 1942 has been prepared by the City Manager and presented to the City Council, and the same was filed with the City Clerk for public inspection on November 22, 1941; and WHEREAS, a public hearing on said budget was held in the City Council Chamber at the City Hall at 10 o'clock A. M., on the 24th day of December, 1941, after due notice of said time and place, at which hearing the taxpayers of the City of Austin were given the opportunity to be present and participate in such hearing; and WHEREAS, said hearing was finally closed on said date; therefore, BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the said tentative Budget of the City of Austin for the year 1942 be and the same 10 hereby adopted, and the amounts set out respectively in said budget be and they are hereby respectively appropriated for the respective purposes and out of the funds respectively shown in said budget, in so far as same may be done by law at this time. Upon motion of Councilman Wolf, the foregoing resolution was adopted by the following voter ayes, Councilmen Alford, Bartholomew, Gi111s, Mayor Miller, and Councilman Wolf; nays, none.: The following ordinance was introduced by Councilman 011116: AN ORDINANCE FIXING AND LEVYING MUNICIPAL TAXES FOR THE CITY OF AUSTIN, TEXAS, FOR THE YEAR A. D. 1941, AND DEOLARING AN EMERGENCY. The ordinance was read the first time and Councilman 01111e moved that the rules be suspended and the ordinance be passed to its second reading. The motion prevailed by the following votes ayes, Councilmen Alford, Bartholomew, 01111s, Mayor Miller, and Councilman Wolf; nays, none. The ordinance was read the second time and Councilman Gillis moved that the rules be further suspended and the ordinance be passed to its third reading. The motion prevailed by the following vote: ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. The ordinance was read the third time and Councilman Gillis moved that the ordinance be finally passed. The motion prevailed by the following votes ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. The Mayor then announced that the ordinance had been finally passed. The following resolution was introduced by Councilman Bartholomews 451 WHEREAS, the City Tax Assessor and Collector has heretofore submitted to the City Council the tax roll of the City of Austin for the year 1941; and WHEREAS, said tax roll appears in all respects to be in correct form, and prior to its submission, the valuations contained in said roll had been examined and corrected by the Board of Equalization, which has made its report to the City Council; and WHEREAS, said roll was on November 20, 1941, approved, subject to those adjustments which might be found proper upon hearing of appeals from the decision of the Board of Equalization to the 01ty Council; and WHEREAS, all appeals from the decisions of the Board of Equalization have been disposed of, and no adjustments have been found necessary; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT said tax roll, showing an aggregate amount of $72,420,930 valuation of property assessed for taxes for said year, and an aggregate amount of $1,641,688.73 levied as taxes for said year, be and the same is hereby approved. Upon motion of Councilman Bartholomew, the foregoing resolution was adopted by the following Vote: ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; naye, none. The Mayor called up for its third reading, the following ordinance: AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF AUSTIN AND THE ANNEXATION OF CERTAIN ADDITIONAL TERRITORY CONSISTING OF ONE HUNDRED AND EIGHTY-FIVE AND 89/100 (185.59) ACRES OF LAND, BEING A PORTION OF THE THOMAS HAWKINS SURVEY AND THE J. C. HARRELSON SURVEY WITHIN TRAVIS COUNTY, TEXAS, WHICH SAID ADDITIONAL TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF AUSTIN, IN THE PARTICULARS STATED IN THE ORDINANCE. The ordinance was read the third time and Councilman Alford moved that the ordinance be finally passed. The motion was seconded by Councilman Gillis, and the same prevailed by the following voter ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. The Mayor then announced that the ordinance had been finally passed. The following resolution was introduced by Councilman Alfordi WHERRAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, ९ BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following streetst (1) A gas main in WINDSOR ROAD from Vista Lane to Bremen Street, the centerline of which gas main shall be 13 feet south of, and parallel to, the north property 11no of said Windsor Road. Said gas main described above shall have a covering of not less than 2) fest. (2) A gas main in WINDSOR ROAD from Keating Lane westerly 395 feet, the centerline of which gas main shall be it feet south of, and parallel to, the north property 1ino of said Windsor Road. Said gas main described above shall have a covering of not less than 20 feet. : Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depthe may not be required at special pointe. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground 452 utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the rostoration and maintenance of said streets after anid mains have been laid, shall be under the supervis- ion and direction of the Oity Manager, and under all the portinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Upon motion of Councilman Alford, the foregoing resolution was adopted by the following vote: ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; naye, none. The Mayor laid before the Council for its second reading, the following ordinances AN ORDINANCE REGULATING THE STORAGE, SELLING, TRANSPORTATION, TRANSFERRING, AND HANDLING OF EXPLOSIVAS WITHIN THN CORPORATE LIMITS OF THE CITY OF AUSTIN, AND WITHIN THE AREA LYING 5000 THET OUTSIDE SUCH CORPORATE LIMITS; PRESCRIBING LICENSES FOR PERSONS SELLING, HANDLING, TRANSPORTING OR EXCHANGING EXPLOSIVES, AND PRESCRIBING REGULATIONS FOR THE PROTECTION OF PUBLIC WORKS, BUILDINGS, HIGHWAYS, RAILROADS, AND UTILITY FACILITIES AND SERVICES WITHIN THE CITY OF AUSTIN AND WITHIN ITS POLICE JURISDICTION; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, BUT MAKING THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES OR PARTS OF ORDINANCES NOT IN CONFLICT; PROVID- ING A SAVING SECTION; PRESCRIBING PENALTIES; AND DECLARING AN EMERGENCY, The ordinance was read the second time and Councilman Wolf moved that the rules be suspended and the ordinance be passed to its third reading as amended. The motion was seconded by Councilman Alford, and the same prevailed by the following votes ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; naye, none. The ordinance was read the third time and Councilman Wolf moved that the ordinance be finally passed. The Mayor then declared the ordinance finally passed. Upon motion, seconded and carried, the meeting was adjourned to January 8, 1942, unless an emergency should arise.
