REGULAR MEETING OF THE CITY COUNCIL: : Austin, Texas, March 12, 1942. The City Council of the City of Austin convened in rogular session, at the regular mooting place in the Council Chamber at the Municipal Building, on Thursday, March 12, 1942, at 10:20 Λ.Μ., with Mayor Tom Miller presiding. Roll call shoved the following members prosent: Councilmen Alford, Bartholomow, G1111s, Mayor Miller, and Councilman Wolf; absent, none. The Minutes of the regular mooting of March 5, 1942, woro read, and upon motion of Councilman Alford were adopted as read by the following votes ayes, Councilmon Alford, Bartholomew, Gi1110, Mayor Miller, and Councilman Wolf; паув, попо. The application of Mrs. Della Wheeler, & State School for the Blind, for a taxicab liconse Vas submitted. Councilman Alford moved that the application be granted, in accordance with tho recommendation of the City Manager. The motion prevailed by the following vote: ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Millor, and Councilman Wolf; nays, nono. The following application for a private boat license was submitted: Name and Addreus of Applicant Leet, William 361.1 Lako Austin Blvd Description of Doat Home-made, Inboard, 1942 Model, Plymouth, "Bidol", 4-passongor Councilman Bartholomew moved that the application be granted, subject to the approval of the Lako Austin Navigation Board. The motion prevailed by the following vote: ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. A group of citizens residing in the 10-mile area around Austin came before the Council. and registered a protest against the light rates, alleging failure on the part of the City to grant the light rate reduction scheduled for this year, and asking that they be put on the CRA service. Following the discussion, the Mayor informod the group that it is the purpose of the City eventually to grant such light rate reduction when and if conditions permit, and cited the romolution passed by the City Council on February 12, 1942, regarding the matter. W. E. Seaholm, Superintendent of Utilities, was thon instricted to make a study of the matter to see what the difference in dollars and conte is betweon the City and the CRA rates in the 10-milc area. Mayor Millor presented Mrs. Imogone Grumblos with a h-Star Emblem of Honor pin, bestowed upon her by a patriotic organization in New York for the distinction of having four sons in the Navy and a husband in the Army. The following resolution was introduced by Councilman Alford: WHEREAS, Texas Public Service Company has presented to the City Council tontative mape or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considored by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in WEST 38TH STREET from Avenue"B" to Home Lane, the centerline of which gas main shall be 72 feet south of, and parallel to, the north property line of eaid West 38th Street. Said gas main described above shall lave a covering of not less than 2 feet. (2) A gas main in EAST 12TH STREET from Hechos Street to Red River Street, the centerline of which gas main shall bo 73 feet south of, and parallel to, the north property line of said East 12th Street. Said gas main described above shall have a covering of not less than 2 foot. The Texas Public Service Company is hereby put upon notice that the City of Austin does not : cuarantee that the apuco assigned above 18 clour from other underground utilities, but in based 553 554 upon the best records we have at hand, and that the minimum depth stated does not have any roforence to the fact that greater depths may not be required at special points. When the Texas Public Service Company requiros definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will bo required to bear the expense of repairs or replacement of any underground utility damaged during the construction of linen named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Upon motion of Councilman Alford, the foregoing resolution was adopted by the following vote: ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, nono. The following resolution was introduced by Councilman Bartholomew: WHEREAS, the Southwestern Bell Tolephone Company has presented to the City Council tentative maps or plans showing the proposed construction of its underground conduits in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: : THAT the Southwestern Bell Telephone Company be, and the same is hereby, permitted to construct its underground conduits in the following streets: (1) An underground conduit in LAMAR BOULEVARD from Barton Springs Road to West Fifth Street, the centorline of which conduit shall bo 20 feet west of, and parallel to, the centerline of said Lamar Boulevard. (2) An underground conduit in WEST 5TH STREET from Lamar Boulevard to Bowie Street, the conterline of which conduit shall be 5 feet south of, and parallel to, the north line of said West 5th Street. THAT the work and construction of said conduits, including the excavation in the streets and the restoration and maintenance of said streets after said conduits have been constructed, shall be under the supervision and direction of the City Mannger, and in accordance with the ordinances and regulations of the City of Austin governing such construction. Upon motion of Councilman Bartholomew, the foregoing resolution was adopted by the following vote: ayes, Councilmon Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nayo, none. The application of Dixon Moore Harper, 601 West 14th Street, for a permit to drive a taxicab was submitted. Councilman Alford moved that the application be granted, in accordance with the recommendation of the City Manager. The motion provailed by the following vote ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. The application of William Leroy Wilson, 705 Trinity Street, for a permit to drive a taxicab was submitted. Council.man Alford moved that the application be granted, in accordance with the recommendation of the City Manager. The motion prevailed by the following vote: ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. The City Manager submitted a budget for the operation of the Robert Mueller Airport for the nine and onc-half months ending December 31, 1942. Councilmen Wolf moved that the budget as prosented by the City Manager be adopted. The motion prevailed by the following vote: ayes, Council- men Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. C. Cross as manager of the Robert Mueller Airport. The following resolution was introduced: WHEREAS, City of Austin taxos were assessed in the name of C. B. King Funeral Home for the years 1937, 1938, 1939, and 1940 on Luts 12, 13, and 14, Block 4, Outlot 2, Division "A", and personal property for the years 1931 through 1940, said taxes being for the sum of $655.30; and for non-payment of same at maturity, penalty in the sun of $32.79 has been assessed, and interest in the sum of $114.28 has accrued, making the total amount of taxes, penalty and interest the sun of $302.87; and WHEREAS, the City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $32.79 and ono-half of the interest in the sum of $57.14; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $32.79 and ono-half of the interest in the sum of $57.14 are hereby remitted, and the Tax Assessor and Collector of the City of Austin is authorized and directed to charge said penalty, in the sum of $32.79, and one-half of the interest, in the sum of $57.14, off his rolls, and to issue to the party entitled to receive samo a receipt in full upon the payment of said taxes and one-half of the interest, as aforesaid. Upon motion, the foregoing resolution was adopted by the following vote: ayes, Councilmen Alford, Bartholomow, Gillis, Mayor Miller, and Councilman Wolf; nays, none.
