REGULAR MEETING OF THE CITY COUNCIL: Austin, Toxnn, August 27, 1942 The City Coumil convened in regular session, at the regular meeting place in the Council. Chamber at the Municipal Building on Thursday, August 27, 1942, at 10:25 A. M., with Mayor Tom Millor presiding. Roll call showed the following members present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; absent, NONE. There were present also: Acting City Manager Seaholm, City Engineer Motheral, City Attorney O'Quinn, Assistant City Attorney Randle, and Chief of Police Thorp. The Minutes of the regular meeting of August 20, 1942, were rond, and upon motion of Councilman Alford, were adopted as read by the following votet "ayes," Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; "nays," none. The application of James Franklin Bryant, Star Route A, for a taxicab driver's permit, approved by the Acting City Manager, was submitted. Councilman Alford moved that the permit be granted. The motion prevailed by the following votet "ayes," Councilmen Alford, Bartholomew, 011118, Mayor Miller, and Councilman Wolf; "nayв," попе. The application of Joe Eugene Jordan, 300 Congress Avenue, for a license to operate as a taxicab a Ford Sedan, 1941 Model, Motor No. 5946904, State License No. 4-363, approved by the Acting City Manager, was submitted. The application of Horace Werth Platt, 300 Congress Avenue, for a license to operate an a taxicab a Chevrolet Sedan, 19h1 Model, Motor No. AA499025, State License No. 1113-934, approved by the Acting City Manager, was submitted. Councilman Wolf moved that the application be approved. The motion prevailed by the following votet "ayes," Councilmen Alford, Bartholomew, Gillin, Mayor Miller, and Councilman Wolf; "naya," none. The application of Roy Valesques for a taxicab terminal operator's license for Roy'a Taxi Servico, 1005 East 6th Street, approved by the Acting City Manager, was submitted. Councilman Alford moved that the application be approved. The motion prevailed by the following vote: "nyes," Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; "nays," none. The application of V. R. Moore for a taxicab terminal operator's license for Moore Taxi Service, 214 Congress Avenue, approved by the Acting City Manager, was submitted. Councilman Alford moved that the application be approved. The motion prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; "nays," none. The Mayor announced that the public hearing on the proposed ordinance promulgating and adopting rules and regulations for the operation of the City Market would now be opened. There being no one present who wished to be heard on the matter, Councilman Wolf thereupon introduced the following 37 38 ordinancet AN ORDINANCE PROMULGATING AND ADOPTING RULES AND REGULATIONS GOVERNING THE CITY MARKET OF THE CITY OF AUSTIN, TEXAS, AND DEFINING "CITY MARKET"; CREATING THE OFFICE OF MARKET MASTER AND PROVIDING FOR THE ADMINISTRATION OF THE CITY MARKET BY THE MARKET MASTER; PRESCRIBING PENALTIES; PROVIDING A SAVING CLAUSE; REPHALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY The Ordinance was read the first time and Councilman Wolf moved that the rules be suspended and the Ordinance be placed on its second reading. The motion was seconded by Councilman Alford, and the same prevailed by the following votes "ayes," Councilmen Alford, Bartholomew, 0111is, Mayor Miller, and Councilman Wolf; "nays," none. The Ordinance was read the second time and Councilman Wolf moved a further suspension of the rules and the placing of the Ordinance on its third reading. The motion was seconded by Councilman Alford, and the same prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; "nays," none. The Ordinance was read the third time and Councilman Wolf moved that the Ordinance be finally passed. The motion was seconded by Councilman Alford, and the same prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; "nays," none. The Mayor then declared the Ordinance had been finally passed. A letter from Dr. Lora M. Lee relative to the employment of a food technologist was received and ordered filed. Acting City Manager Seaholm reported to the Council that he had received notification from the War Production Board that the City of Austin's application for materials for the construction of a hangar at the Municipal Airport, at an estimated cost of $17,000, had been given a preference rating. Councilman Gillis then offered the following resolutions BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of Seventeen Thousand Dollars ($17,000) be, and the same is hereby, appropriated out of the General Fund, not otherwise appropriated, for the purpose of constructing a hangar at the Municipal Airport. Upon motion of Councilman Gillis, the foregoing rosolution was adopted by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; "naya," none. Mr. John Puryear appeared before the Council and requested permission to reconstruct a building under a non-conforming setback Height and Area regulation, located at the corner of Holly and Canadian Streets. The matter was referred to the Board of Adjustment for disposition. Councilman. Wolf offered the following resolutions WHEREAS, the City of Austin, by a certain conveyance dated October 10, 1939, and recorded in Book 633, pages 18 et seq., of the Deed Records of Travis County, Toxan, acquired from the Lower Colorado River Authority certain electric distribution properties, including easements, licenses, and rights of way within a zone represented by an area ten miles wide, extending around the corporate limits of the City of Austin, as such limits existed at the end of the year 1937; and WHEREAS, a portion of said properties is within the Del Valle Air Support Comand Base, acquired by the United States Government and the City of Austin, and developed by the United States Government as an airport for use of the armed forces of the United States; and WHEREAS, the City Council deems it advisable and for the best interests of the City of Austin and of this Nation to release by appropriate instrument all right, title, and interest of the City of Austin in and to the easements, licenses and rights of way lying within the area now occupied by the Del Valle Air Support Command Base; therefore, 39 39 DE IT RESOLVED DY THE CITY COUNCIL OF THE CITY OF AUSTINS THAT the City Manager, or in his absence the Acting City Manngor, be, and he is hereby, authorized and directed to execute in behalf of the City of Austin an appropriate instrument roleasing to the United States Government all right, title, and interest in and to the ensements, licenses, and rights of way lying within the boundaries of the Del Valle Air Support Command Baso for the duration of the present war and for six months thereafter, and by such instrument, the City Manager, or the Acting City Manager, shall, in behalf of the City of Austin, agree not to exercise any rights or privileges within the boundaries of the Del Valle Air Support Command Baso under and by virtue of the easemonts, licenses, and rights of way acquired by the City of Austin from the Lower Colorado River Authority for the duration of the war and for six months thereafter. Upon motion of Councilman Wolf, the foregoing resolution was adopted by the following vote: "ayов, " Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; "nnys," none. The application of Orbie Eulila Wheeler, 1306 Congress Avenue, for a taxicab driver's permit, previously recommended for denial by the City Manager, was submitted. It was moved by Councilman Wolf that the permit be granted on a 30-day probationary basis, subject to revocation in the meantime for traffic law violation; and it was further moved that the applicant be required to report to the Chief of Police at the expiration of the 30-day period, and if it is shown at that time that his record is satisfactory, the permit may be extended for ninety days. The motion prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; "nays," none. The matter of the appointment of a City Attorney to serve during the absence of City Attorney Trueman E. O'Quinn if and when the said Trueman E. O'Quinn is called into active military service came up for discussion. It was the sense of the meeting that the appointment of Gibson R. Randle, Assistant City Attorney, to be Acting City Attorney, as submitted by Acting City Manager Seaholm, be approved. A committee of women from the Negro Community Welfare Association, with Dr. Mary E. Branch as spokesman, came before the Council and submitted a written request for the appointment of a police woman for the Negroes because of (a) undesirable conditions broughtabout by increased civil population; and (b) war-time social activities. After a discussion of the matter, it was the sense of the Council that no Negro police woman bo employed at this time, but that as soon as a desirable site for the new park for Negroes can be found, the same be built and a director appointed, who would be under the direction of the Recreation Department, with police powers to help enforce order there, or elsewhero whenever needed.
