REGULAR MENTING OF THE CITY COUNCIL: 1 89 Austin, Texas, December 10, 1942 The City Council convened in regular session, at the regular meeting place in the Council Chamber at the Municipal Building, on Thursday, December 10, 1942, at 10:55 A. Μ., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen Alford, Bartholomew, G1111s, and Mayor Miller; absent, Councilman Wolf. There were present also: Acting City Manager, Walter E. Seaholm: Acting City Attorney, Gibson R. Randle; and City Engineer, J. E. Motheral. The Minutes of the regular meeting of December 3, 1942, were read, and upon motion of Councilman Alford, were adopted as read, by the following voter "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. Councilman Bartholomew offered the following resolutions (RESOLUTION) WHEREAS, Walter E. Seaholm, Acting City Manager, has reported that the furnishing of kitchen and cafeteria equipment at Brackenridge Hospital has been completed and installed in accordance with the plans, specifications and contract agreement by the John Van Range Company; and 1 WHEREAS, The City Council is of the opinion that the equipment should be finally accepted; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT said equipment and installation are hereby accepted, and the Acting City Manager is hereby authorised and directed to pay the final estimate, including all authorised change orders. Upon motion of Councilman Bartholomew, the foregoing resolution was adopted by the following vote: Mayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. Councilman Gillis offered the following resolution: (RESOLUTION) WHEREAS, On the 16th day of December, 1941, the City of Austin entered into a contract with. the Neptune Meter Company for the purchase of a certain number of meters; said contract to expire one year from said date; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager, or in his absence the Acting City Manager, is hereby authorised and directed, for and in the name of the City of Austin, to extend said contract for a period of one year from the 16th day of December, 1942, such extension to be upon such terms as the City Manager, or in his absence the Acting Oity Manager, may deem advisable; and in the event he has already found it necessary or expedient to make said extension, his act in so doing is hereby in all things ratified and confirmed. Upon motion of Councilman Gillis, the foregoing resolution was adopted by the following votes "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The following application for a license to operate a private boat was submitted: Name and Address of Applicant Wheeler, Billy - 3202 Beanna Street Description of Boat Scow, Sailboat, "Hard Tack", 5-passenger Councilman Bartholomew moved that the license be granted, subject to the approval of the Lake Austin Navigation Board. Shackles, 1709 Mast 12th Street, for a license to operate as a taxicab a 1937 Model Oldsmobile, Motor No. 853999, State License No. 122-759, duly approved by the Acting City Managor, et al., was submitted. Councilman Gillis moved that the application be approved. The motion was seconded by Councilman Alford, and the same prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The application of James Haywood Medlook, colored, 1709 East 12th Street, for a license to operate as a taxicab a 1939 Model, 2-door Chevrolet Coach, Motor No. 1241193, State License No. N18-837, duly approved by the Acting Oity Manager, et al., was submitted. Councilman Gillis moved that the application be approved. The motion was seconded by Councilman Alford, and the same provailed by the following vote: Hayes," Councilmen Alford, Bartholomew, 0111is, and Mayor Miller; "nays," none; Councilman Wolf absent. The application of Alfred Toliver, colored, 2210 Longfellow Street, for a taxicab driver's permit, duly approved by the Acting City Manager, et al., was submitted. Councilman Alford moved that the permit be granted. The motion was seconded by Councilman Bartholomew, and the same prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The application of Fannie Zenobia Wheless, 2403 Fredericksburg Road, for a taxicab driver's permit, duly approved by the Acting City Manager, at al., was submitted. Councilman Alford moved that the permit be granted. The motion was seconded by Councilman Bartholomew, and the name prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," 'none; Councilman Wolf absent. The application of Odis Lavern Smith, 906 West Gibson Street, for a taxicab driver's permit, duly approved by the Acting City Manager, et al., was submitted. Councilman Alford moved that the permit be granted. The motion was seconded by Councilman Bartholomew, and the same prevailed by the following votes "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The application of Willie G. Donley, 1605 Leona Street, for a taxicab driver'e permit, was submitted. Councilman Alford moved that the permit be granted, subject to said application's being properly filled out. The motion was seconded by Councilman G1111s, and the same prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller, "nays," none; Councilman Wolf absent. It was moved by Mayor Miller that the Acting City Manager be authorised to take up and pay off the balance owing, amounting to $300,000 plus interest, on the indebtedness which the City incurred by reason of the purchase of electric lines in the ten-mile area around Austin, and of extensions to the sanitary sewer lines, all of said indebtedness being paid out of the revenues of the City. The motion prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. In compliance with the request of the Athletic Council of the Austin High School for legislation that would insure order, preserve the peace, and promote tranquillity at the football stadium in House Park by banning intoxicating liquors, Mayor Miller laid before the Council the following ordinancet AN ORDINANCE MAKING IT UNLAWFUL TO DRINK INTOXICATING LIQUORS, OR TO BRING INTO OR HAVE IN POSSESSION ANY INTOXICATING LIQUORS FOR THE PURPOSE OF DRINKING IN OR ON THE FOOTBALL FIELD AND STADIUM LOCATED IN HOUSE PARK IN THE CITY OF AUSTIN, TEXAS; PROVIDING A PENALTY FOR THE VIOLATION THEREOF; AND DECLARING AN EMERGENCY. 41 91 The Ordinance was read then the first time and Councilman Bartholomew moved that the rules be suspended and the Ordinance be passed to its second reading. The motion prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The Ordinance was read then the second time and Councilman Bartholomew moved that the rules be further suspended and the Ordinance be passed to its third reading. The motion prevailed by the following voter "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The Ordinance was read then the third time and Councilman Bartholomew moved that the Ordinance be finally passed. The motion prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "naye," none; Councilmen Wolf absent. The Mayor then declared the Ordinance finally passed. The following resolution was submitted: WHEREAS, 0ity of Austin taxes were assessed in the name of W. W. Hornsby for the years 1928 thru 1940, on the House on State Land, Spear League, Plat 99 (House #3101), City of Austin, Texas, said taxes being for the sum of $101.88, and for non-payment of same at maturity, penalty in the sum of $5.09 has been assessed, and interest in the sum of $49.20, making the total amount of taxes, penalty and interest $156.17; and WHEREAS, The City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $5.09 and a portion of the interest in the sum of $41.08; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $5.09 and a portion of the interest in the sum of $41.08 are hereby remitted, and the Tax Assessor and Collector of the City of Austin is authorized and directed to charge said penalty in the sum of $5.09 and a portion of the interest in the sum of $41.05 off his rolls, and to issue to the party entitled to receive same a receipt in full upon the payment of said taxes and the balance of the interest as aforesaid. Upon motion, the foregoing resolution was adopted by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "naye," none; Councilman Wolf absent.
