612 The Ordinance was read the third time and Councilman Bartholomew moved that the Ordinance be finally passed. The motion was seconded by Councilman Alford, and the same prevailed by the following votet ayes, Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; naye, none. The Mayor announced that the Ordinance had been finally passed. Upon motion, seconded and carried, the meeting was recessed at 11:30 A. M., subject to call of the Mayor. The City Council convened in regular session, at the regular meeting place in the Council Chamber at the Municipal Building, on May 22, 1942, at 11:00 A. M., with Mayor Pro Tem. Wolf presiding, the meeting having been held on Friday instead of Thursday, the regular meeting day, at the request of the Mayor Pro Tem. Roll call showed the following members present: Councilmen Alford, Bartholomew, Gillis, and Mayor Pro Tem. Wolf; absent, Mayor Miller. The Minutes of the regular meeting of May 14, 1942, were read and upon motion of Councilman Alford were adopted as read by the following votet ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Pro Tem. Wolf; naye, none; Mayor Miller absent. The following resolution was introduced by Councilman Gi111st BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager, or Acting City Manager, be, and he is hereby, authorized and directed, in behalf of the City of Austin, to execute a correction deed to Mrs. R. B. Fairbanks to the following described property: Lot No. 3, in Block 11, Outlot 32/33, Division "B", Glenwood Addition to the City of Austin, Travis County, Texas. Upon motion of Councilman Gillis, the resolution was adopted by the following vote: ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Pro Tem. Wolf; nays, none; Mayor Miller absent. Councilman Bartholomew offered the following resolution and moved its adoptions WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps or plans showing the proposed construction of its underground conduits in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; 613 therefore; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be, and the same is hereby, permitted to construct its underground conduits in the following streetss (1) An underground conduit in CONGRESS AVENUE from Ist Street south one block, the centerline of which conduit shall be 16 feet west of, and parallel to, the east line of said Congress Avenue. (2) An underground conduit in CONGRESS AVENUE across Colorado River Bridge, the center line of which conduit shall be 21.3 feet east of, and parallel to, the centerline of said Congress Avenue, (3) An underground conduit in SOUTH CONGRESS AVENUE from Congress Avenue Bridge to Miller Street, the centerline of which conduit shall be 29 feet east of, and parallel to, the centerline of said South Congress Avenue. (4) An underground conduit in SOUTH CONGRESS AVENUE from Miller Street to East Monroe Street, the centerline of which conduit shall be 49.5 feet east of, and parallel to, the centerline of said South Congress Avenue. (5) An underground conduit in POST ROAD from East Live Oak Street south two blocks, the centerline of which conduit shall be 30 feet east of, and parallel to, the west property line of said Post Road. (6) An underground conduit in POST ROAD at South Congress Avenue intersection, the centerline of which conduit shall be 5 feet east of, and parallel to, the east curb line of said Post Road. (7) An underground conduit in POST ROAD from South Congress Avenue to Havana Street, the centerline of which conduit shall be 50 feet east of, and parallel to, the centerline of said Post Road. THAT the work and construction of said conduits, including the excavation of the streets and the restoration and maintenance of said streets after said conduits have been constructed, shall be under the supervision and direction of the City Manager, and in accordance with the ordinances and regulations of the City of Austin governing such construction. The motion was seconded by Councilman Alford, and the same prevailed by the following vote: ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Pro Tem. Wolf; nays, none; Mayor Miller absent. The following resolution was introduced by Councilman Alford, who moved its adoptions WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plane showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct ite gas main in and upon the following streets A gas main in BRYKER DRIVE, from West 34th Street southerly 136 feet, the center1ine of which gas main shall be 72 feet west of, and parallel to, the east property line of said Bryker Drive. Said gas main described above shall have a covering of not less than 20 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depthe may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. 614 THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. The motion was seconded by Councilman Gillis, and the same prevailed by the following vote: ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Pro Tem. Wolf; nays, none; Mayor Miller absent. The motion was seconded by Councilman Alford, and the same prevailed by the following vote: ayes, Councilmen Alford, Bartholomew, Gillis, and Mayor Pro Tem. Wolf; nays, none; Mayor Miller absent. The following communication from the School Board was receiveds "Austin, Texas May 21, 1942. Honorable Tom Miller, Mayor, and Members of the City Council, Austin, Texas. Gentlemens I wish to notify you that at a meeting of the Austin School Board held May 19, 1942, it was unanimously voted to request you to set the school maintenance tax rate for the next year at sixty-two cents ($.62) on the one hundred dollars' valuation of property, the same as for the present year. : Yours very truly, (Signed) Russell A.
