A group of plumbers appeared and protested that provision of the amendment to the Plumbing Ordinance which would allow the gas company to install water heaters, declaring that the water heater is a plumbing fixture rather than a gas appliance, and as such should be installed by a licensed plumber. There being no protests against the other provisions of the amendment to the Plumbing Ordinance, and no one else requesting to be heard, the meeting was then recessed, subject to call of the Mayor, without further action by the Counc11. The City Council of the City of Austin convened in regular session, at the regular meeting place in the Council Chamber at the Municipal Building, on Thursday, April 9, 1942, at 10:30 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen Alford, Bartholomew, G11118, Mayor Miller, and Councilman Wolf; absent, none. The Minutes of the regular meeting of April 2, 1942, including the Afternoon and Night Sessions, wore read, and upon motion of Councilman Alford, were adopted as read by the following votes ayon, Councilmen Alford, Bartholomew, G1111s, Mayor Miller, and Councilman Wolf; naye, none. Councilman Alford offered the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of $5,137.50 be, and the same is hereby, appropriated out of the General Fund, not otherwise appropriated, for the purpose of employing five additional men to operate the three cruising cars in the Fire Department from April 15, 1942, to the end of the year. This will be at the rate of $110 for three months: $120 for three monthet and $135 for two and a half months, or a total of $5.137.50. Upon motion of Councilman Alford, the foregoing resolution was adopted by the following votes ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; naye, none. Councilman Gillis offered the following resolution: WHEREAS, in Book 3, page 119, of the Plat Records of Travis County, Texas, there appears a map or plat of a subdivision of land known as Castle Court; and WHEREAS, upon said map or plat there is delineated a street, alley, or roadway designated as Castle Court; and 577 578 WHEREAS, Mrs. Samuel Spears, who resides in this said nubdivision, and who gives her address at 1102 Castle Court, has protested to Mr. Robert Thompson, the owner of the property designated as Castle Court; and WHEREAS, the said Robert Thompson doon not reside in Travis County, Texas, and has placed this request from his tenant, Mrs. Spears, in the hands of his local representative, namely, Harrison-Wilson Company of Austin, Texas, and the said Harrison-Wilson Company has requested the City Council of the City of Austin to change the name of said Castle Court to that of Oastle Hill, for the reason that much confusion is caused among those seeking to locate people residing on the said Castle Court, and among delivery services, in general; and WHEREAS, the said request has been reviewed and considered by the City Council of the City of Austin, and it has been determined that the said Castle Court is near enough in line with the southerly prolongation of Castle Hill to be considered on oxtension of Castle Hill, in so far as the naming of the public passageway is concerned; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTINS : THAT that street designated as Castle Court, as shown upon a map or plat of a subdivision of land known as Castle Court, as recorded in Plat Book 3, page 119, of the Plat Records of Travis County, Texas, be known and designated hereafter as CASTLE HILL. Upon motion of Councilman Gillis, the foregoing resolution was adopted by the following vote: ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; naye, none. Councilman Bartholomew offered the following resolution: WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the Oity of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following streetsi A gas main in HOLLY STREWT from a point 282 feet west of Chalmers Avenue westerly 49 feet, the centerline of which gas main shall be 26 feet south of, and parallel to, the north property line of said Holly Street. Said gas main described above shall have a covering of not less than 20 feet. The Texas Public Service Company is hereby put upon notice that the Oity of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department notless than three (3) days before such information is required. The Texas Public Service Company 18 further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines namod in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervis- ion and direction of the City Manager, and under all the pertinent terme and conditions of the certain franchise granted to said Company by the City of Austin. Upon motion of Councilman Bartholomew, the foregoing resolution was adopted by the following vote: ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; nays, none. Councilman Gillis offered the following resolution: WHEREAS, the Oity Council has decided to provide lower domestic water rates to consumers residing within the corporate limits of the City of Austin for a six monthe period; namely, for water con- sumption between April 1 and October 31, 1942 (dependent upon billing dates), for the purpose of furthering the Victory Garden program and the further beautification of the City; and WHEREAS, it is the intention of the City Council that this reduction shall be made only to those water consumers whose use shall be strictly for residential purposes, and is not effective for commer cial purposes; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTINS THAT the City Manager be, and he is hereby, authorized and directed to make effective on all water readings within the corporate limite of the City of Austin, Texas, for all water consumers whose use is strictly for residential purposes, as of April 1 to October 31, 1942, a reduction of 10% from the gross bill on amounts from $1.00 to $3.00 inclusive, there being no reduction on any amount less than $1.00; a reduction of 20% from gross bill on amounts between $3.01 and $6.00, inclusive; a reduction of 25% on grose bill on amounts above $6.00; all amounts of water used in excess of 250,000 gallons per month to be billed net on the regular rate. Upon motion of Councilman Gillis, the foregoing resolution was adopted by the following vote: ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; noys, none. Dr. Lora M. Lee came before the Council and asked that the City contribute $100 per month to the salary of a nutritionist and equipment for the Nutrition Advisory Clinic. The matter was taken under advisement. The application of A. H. Swanson, W. C. Schulle, Melete Numbers, and Emily Numbers for a change in zoning, from "B" Residence District to "O" Commercial District, of the entire block on Rio Grande Street facing went between 12th and 13th Streets, and extending back enst 138 feet on both West 13th and West 12th Streets, and south from West 12th Street to the alley, was received; and the matter was referred to the Board of Adjustment for consideration and report. The City Manager submitted a request from the South Austin Civic Club, asking that the water for the Stacy Swimming Pool be supplied from the City's mains instead of from the artesian well, due to the fact that the high temperature of the latter makes it undesirable for swimming.
