REGULAR MEETING OF THE CITY COUNCIL: 57 57 Austin, Texas, October 01, 1942 The City Council convened in regular session, at the reguler moeting place in the Council Chamber at the Municipal Building, on Thursday, October 1, 1942, nt 10:00 A. M., with Mayor Tom Miller presiding. Roll call showed the following members presents Councilmen Alford, Bartholomew, Gillin, Mayor Miller, and Councilman Wolf; absent, none. There were present also: Acting City Manager Sonholm, City Engineer Mothoral, and Acting City Attorney Rondle, The Minutes of the regular meeting of September 24, 1942, were rund, and upon motion of Councilman Alford, were adopted as read by the following vote: "ayen," Councilmen Alford, Bertholomew, Gillin, Mayor Miller, and Councilman Wolf; "nnys," none. Mrs. R. J. Johnson came before the Council on behalf of the Govalle citizens and submitted a request for bus service to this locality on the basis of at least two busses per day. The matter was taken under advisement with the Austin Transit Company to find out if the extension to Del Valle Air Base nuthorized by the Office of Defense Transportation could be re-routed to include Govalle. The following applications for private boat licenses were submitted: Name and Address of Applicant Darcy, H. B. Darcy, H. B. 2003 Sharon Lane 2003 Sharon Lane Description of Bont Helton Klinker, Outboard, 1939 Model, Evenrude, 3-passenger Home-made, Outboard, 1937 Model, Evenrude, 3-passenger Councilman Bartholomew moved that the applications be granted, subject to the approval of the Lake Austin Navigation Board. The motion prevailed by the following vote: "ayen," Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; "anys," none. The application of Walter Owens, 300 Congress Avenue, for a liconse to oporate as a taxienb a 1941 Model, 4-door Chevrolet Sedan, Motor No. AA56169, State License No. 172-114, approved by the Acting City Manager, was submitted. Councilman Alford moved that the amplication be granted. The motion was seconded by Councilman Wolf, and the same prevailed by the following vote: "nyes," Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; "uays," none. The application of Herman Ivy Birkes, 3800 Block on East Ist Street, for permit to drive a taxicab, Approved by the Acting City Manager, was submitted. Councilman Alford moved that the application be granted. The motion was seconded by Councilman Wolf, and the same prevailed by the following votet "nyes," Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; "nays," none. The application of James Arthur Cole, 505 East 39th Street, for a permit to drive a taxicab, approved by the Acting City Manager, was nubmitted. Councilman Alford moved that the application be Cranted. The motion was seconded by Councilman Wolf, and the same provailed by the following votot "nyen," Councilmen Alford, Bartholomew, Gillin, Mayor Millor, and Councilman Wolf; "nayn," none. Councilman Gillis offered the following resolutiont (RESOLUTION) WHEREAS, Texna Public Service Company has presented to the City Council tentative maps or plane showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its Ans mains in and upon the following streets: (1) A gas main in WEST 38TH STREET from Guadalupe Street east 176 feet, the centerline of which gas main shall be 7.5 feet south of, and parallel to, the north property line of snid West 38th Street. 58 5 Said gas main described above shall have a covering of not less than 2 feet. (2) A (as main in GUADALUPE STREKT from West 38th Street north 12 feet, the conterline of which gos main shall be 7.5 feet west of, and parallel to, the onst property line of said Gundalupe Street. Said gas main described above shall have a covering of not less than 2 feet. (3) A gan main in WEST 38TH STREET across Guadalupe Street intersection, the centerline of which gas main shall be 12 feet north of, and parallel to, the north property line of West 38th Street. Said gas main described above shall have a covering of not less than 20 feet. (4) A gas main in WABASH AVENUE from West 37th Street south 101 feet, the centerline of which gaa main shall be 11 feet west of, and parallel to, the east property line of said Wabash Avenue. Said gas main described above shall have a covering of not less than 2 feet. (5) A gas main in WABASH AVEMUN across West 37th Street intersection, the centerline of which gas main shall be 2 feet east of, and parallel to, the onst property 1ine of said Wabash Avenue. Said gas main described above shall have a covering of not less than 20 feet. (6) A gas main in WEST 37TH STREET across Wabash Avenue intersection, the centerline of which gas main shall be 10 feet north of, and parallel to, the south property line of said West 37th Street. Said gas main described above shall have a covering of not less than 20 feet. The Texas Public Service Company is heroby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department notless than three (3) days before such information is required. The Texas Public Service Company 18 further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Upon motion of Councilman Gillis, the forogoing resolution was adopted by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; "nnys," none. The following resolution was introduced by Councilman Wolf: WHEREAS, the Austin Transit Company has applied to the City Council of the City of Austin for authority to eliminate, skip, or change certain of its bus stops in the City of Austin in order to Conserve gasoline and equipment, including its automobile tiren; and WHEREAS, such application was made in accordance with a request from the Federal Office of Defense Transportation to the Austin Transit Company; and WHEREAS, it appears to be to the public interest to permit the Austin Transit Company to put said changes into effect on a trial basis: now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Austin Transit Company be, and it is hereby, authorized and directed to put into effect on Tuesday, October 6, 1942, the proposed bus stop changes, in accordance with a list thereof submitted to and considered by the City Council, such list being dated September 22, 1942, and marked "Exhibit A", and consisting of twenty-five pages, it being understood that if, after a reasonable trial has been 59 59 given to such changes, any of anme are found to be not to the public interest, the City Council retaine and reserves the power to make further ordern in regard to "nmo. THAT the Austin Transit Company be, and it is heroby, further authorized and directed to give reasonable notice to the public of much changes in a general way through the newspapers of the City of Austin, and by placing markers at the new stops and removing markers from stops eliminated. THAT the City Clerk be, and she is hereby, nuthorized and directed to place the said Exhibit "A" in the permanent files of her office without the necessity of recording the contents of neid Exhibit in the Minutes of the City Council. Upon motion of Councilman Wolf, the foregoing resolution was adopted by the following vote: "ayes," Councilmon Alford, Bartholomew, 0111is, Mayor Millor, and Councilman Wolf; "nayn," none. The following resolution was introduced: WHEREAS, City of Austin taxes were ansonsed in the name of John W. Burney for the years 1920 through 1926 and 1930 through 1941 on Lots 4, 5, 9, 10, 11, and 12, Block 13, Outlot 32, 33, Division B, Glenwood, City of Austin, Texas, said taxes being for the sum of $2.73.30, and for non-payment of same at maturity, penalty in the sun of $13.66 has been assessed, and interest in the sum of $174.47, making the total amount of taxes, penalty and interest, $461.43; and WHEREAS, the City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $13.66, and a portion of the interest in the amount of $171.74; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the aforesaid penalty in the sum of $13.66 and a portion of the interest in the amount of $171.74 are hereby romitted, and the Tax Assessor and Collector of the City of Austin is authorized and directed to charge-Raid penalty in the sum of $13.66 and a portion of the interest in the sum of $171.74 off his rolls, and to issue to the party entitled to receive name a receipt in full upon the payment of said taxes and. the remaining portion of the interost, as aforesaid. Upon motion, the foregoing resolution was adopted by the following vote: "ayen," Councilmen Alford, Bartholomew, Gillis, Mayor Miller, and Councilman Wolf; "nays," none.
