570 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, April 02, 1942. The City Council of the City of Austin, Texas, convened in regular session, at the regular mooting place in the Council Chamber at the Municipal Building, on Thursday, April 2, 1942, at 10:25 A. M., with Mayor Tom Miller presiding. Roll call showed the following members presents Councilmen Alford, Bartholomew, G1111s, Mayor Miller, and Councilman Wolf; abeent, none. The Minutes of the regular meeting of March 27, 1942, wore read, and upon motion, adopted by the following votet ayes, Councilmen Alford, Bartholomew, 0111is, Mayor Miller, and Councilman Wolf; naye, none. In accordance with published notice thereof, at 10:30 A. M., the Mayor announced that bids for $300,000.00 to $600,000.00 Airport Bonds, Series 1942, would then be opened, and asked if there were any bidder's present who had not submitted their bids. The following resolution was introduced by Councilman Alfords WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps or plans showing the proposed construction of its underground conduits in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore DE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be, and the name is hereby, permitted to construct ite underground conduits in the following streetst (1) An underground telephone conduit in EAST 9TH STREET from Congress Avenue alley to Brazos Street, the centerline of which underground conduit shall be 25 feet south of, and parallel to, the north line of said East 9th Street. The following resolution was introduced by Councilman 011liss 572 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the following described tract of land owned by the City of Austin, a municipal corporation, situated in Travis County, Texas, be and the same is hereby set aside and dedicated for use as a public street and thoroughfare in the City of Austin, said tract being described as followes Two and sixteen one-hundredths (2.16) acres of land, the same being a portion of the Thos. L. Hawkins Survey No. 9 in Travis County, Texas, and being out of and a part of that certain 100-acre tract or parcel of land conveyed to the City of Austin by J. M. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Clerk be, and she is hereby, authorized and directed to file this resolution in the office of the County Clerk of Travis County, Texas, giving notice to the public of the dedication for street purposes of the tract of land hereinabove described. Upon motion of Councilman Gillis, the foregoing resolution was adopted by the following votes ayes, Councilmen Alford, Bartholomew, G1111s, Mayor Miller, and Councilman Wolf; nayo, none. A petition, signed by Annie L. Kuse, et al., protesting the granting of a permit for a beer tavern at 1200 East 6th Street, was received. The matter was referred to the City Attorney, with instructions that the application be not granted, said location being within 300 feet of a church. Mayor Miller submitted a telegram roceived from Henry Morgenthau, Jr., Secretary of the Treasury, announcing the sale of $1,500,000,000.00 of Treasury Certificates of Indebtedness on Monday, April 6, at par and 1/2% interest, maturing in six months; and offering the City of Austin an opportunity to invest some of its accumulated funde if it so desires. The matter was referred to the City Manager, with authorization to invest some of the City's funds if in his judgment he thinks it advisablethe matter being left entirely to his discretion. The following resolution was introduced by Councilman Wolf: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS: THAT the sum of $1500.00 be, and the same is hereby, appropriated out of the General Fund, not otherwise appropriated, for the purpose of installing hot and cold showers, and other improvements, at Rosewood Park. Upon motion of Councilman Wolf, the foregoing resolution was adopted by the following voter ayes, Councilmen Alford, Bartholomew, 01111s, Mayor Miller, and Councilman Wolf; nays, none. It was the sense of the Council that all City employees wishing to attend roligious services on Good Friday be given time off for the occasion. It was the sense of the Council that the penalty date on taxes for the year 1941 be postponed to June 1, 1942, with the proviso that those taxpayers who take advantage of this extension wi11 not be allowed the three days of grace on interest effective April 1st. The following resolution was introduced: WHEREAS, Oity of Austin taxes were assessed in the name of Leslie Warren for the years 1938, 1939, and 1940, on Lot 1, Block 1, Outlot 62, Division B, College Heights Annex, said taxes being for the sum of $30.21; and for non-payment of same at maturity, penalty in the sum of $1.50 has been assessed, and interest in the sum of $3.61 has accrued, making the total amount of taxes, penalty, and interest the sum of $35.32; and WHEREAS, the City Council of the City of Austin, deems it just and equitable to remit said penalty in the sum of $1.50 and one-half of the interest in the sum of $1.81; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $1.50 and one-half of the interest in the sum of $1.81 are hereby remitted, and the Tax Assessor and Collector of the City of Austin is authorized and directed to charge said penalty in the sum of $1.50 and one-half of the interest in the sum of $1.81 off his rolls, and to issue to the party entitled to receive same a receipt in full upon the payment of said taxes and one-half of the interest, as aforesaid. The City Council of the City of Austin, Texas, reconvened at three o'clock in an afternoon session of its Regular meeting on April 2, 1942, at the regular meeting place in the Council Chamber at the Municipal Building, with Mayor Tom Miller presiding. The Ordinance was read the first time and Councilman Gillis moved that the rules be suspended and the Ordinance be placed on its second reading. Mayor NIGHT SESSION OF THE REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, April 2, 1942. The City Council reconvened at 8:00 P. M., April 2, 1942, in the Council Chamber at the Municipal Building, with Mayor Tom Miller presiding. Roll call showed the following members presents Councilman Gillis, Mayor Miller, and Councilman Wolf; absent, Councilmen Alford and Bartholomew. The Mayor stated that the meeting was called for a public hearing on the pending Solicitation Ordinance and an Amendment to the Plumbing Ordinance passed October 11, 1934, and then declared the meeting open to discussion. No one appearing either for or against the Solicitation Ordinance, the matter was ordered laid on the table until the next regular meeting. Judge Ike D. White, attorney, and other representatives of the Texas Public Service Company were present and plead for the amendment to the Plumbing Ordinance which would allow the gas company to install water heaters, declaring that the provision of the present ordinance requiring that gas fitters also pass a plumber's oxamination was working a hardship on gas fitters, and further cited the action of the United States Government and the courts in recognizing the water heater as a gas appliance. A group of plumbers appeared and protested that provision of the amendment to the Plumbing Ordinance which would allow the gas company to install water heaters, declaring that the water heater is a plumbing fixture rather than a gas appliance, and as such should be installed by a licensed plumber. Councilman Alford offered the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of $5,137.50 be, and the same is hereby, appropriated out of the General Fund, not otherwise appropriated, for the purpose of employing five additional men to operate the three cruising cars in the Fire Department from April 15, 1942, to the end of the year. This will be at the rate of $110 for three months: $120 for three monthet and $135 for two and a half months, or a total of $5.137.50.
